If the judge does let him out today, could he require him to wear an ankle bracelet?

Where is Barry supposed to live? Isn't that an issue? Would the defense have communicated privately with the judge about the willingness of certain individuals to house him?

I predict bail would be high and would not be arranged by end of business today in any case. I also predict Barry would be able to post his part of the bond and has friends/family who will put their property on the line to secure the bond.
 
Yep he’s gonna walk. The judge just doesn’t want to say so in front of everyone. This is baloney.

The judge is concerned about only one thing. If he finds there is probably cause, will
E&N beat him on appeal? So he is taking a few minutes to put together a decision that will be difficult to overturn.
He's not new at this game. He knows BM killed SM. But he doesn't want to throw away his own career.

Yes - I believe this is true. However, keeping a man in jail when he might be entitled to bail under CO law would be a big misstep for the judge.

We absolutely value a defendant's rights in the US, until that person is proved guilty. It is my understanding that as long as the charge stays Murder 1, the judge has no choice but to withhold bail (although...I wonder if that's truly an absolute...I don't know CO case law well enough to form even a basic opinion).

Based on this full statement, it sounds like he will be going to trial. I am not sure what he would need to explain if it wasn't. I am curious if he needs to piece his reasoning together like they did for the AA.. it's all the things combined and not just one or two things that seal it up. Maybe he needs time to prepare the ruling outlining why.

Reporters waiting outside tweeted that the defense and prosecution were meeting with the judge prior to the hearing. And during the early part of today's hearing, the judge told Lindsey that it was already an understanding on his part that SM was done with the marriage.

It may be that the prosecution had more planned for today, but whatever occurred during that meeting shut certain avenues of testimony off (which may be either positive or negative for the prosecution) and then the judge's admonition to Lindsey alerted the prosecution to the fact that evidence already presented in relation to the state of the marriage was sufficient.

I just hope that Judge Murphy has received training within recent years about domestic violence, the many forms it can take, and the typical ways in which it escalates, so he recognizes what it looks like.
 
I'm thinking BM isn't going anywhere and they will set a date for a hearing next week based on this tweet:

Judge Patrick Murphy said he isn't going to make a decision today. He took 25 pages of notes and there were over 20 hours of testimony. Looks like he is going to talk with attorneys about when the next hearing will be set.

Agreed. I think the "get naked" photos that JL suggested were to/or did take place in the house. Probably her bedroom. It's possible, IMO, that Suzanne was engaging in, or about to engage in the photo sess with JL and may have already undressed in the bedroom or shower.

I'm not a "get naked" photo expert by any means, but those that I have had "privvy" to are almost always in a bedroom or a bathroom.
