CHAFFEE COUNTY, Colo. – A decision to determine whether there’s enough evidence to proceed with the criminal case against Barry Morphew, who is suspected of murdering his wife Suzanne, will be decided by a judge in mid-September.

After 20 hours of testimony in a preliminary hearing that spanned four days, 11th Judicial District Chief Judge Patrick Murphy told the court he would rather make the decision correctly rather than too quickly.

An in-person hearing where attorneys will make further arguments for their case will take place on Sept. 17 at 1:30 p.m. Judge Murphy will make this ruling whether to proceed to a trial thereafter, or whether to let Morphew get out on bond. The arrest affidavit in the case, which has remained sealed, will also be addressed.

Five months after taking office, Stanley expressed confidence she could prove Morphew guilty in court. She authorized the arrest and prosecution of Morphew for killing Suzanne. Before any murder trial though, Chaffee County Chief District Judge Patrick Murphy must make critical probable cause and bail eligibility rulings on Sept. 17.

Prosecutors usually win preliminary hearings. Expect Morphew to be bound over for trial based on probable cause. At this preliminary screening stage, evidence must be viewed in the light most favorable to the prosecution.

To keep Morphew in custody without bail, Judge Murphy must further find there is proof evident or presumption great that Morphew will be convicted of first-degree murder. The defense in this summer’s combined four-day hearing was feisty and formidable. Morphew hired two stellar Colorado criminal defense attorneys, Iris Eytan and Dru Nielsen.

Josh Maximon, an accomplished Colorado trial lawyer and a contemporary of Eytan and Nielsen, told me this dynamic duo have built their solid reputations “case by case,” first as Denver public defenders and then in private practice. According to Maximon, Eytan has merited the affectionate moniker “Hurricane Iris” because “she is a force of nature.”

Judge in Barry Morphew case expected to announce critical decision Friday

CHAFFEE COUNTY, Colo. — A Chaffee County judge will make a ruling on Friday whether a man accused of killing his wife will go to trial or be let out of jail on bond.

53-year-old Barry Morphew faces five felony charges including first-degree murder for the death of his wife Suzanne. He is currently being held without bond in the Chaffee County Jail.

Suzanne Morphew, 49, was reported missing over Mother’s Day weekend in 2020. During a press conference in May 2021, Chaffee County Sheriff John Spezze said that although no body has been recovered, his “belief is that Suzanne is not alive at this time.”

Before Judge Patrick Murphy will make a ruling, both the defense and prosecution will have a chance to give closing arguments. Judge Murphy is also expected to make a decision on whether or not the 130-page arrest affidavit will be unsealed. Morphew is expected to be in court at 1:30 p.m.
 
We’re in Salida today for #BarryMorphew’s hearing. He’s accused of murdering his wife, #SuzanneMorphew, last year. Today, we’ll learn if a judge thinks there’s enough evidence to go to trial. We’ll also find out if Barry will be able to bond out ahead of a potential trial.

Sean Connelly is a new attorney for the defense and Dan Edwards is a new attorney on the state side. Judge Patrick Murphy is limiting the arguments to 20 minutes for each side. Then he will make a decision. A motion was filed yesterday by the defense.

He says FBI had to recover texts from #BarryMorphew phone. He says that shows he had something to hide. He’s now referring to a text from Barry to #SuzanneMorphew playing the “victim.” He says Suzanne is the one who’s been on trial.

Lindsey says when you think of who could have done this it’s #barryMorphew. Lindsey says it’s because Barry wouldn’t let #SuzanneMorphew divorce him because “marriage is for life.” Lindsey says he thinks Barry loaded a syringe in the garage the day of May 9th.

Lindsey says #BarryMorphew missed things because #SuzanneMorphew always wears her camelbak and sunglasses when she rides her bike- both of which were found in her car and not with her bike.

Lindsey says investigators asked #BarryMorphew what he was throwing away on his “trash runs” but Barry continued to say “I don’t recall” Lindsey says that is because he’s using that as a fallback instead of telling the truth.

Lindsey continues by saying what us important is the “tranquilizer” evidence. He says when asked the last the #BarryMorphew saw of #SuzanneMorphew he says she was lightly snoring. Lindsey says that was because of the tranquilizer chemical. With that he wraps up

He added that the bicycle look staged, the bike helmet was staged and #BarryMorphew admitted to being in that area. The fireplace evidence... "We had burned stuff that week," according to BM. 5 separate trash runs, the tranquilizer evidence is significant.

Deputy D.A. said #BarryMorphew couldn't say bye to Suzanne because she isn't there (May 10). The tranquilizer evidence is significant. Agent Grusing said the biologist talked about if SM was tranquilized she would have hypoxia and would lightly snore.

Defense turn: Attorney Connolly is refuting that May 6 is a "Chilling day" like the state is trying to say. He said The murder didn't happen on May 6. May 8 was a fine night according to texts from #SuzanneMorphew & Jeff Libler. Went to town, looked at real estate.

Defense says after the "I'm done" text #BarryMorphew didn't respond with violence. There was no evidence of domestic violence. He didn't say he was going to kill her.
