Chernoff talking about just receiving info from prosecution today regarding arguing this case should be considered "serious felony" and judge is saying he just got it today. Two cases of case law. Judge not happy they just got this today and asking prosecution why they are just getting this today.

(wonder if this would prohibit his sentence from falling under the new law which would get him less time due to realignment sending him to prison instead of county jail)

Walgren telling judge why they just got this to them this morning. Case law they researched this yesterday.

Has to do with realignment law that California has now. Judge is saying that his understanding of the realignment law specifically states that Involuntary Manslaughter does fall under the realignment, Walgren agrees but says these 2 cases can argue could pull this particular case out of the new legislation. Judge asking Walgren if he intends to argue this.
This is very confusing.
 
Judge said he does not think these 2 cases have any bearing on the sentencing due to the new realignment law. (Judge did say he is bound by the law, even though he might not agree with it. I'm thinking he'd give more than 4 years if he could and it would not be county jail).

Moving on to sentencing arguments now.

That was a nice generic statement from the family, I don't know what I was expecting but I thought it would be a little more personal in context.

Walgren's turn now. Sounds like he is just going through what was in the prosecution sentencing memorandum.

There are apparently two cases out there that say involuntary manslaughter is a "serious felony". The incredibly horrible "realignment statute", made necessary b/c of California operating on austerity, apparently lists specific crimes that are not considered "serious felonies", apparently involuntary manslaughter is one of them. Therefore, the statute would supercede previous case law.

Yay, just heard on In Sessions that Brazil and Walgren will be on live tomorrow at 10 am.

At the conference held immediately after the verdict was read and Conrad Murray was escorted off to prison, Ms Brazil refused to make a comment so I'm glad she agreed to come on the Show.

The sentencing hearing is scheduled to start @1:30 CST I believe and alot of people will be watching it.

I really don't know what I expected but yes the statement said a lot. I have never watched a sentencing before so I don't know what is "normal". Usually I don't catch the sentencing so this is a first for me.
