Defense claims judge had inappropriate convo with blogger?

They saw Marinade go up to the judge in court that day. He was sitting right behind the defense (2 rows back) with Holly, Brad, George, Cindy and the Anthonys pet Media Rep...can't recall his name. He had previously given Jose his business card and thereby introduced himself at a PREVIOUS hearing. He was friendly enough with the family to shake hands and chit chat with them, and to offer something to Brad Conway that he had received from a "private source". The defense cannot expect a REASONABLE person to believe they were unaware of Dave Knechel before this motion/interview. They were WELL aware of him and what he does and they SAW with their own eyes him walk up and talk to the judge. So...I guess they can try it, but they are not fooling me for an instant.


If it WERE overturned, if he DID recuse himself, would it THEN be appropriate for the motion to recuse and its reasons to be re-addressed in consideration of the appeal? I mean, would the appeal open a pathway into dialogue about the actual contents and beliefs stated within the motion and the reality of what actually happened? Or is that motion to recuse a closed book once he WOULD step down. What I mean is could his stepping down and the reasons be discussed by the court in the event of a NEW trial?:waitasec:

Obviously they knew something beforehand... an investigator for the defense was there interviewing him... :waitasec:

As I now understand this motion, when considering it, JS must consider the allegations of actual conversation and alleged phone call as FACT, without debating the issue, correct?

So for this motion, JS cannot deny it based on his claim none of this happened, right?

SO...

If this motion is DENIED, and the issue reappears under appeal, under THAT process, will JS be able to respond to the allegations???

I'm just jumping in here, trying to catch up as best I can...

My first inclination is to say they signed 2 copies - one for early media distribution (ya know, they needed time to review and get statements from Dave before the 6 o'clock news) and one to file with the court. The one filed at 4:48pm on Friday would not have given sufficient time for the media to give the defense the headlines they so obviously craved.

ick. ugh.

I wonder if JB charges the same going rate for copies as the Clerk of Court or is he including the copy cost in his bill to the State/ Could he be double dipping?

Ok to clarify about where Marinade was sitting the day of the hearing when the judge called him up to the bench. He was NOT directly beside of George. He is beside Holly B. and Brad C. is seated in the aisle beside of him. George and Cindy and their media man that is always there with them, are right beside of Holly. So he is not "shoulder to shoulder" with George as I previously stated, but in the same row, and he does talk to them afterward and shakes hands with Brad and is very friendly with the entire entourage. So...my opinion still stands that he is friend to the defense. Just wanted to clear up that shoulder to shoulder thing from WAY back in the thread when I first went on the warpath...lol

This is starting to sound like one of those spy stories Joy W told, about government agencies and being followed, and hmmm...:waitasec: Why is it that it seems that people get involved with this case, who have nothing to do with it, and then they go crazy. Why is that?

I say this with nothing but common sense AND without agenda. He needs to just stop. Announcing intent to purchase a weapon? It's not only inappropriate but overly dramatic. There's a 3 day waiting period and with his rantings......I'd bet he may not get that permit quickly. Sheesh......that will be the next story

If you ever read the comments page on the Orlando Sentinel you will see some vicious comments everyday. What people will do to KC if she's acquitted etc- boggles the mind. I don't blame him being wary and arming himself if he feels the need, there is often someone out there willing to do harm to another in a case like this, just for their 15 minutes of notoriety..

I totally understand what you are saying, BUT there is a time and place for that. Right now....this instant, is not the time. There is a ruling hanging out there and he needs to shush until that ruling is made.

I am disgusted by the comments made on a number of sites. While I do not begrudge him his right to bear arms........there is NO REASON to make an announcement of his intent to do so. It just fans the flames and may invite action by another party. Nothing good could possibly come from that statement.

I didn't make myself clear- I was asking as to JS rights re a malicious accusation.

This is true my copies are all identical. I'm thinking as someone back a page said. The "original" was modified before it was given to the clerk. Then the one with the modification was signed and that one was then given to the clerk. So the one that was given to the news agency before it was given to the clerk is the unmodified one. Which means JB is passing his motions to that news agency before the they are giving the to clerks office. Would that be an ethics issue...just wondering.

Did that make sense?....sorry I'm hopped up on Clarintin-D and my head still feels like a 50 lbs water balloon. On the ot did I mention I hate spring/pollen?

Well...if we thought Ms. Kerley's and Mr. Jordan's testimony backfired on the defense...this makes that look like a tea party. No one is going to take anything this guy claims more seriously than a Joy letter or one of those letter writers who spoke of O'Town's finest. This stuff is nonsense, imo!!!

No you are good - that's exactly what I was suggesting about your work and the difference of this defense motion. I didn't think you'd caught the issue "exactly" we were going on about.
