MM, have you heard anything at all about the docs re. Dr. Fairgrieve and Dr. Bock that were to be filed today, per HHJP's order issued on Friday???

Those were due at noon! Could the defense get sanctioned by not allowing those witnesses or at least allowing the prosecution more time if needed?

No, but I'm wondering if they could have been given directly to the SA, to be filed at a later time/date? Or do they have to be filed at all?

The way I interpret the "Amended Defense Witness List" filed yesterday, is that it is not a full List, but only two amendments made to previous Lists. As MM said - TWO WITNESSES REMOVED.

Expert in computers - Larry Daniels -Guardian Digital Forensics, and Expert Michael J. O'Kelly - expert in cell towers and phone.

Larry Daniels:
- on the ORIGINAL Defense Witness List Nov 20, 2008
- NOT on the Amended January 22, 2009 List - Full list
- NOT on the Amended June 30, 2010 List - Experts and Laura B, Jill K, Brandon S, Crystal S.
- NOT on the Amended August 30, 2010 List with the 3 Inmates
- NOT on the Amended August 30, 2010 List - FULL List
- NOT on the Amended Sept 20, 2010 List with the GLOBE guy and girl who heard screaming
- NOT on Amended Nov 30, 2010 List - with all Experts
- REMOVED from Amended Dec 13, 2010 List with one other witness O'Kelly

Interesting to me that this is the FIRST Amended Witness List where the Defense listed who was REMOVED!
They did not file a "Removed" Notice when Dr. Lawrence Kobilinsky was dropped from the List.

I really do not understand how the Defense is allowed to put Expert Larry Daniels BACK ON the list, PAST the Deadline for listing Experts???

I think you may have misread. This filing shows they were BOTH removed from the witness list today. The notice was for REMOVAL from the witness list and JB managed to include another spelling error!

I totally missed the word "removal" on my first reading! I made corrections to my post, but your're too fast for me Numzie! I was surprised because this is the FIRST "removal" Amended List!

Does HHJP make sure that orders are followed? Or, does he rely solely on the prosecution and defense's integrity?

Of course they won't be sanctioned, don't you know death is different? Instead of that, lets just give them more of the taxpayers money to waste. Whole thing is beyond disgusting.

Perhaps the turquoise crayon for Dr Kobilinsky rolled off Baez's desk, so he can't be included anymore.

Judge Perry doesn't have time to follow up with the clerk's office to make sure his orders are complied with. Someone would have to make him aware that it was not done...IF it wasn't done. So far, that appears to be the case.

Yeah, they could be sanctioned or he could punish them in other ways (ie. not allowing them to testify. However THAT would be a long shot, imo.) Okay, even JB & CM aren't SO STUPID to totally disregard HHJP's stern tone when he gave that order on Friday, so I am thinking that one of them possibly called JA and groveled on about how they had been busting their a$$es to get it all together .... maybe emailed them a token amount of discovery... and asked if they could have until tomorrow morning to file the final docs with the clerk. IOW, "JA, please don't call HHJP. We are complying as quick as we can." That is simply a guess. I just don't think they are so stupid that they just aren't gonna comply period.

And do you think Ashton would be all warm and fuzzy and sympathetic about this when the one deposition is scheduled for tomorrow?
 
I do not know if this is permissable ... but wonder if JB asked the Clerk's office not to file the Notice of his Expert witness info until tomorrow?

The other thing could be that Ashton thought the depositions were being done on Wednesday ... so Judge Perry said the info must be filed by JB on Tuesday noon.

But, the deposition of Dr. Fairgrieve is actually on Thursday at 9:00am via Skype.
So, maybe JB was allowed until Wednesday at noon to file the Expert info on both Fairgrieve and Dr. Bock. Dr. Bock's depo is Tuesday Dec 21st.

Thank you - I stand corrected. But it would still be nice to have some time to review the information and plan their strategy for the depo.
