No mistrial, right? The Judge wants to strike the witness testimony?
 
Sure wish the state could ask the judge to recuse himself. That would not be a good move, but I think this judge is somewhere to the left of Judge Perry on the bell curve, and Perry was just awful, IMHO.

Likely strike the witness' entire testimony (IMO, that is wayyyy over reaching).

1:20 p.m. Judge suggests compromise to mistrial

Judge Edward Burmilla has proposed that, instead of declaring a mistrial, the testimony of neighbor Thomas Pontarelli be stricken from the record. He has asked the defense to consider it.

Does this mean that they can still call for a mistrial? Doesn't the judge get to decide that?

I think we have entered an era of defendant friendly judges.IMO of course.
 
What a mess!! If they strike this witness testimony, his wife's testimony will also raise credibility issues with the jury, wouldn't it? UGH!
 
I do think it's important that judges hold everyone to the same standards. And I do believe a fair trial is vital. I'm not so sure this judge's rulings are truly fair or unbiased. Then again, as I said before, I don't know what the state did to warrant such vitriol by the judge.

:innocent: In the beginning, I thought Perry was okay, but after going back and looking at how he handled his courtroom ... the preferential treatment ... blah blah blah ...

I'm one of the few who thought Perry gave into the defense way too much and petted the Pinellas 12 to death.

This judge is blatant with his moves, IMO, almost to 'in your face' unfairness to the victim.

From the very first moment I never liked Perry. I know most people thought he was great at first, not me. I saw a big buffoon who couldn't even articulate his words well and whose rulings were all over the place. His pandering to the jury, to the cameras and his general demeanor were big red waving flags to me. When I see more hot air than simple rulings I know the judge isn't very good.

This judge reminds me of Judge Ito of the Simpson trial. Ito let the defense rule the courtroom. When a judge lets one side dictate everything that's a bad sign. Asking the defense what they think? Who cares what they think. You're the judge. Make a decision and everyone lives with it!

In Session During this break, the defense team is holed up in Courtroom 401, which is directly next to the overflow courtroom. Because the defendant is inside with his attorneys, there is a deputy posted directly outside 401”s front door. The prosecution team is now gathered in Courtroom 402, which is a bit down the hall.

I absolutely loved Perry up until he forced the woman onto the jury who stated she could never go for the death penalty
