Oh, this is an absolute train wreck. Judge, would you just rule already?
 
I think we have entered an era of defendant friendly judges.IMO of course.

They are for the most part running scared of a lethal weapon--the appeal!

For some judges it seems that a perp walking free is better than the judge's record being besmirched by the filing of an appeal.

Of course no one wants a verdict overturned on appeal but some judges do go too far with preventive measures, IMO. When that occurs it creates an even less level playing field than we are obligated to start with. All JMO.

In Session Now some of the attorneys from both sides have left the courtroom again. It may be a while before this is all resolved.
 
So IF they throw out this neighbors ENTIRE testimony, then what. What does the state even have left to offer. They cannot discuss Stacey being missing and LE thinking Drew is the prime suspect. And they cannot discuss Drew threatening Kathleen's life previously. They cannot discuss Drew offering 25 grand to find a hit man. They cannot discuss Drew drilling a hole through the bedroom wall to try and to get to her, because she had deadbolted the door in terror. They cannot discuss the bullet standing upright in the driveway, in order to intimidate the neighbors who were trying to help Kathleen.

What's left for them to present?
 
Judge suggests striking ALL of Pontarelli's testimony.

In Session Defense attorney Steve Greenberg is in the trial courtroom. But most of the defense team – including the defendant, based on the presence of courthouse deputies – is back in conference in an adjoining courtroom.

I can understand why " prior bad acts " are not admissible because their not relevant to the case, but isn't this particular "bad act" relevant to this case?

I think it is relevant to the case, but at the same time the money offer happened prior to Kathleen's death, so it puts it as a prior "bad act." It does clearly point to Drew's desire to see Kathleen die, and happened within a matter of a few months prior to her death.

This is all so wrong. Even if the judge does not declare a mistrial, these moments are putting the entire case on the silver platter for appeal. WTF is the prosecution thinking? They didn't have a strong case to begin with, and now I am just seeing it all come collapsing.

"No doubt"? I know it's his decision but that's pretty strong. I'd have maybe wanted to question the witness privately - see if I could determine whether he was coached in some way to try and sneak the bullet into his testimony.

As for the bullet - when the witness said to Drew "I got your message....", what was Drew's response? Did he ask "what message? What are you talking about?" Or did he seem to know exactly what the witness was referring to?

Nothing. If this a-hole goes free, it's on them.
 
This is a mess. So now we wait. I don't think the judge wants to call a mistrial, because usually they do it pretty quickly. The way he sorta gave the defense a choice of how they wanted to proceed was a indication to me that he may not call a mistrial. I don't think tossing out the entire testimony is going to work either. With a circumstantial case you need all the testimony possible.

To me, if I was on the jury, when I heard someone wanted a deadbolt on their bedroom door, I'd have two questions: was it on the outside to keep her in or on the inside to keep him out.
