KUSA - The father of Dylan Redwine was arrested early Saturday morning in the state of Washington in connection with his then-13-year-old son’s death, 9Wants to Know has learned.

A source familiar with the investigation told 9Wants to Know Mark Redwine was in Washington because he works as an over-the-road truck driver.

According to an indictment distributed by the La Plata County Sheriff's Office Saturday afternoon, Redwine is charged with second-degree murder and child abuse resulting in death,

According to a booking report posted online by Whatcom County, Washington, the 55-year-old is being held on "fugitive from justice warrants."

Trial postponed for Mark Redwine, accused of killing teenage son
The Durango Herald reports a four-week trial for Mark Redwine was scheduled to begin in late February, but it will likely be moved to the summer as a judge is expected to rule on dozens of pretrial motions in the coming months.

Redwine appeared in court last week as attorneys argued motions to determine what evidence will be allowed at trial and where the trial will be held.

Lawyers spent dozens of hours this week in 6th Judicial District Court arguing about how law enforcement obtained evidence and what pieces of that evidence should be permitted at trial. Defense lawyers made a case in closed court Friday for why they think the trial should be moved to a different judicial district, likely arguing that significant media coverage and other factors make it impossible for their client to receive a fair trial in La Plata County. Lawyers can request what is called a “change of venue” if they believe a jury pool may be negatively influenced by pretrial publicity.

The evidence in dispute includes statements Redwine made to law enforcement; the findings of a cadaver dog trained to sniff human remains; and media coverage that included local, state, national and international stories about Dylan’s disappearance and murder, including a two-part episode on “Dr. Phil,” among other issues.

Wilson said he would rule at a later date whether jurors will be allowed to watch the “Dr. Phil” shows, in which Redwine, his ex-wife, Elaine Hatfield Hall, and their son, Cory Redwine, appeared on the show.
 
The court heard from at least three investigators, including an FBI special agent and La Plata County Sheriff’s Office investigators. Lawyers questioned each witness about how they obtained information from Redwine, including whether statements were given voluntarily or through coercive means.

Mark Redwine appeared each day in court dressed in a “2XL” orange jumpsuit with his right hand shackled to his waist. Throughout the hearing, Redwine wrote notes to his attorneys and, at times, advised them verbally.

Prosecutors spent hours trying to convince Wilson that evidence obtained by law enforcement was done legally. They asked questions like: What was the officer wearing on the day she or he spoke with Redwine? Was Redwine told he could leave at any time? Was Redwine ever detained or put in handcuffs?

In asking these questions, lawyers tried to show that law enforcement did not coerce Redwine into making statements. If the evidence wasn’t obtained legally, as the defense argued, the evidence could be thrown out by the judge.

I'm still bleaching from the first time we found out about this.... And still a horror. I can't imagine a twelve year old son trying to process this about his own dad.

Everything went so terribly wrong for Dylan. With his father, and with family court. Both are supposed to protect him and they didn't.
 
I will forever, be amazed at how evil, can appear so normal.

Knowing what we now know, these videos make me cry.
The victims in this case and countless others, never understood how evil the person next to them could be.
I know there is evil on this world. Everywhere.

Everywhere. Be it the USA, Africa, the Middle East and beyond.
The best science ever, would be how to identify humans who have a pre-deposition to murder.
Meanwhile. I am grieving for young Dylan Redwine.

9/10/17 update: Def. Att. asked to ban media interview w/Mark while in jail pending trial & a motion of about how evidence was handled. Could face from 16 to 48 yrs in prison on either count. Judge set a hearing for 12/15/17 to review Def. Team's progress analyzing the 13,000 pgs of evidence. If the defense is prepared to move forward with the case at the Dec. 15 hearing, Wilson would likely schedule an arraignment, a hearing in which Redwine’s attorneys would enter his plea in the case.
12/14/17 update: The defense team for Redwine asked the court for more time to examine thousands of pages of police reports and other documents in the case that garnered nationwide attention. District Court Judge Jeffrey Wilson scheduled Redwine for a second status conference on April 13. 4/13/18: Judge denies motion for continuance. Next hearing on June 29th for Redwine to enter his plea. Next Motion hearings on 10/11, 10/12, pretrial conference hearing on 11/19, trial will start 11/26 and will run about 4 weeks.

10/10/18 Update: Plead not guilty to all charges. All dates have been cancelled (10/11, 10/12, 11/19 & 11/26). More than 100 motions have been filed by Defense attorneys. Those are scheduled to be heard during a two-week motions hearing starting Dec. 3 (thru 12/14). Among the motions to be discussed, at least one will seek to move the trial to a community outside La Plata County, while others will seek to admit or suppress possible evidence. Trial has been set for 2/25/19.

10/25/18 Update: More than 400 motions, exhibits, rulings, proposed orders and judicial orders have been filed. More than half of those filings came from public defenders who opposed expanded media coverage, sought to limit certain types of evidence, wanted to move the trial to a different judicial jurisdiction, objected to certain witnesses and attempted to suppress statements made by their client. One motion seeks to dismiss the case “based on the prosecution’s unreasonable five-year delay in bringing charges,” according to a register of actions maintained by the 6th Judicial District Court. Motions that have not been addressed by the court will be heard during a two-week motions hearing scheduled to begin Dec. 3. Redwine’s four-week trial is scheduled to begin Feb. 25. If convicted, Redwine could spend 16 to 48 years in prison.

Mark Redwine trial set to begin in late June in Durango


The trial of Mark Redwine, a Vallecito man accused of killing his 13-year-old son, Dylan, is set to begin June 24 in Durango.

The trial date and location were announced Thursday by 6th Judicial District Judge Jeffrey Wilson. Lawyers will have a chance to vet potential jurors at the start of the trial.

If it becomes apparent an impartial jury can’t be seated in La Plata County, Judge Wilson said he will consider moving the trial to a different judicial district.

In court Thursday, Moran (defense atty) said the midyear trial setting may be too early for the defense team to have its case ready to go.

“If we’re talking hard setting, sometime around September seems about the sweet spot,” Moran said before Wilson issued his order.

The June trial is expected to take four weeks.
