Official: Parkland shooting suspect's mother let him buy gun

"SUNRISE, Fla. (AP) — Mental health counselors told the mother of Florida school shooting suspect Nikolas Cruz she shouldn’t let him buy guns, but she ignored their concerns and he began assembling an arsenal before her death last year, officials said Tuesday.

Lynda Cruz was “an enabler” who interfered with efforts to get her son treatment, Pinellas County Sheriff Bob Gualtieri, chairman of the Marjory Stoneman Douglas High School Public Safety Commission, told members....

The commission is scheduled to discuss Cruz’s mental health treatment in a closed session Thursday because those records are protected by federal and state law...."

Officials Fighting Release Of Parkland Shooting Videos
The videos may show officers who’ve been criticized for failing to engage the alleged gunman.

"Roughly five months have passed since Florida’s deadly Parkland school shooting, and the public has yet to see exterior video surveillance footage that may shed light on the actions of law enforcement.

On Tuesday during a hearing before the Florida Fourth District Court of Appeal in West Palm Beach, a school board attorney and a lawyer representing the Broward state attorney argued against releasing the videos, The Miami Herald reported.

The school board attorney reportedly said releasing footage from the Feb. 14 attack, which authorities say was carried out by former student Nikolas Cruz, would jeopardize the “integrity” of security at Marjory Stoneman Douglas High School.

The state attorney’s lawyer argued that the footage is “criminal investigative information” and therefore exempt from public records laws...."

"...Robin Sparkman, chief of the state’s Firearm Eligibility Bureau, told the Marjory Stoneman Douglas High School Public Safety Commission that even if Cruz had been subjected to an involuntary, three-day mental health evaluation under a state law called the Baker Act, he still could have bought the AR-15 allegedly used in the Feb. 14 massacre.

Under state law before the shooting, only if Cruz, 19, had been adjudicated mentally ill by a judge or convicted of a felony would he have been ineligible to buy a gun. Cruz was never committed under the Baker Act, convicted of a crime or adjudicated mentally ill.

“So many people think the Baker Act is a magic wand – that the Baker Act cures and fixes all. The Baker Act doesn’t,” said Pinellas County Sheriff Bob Gualtieri, the commission’s chairman. “The Baker Act is a temporary custody status for assessment. Rarely does the Baker Act result in any treatment. People think that if Cruz had been Baker Acted that this wouldn’t have happened. That is flat-out erroneous. Whether he would have been Baker Acted or not is another one of those things that would have had little or no impact on what happened.”..."

Pinellas County Sheriff Bob Gualtieri, chairman of the Marjory Stoneman Douglas High School Public Safety Commission, told members that Broward County sheriff's Capt. Jan Jordan's response was crippled by the county's radio system. The system became overwhelmed as dozens of first responders broadcast information and it started blocking new transmissions...."

Of nearly 195,000 Floridians taken into custody for a Baker Act evaluation in fiscal year 2015-2016, the most recent data available, most were released with no follow-up.

In Central Florida, no more than a fifth of those cases make it to a court hearing on whether to require further treatment, and Miami-Dade County Judge Steve Leifman says that, statewide, less than 2 percent are ultimately deemed a danger to themselves or others and committed to mental hospitals.

These folks who are so sick are just recycling through a failed system

The judge in the Nikolas Cruz case heard a laundry list of items on the docket in a Broward County courtroom Monday....

Cruz is charged with 17 counts of first-degree murder. He faces the death penalty if convicted.

His attorneys say he would plead guilty in exchange for a life prison sentence, but that's something the state attorney has already rejected. The judge also set a tentative trial timeline for September 2019.

"....Broward County Circuit Court Jude Elizabeth Anne Scherer ruled Thursday that Cruz and his lawyers cannot keep parts of his video-recorded confession private just because his case has generated publicity. Defense lawyers said the confession could unfairly sway jurors.

"No evidence was shown that public disclosure ... would result in a serious and imminent threat to the administration of justice in this case," she wrote.

Scherer gave the defense 10 days to appeal her ruling...."

Broward Schools will ask state Supreme Court to block release of Stoneman security videos

"An appeals court on Friday delayed an order forcing the release of school surveillance footage recorded the day of the Parkland school shooting in order to allow Broward County Public Schools the time to file an appeal with the Florida Supreme Court.

The Fourth District Court of Appeal had ordered this week that the surveillance footage from Marjory Stoneman Douglas High School be released Friday, upholding a lower court ruling in favor of the Miami Herald and other media outlets that sued months ago in order to force the release of the video. The footage — showing the moments immediately after the Feb. 14 shooting that left 17 people dead — may shed light on what law enforcement officers did as Nikolas Cruz gunned down students and staff in the freshman building before fleeing campus....

The footage subject to Friday’s decision does not include video from the freshman building where the shooting took place. It is separate from video released months ago by order of a judge showing the actions of former BSO deputy Scot Peterson, the school resource officer who resigned after failing to enter the building where Cruz attacked."

A report by Texas Appleseed shows that schools are falling back on a zero-tolerance approach that has proven to be harmful to students.

That routine happened again following two prominent school shootings this year. The shooting at Stoneman Douglas High School in Parkland, Florida on February 14 left seventeen people dead. "Lawyers for the Parkland school shooter want the judge handling his criminal case to block the release of a report based on his school records — a release authorized by another judge last week....

Broward Circuit Judge Elizabeth Scherer is handling the criminal case; Cruz faces the death penalty if convicted. But the school district asked a civil court judge, Patti Englander Henning, to make the report public because it is not a product of the criminal investigation into Cruz’s actions.

That didn’t stop Cruz’s defense lawyers from asking Englander Henning to withhold the report from the public, while lawyers for the South Florida Sun Sentinel and other media outlets argued that it is a public record that should not be hidden from view.

The judge decided last week that most of it should be released. Portions that violate Cruz’s privacy rights were to be blacked out.

Now lawyers are set to appear Friday morning before Scherer. In court papers filed late Monday, Cruz’s criminal defense lawyers argue that he was not properly represented by civil counsel during the hearing before Englander Henning....

Cruz’s lawyers have until the end of this week to decide whether to appeal the release of the confession."

Throughout the more than 15 years Nikolas Cruz spent in the Broward County school system, staff members reported violent outbursts and antisocial behavior, but others noted periods where Cruz's behavior and academic performance markedly improved. ...

The redacted portions of the report provided a detailed narrative of Cruz's time in school from prekindergarten to just before the Valentine's Day mass shooting at Marjory Stoneman Douglas High School that left 17 people dead and more than a dozen others wounded....

At one point, Lynda Cruz asked the district if he could return to Cross Creek School, where had excelled, but the district determined Cruz was no longer eligible for the program.

Parkland school shooter told detective he heard a demon in his head, transcript shows (with clip)

"(CNN)Marjory Stoneman Douglas school shooter Nikolas Cruz told a detective shortly after the February massacre that a voice in his head the night before the shooting told him to hurt people....

Several times when the detective left the room, Cruz spoke to himself saying, "Kill me. Just (expletive) kill me. (expletive)."

Another time, Cruz said, "I want to die. At the end you're nothing but worthless (expletive) dude. You deserve to die because you're (expletive) worthless and you (expletive) (unintelligible) everyone. I want to die."

'Demon' in his head

Cruz spoke to the detective about what he called a demon in his head, according to the transcript of the interview. Cruz said the voice told him to do bad things, including the night before the shooting. He said it was the voice that told him to buy the AR-15 and to take an Uber ride to Marjory Stoneman Douglas the day of the shooting.

The detective asked Cruz what the demon told him to do. Cruz answered, "Burn. Kill. Destroy."

He told the detective that he sometimes used the drug Xanax and marijuana to make the voice go away.

Cruz said the voice was talking to him while he was there in the interrogation room, telling him to kill himself...."

"In the year leading up to the mass shooting at Marjory Stoneman Douglas High School, killer Nikolas Cruz was stripped of the therapeutic services disabled students need, leaving him to navigate his schooling as a regular student despite mounds of evidence that he wasn’t.

When he asked to return to a special education campus, school officials fumbled his request.

Those conclusions were revealed Friday in a consultant’s report commissioned by the Broward public school system....

In part because of the errors, Cruz had no school counseling or other special education services in the 14 months leading up to the shooting on Feb. 14, the report says....

The long-awaited analysis largely absolves the district of culpability, minimizing mistakes as “compliance concerns” and noting the analysis was not done “through the lens of hindsight.”...
