"After searching Davis's phone through a search warrant later, police say Davis searched for "Walmart near me." Around 9:38 p.m., police caught Davis on camera buying a tarp, two rolls of utility tape and chocolate milk..."

"On July 21, another neighbor told police he saw Davis drag something out of the condo and that it sounded like a heavy tarp. The neighbor said the lights were out in the stairwell, but later came back on. Eventually Cape Coral detectives found that Davis's fingerprints were on the bulbs.

On that same day, documents say Davis bought a shovel and pick-axe at a Clewiston hardware store. He also had bought a hand truck in Cape Coral."

"On July 24, police noticed fresh cuts and scratches on his hands, forearms, ankles and shins. Davis said it was the cat"

The icing on the cake: "From the day Barry disappeared until August, documents say Davis used Barry's credit cards to buy several things, including car air freshners."

Unfortunately, we still don't know where Barry is. Don't know if we ever will. Everyone up here in Chicago need some closure. Friends and family need a place to visit him. I hope that door hasn't closed on everybody....

I would say everything points near the second Airbnb by Lake Okeechobee... Right? Because of all the debris found in that Airbnb including sand? The matted grass outside? That's the area that should be searched....don't you agree? I wonder if they have any other GPS locations besides at that second Airbnb house and the road to it and back? Maybe locations with something on foot? I think I remember reading that he (Davis) was wearing an Apple Watch I don't know if it was Barry's or not. Just my thoughts....

According to the Lee County Court, the suspect in the murder of Barry Schmalbach refused to appear in court on Monday for his case management.

Christopher Davis' attorney waived his presence to the 120-day speedy trial and requested to file a motion of continuance.

Davis' attorney waived his right to a speedy trial, saying he's only gotten through about a fourth of the 2,000 pages of discovery.

The judge said that he wants to hear from Davis himself on waiving his right to a speedy trial, so they'll be back in court Tuesday morning.

The trial for a transient Cape Coral man accused of killing his boyfriend days before he reported his disappearance has been delayed until after early October. Counsel cited an extensive amount of evidence that has not yet been reviewed with the accused killer.

Witnesses said they saw Davis purchase a pick-ax and a shovel and dispose of them shortly after he reported Schmalbach missing.

The next hearing is scheduled for Oct. 10 at 1:30 p.m.

The amount of rage it took to buy that pick axe and then dispose of it shortly afterward is mind-boggling. Absolutely sickening.

I'm pretty sure I read in that 72 page report that at least the pickaxe was saved by Ace Hardware. So there should be some evidence on it. I'm guessing that they (murderer and defense attorney) know he is nailed for hiding Barry's body so they will come up with some type of accidental death for the reason of the cover up. Like sex gone wrong? Something like that? Trying to make it look like it wasn't premeditated murder. So that's why they're delaying this.... so they can come up with a new story. That would be my guess...what do you think?

Well, I think for one, the defense has a difficult client. He first went to SC for his warrant, then was extradited back in June. One article says that he seemed confused in court. He's refused to appear in one instance. So I wonder how he's cooperating with counsel.

Plus, his attorney doesn't merely have to read those 2,000 pages, but he has to review the material with his client, interview potential witnesses, and possibly do some testing of their own. When did they receive all this discovery? I'd bet it's still coming in.

At this point, I doubt they've settled on a defense, or trial strategy. But IANAL. MOO
