This news video puts to rest any idea that the defendant recently visited the apartment/crime scene:

In the defense Motion granted by the Court for an inspection, attorneys are not saying what they were looking for in apartment 201 but only one attorney and a photographer were seen entering the apartment, -- allegedly taking measurements of the bedroom and a closet.

The prosecution and the husband/stepfather both opposed the inspection and the information is being kept private in Court.

Why do Derek Rosa's attorneys want to inspect apartment 201?​

It’s unclear what defense attorneys for the teen facing first degree murder are looking for inside apartment 201 at the complex. Because of client-privilege, Rosa’s attorneys did not go into much detail in open court but gave some hints.

"There are measurements of the closets, of how far that is from the bedroom. Where the weapons were located," said Armando Luis, one of Rosa’s attorneys. "Would assist us in getting into the defense’s theory and state of mind at the time."

Whatever information is gathered from inside the apartment will be kept private since it "is necessary to defend against the allegations."

Rosa’s stepfather, Frank Ramos, Garcia’s partner at the time of the murder, is also against the inspection.

In Spanish, Ramos told Judge Richard Hersch he wasn’t in favor because family members, like Rosa’s biological dad and others, cleaned out the apartment. Ramos, in an effort to try and move on after his partner was murdered, will be turning in the apartment at the end of the month.

“The order will allow a 3-hour block this Thursday afternoon. There will be police presence outside the front door. They will not be entering while you are inspecting the apartment. Persons allowed in the apartment 1 attorney, 1 forensic examiner, 1 photographer," Hersch ordered.
 
I wonder if the stepfather will want any further contact with his stepson. He probably did his best to be a good stepfather before this tragic event, but now? I don't think anyone could possibly blame him if he never wants to have anything to do with him from now on.
I noticed the stepfather (Frank Ramos) is now being blurred out of the "family photo" that was first being circulated including the victim when pregnant.

Also, I wondered if FR is seen in the courtroom photo (post #129) seated furthest from the bio-dad, next to woman with raised, clutched hands.
 
Defense attorneys previously said they have about six witnesses set for day two of the evidentiary hearing, which was scheduled for Thursday but was pushed back to next week so attorneys have time to review records from the corrections department.
Per court records by @PayrollNerd, the hearing is set for 12/14 at 9AM.

Given how eager the defense was when they requested the hearing, perhaps the boy wonder image is beginning to crack after allegations DR's been communicating from Metro West with others than his attorney and family. If true, he wouldn't be the first inmate caught using the pin number of another inmate to make calls outside. IMO, he's exactly where he needs to be.

In court, attorney Armando Luis said their client’s life is on the line, but did not give specific details as to why they really want to go inside, per attorney-client privilege.

Ramos added that family members have taken the victim's and the defendant's personal items from the apartment.

Judge Hersch questioned why defense attorneys were asking to go into an apartment more than a month after the murder, especially since many people had gone inside.

Judge Hersch said Ramos has the privacy right to decide who enters his apartment and wonders if he even has the authority to approve this emergency request.

State attorneys argued police had already legally inspected and recorded the apartment as protocol.

So? Somebody has to be. He is a teen, and IMO he should be with other teens, not children. Especially given what he is accused of.

Exactly! -- And unlike Metro West where inmates young and old are awaiting trial for serious, adult crimes, I do not like the idea of DR being housed for the next year with detained juveniles pending adjudication, disposition, or placement in commitment facility, and where the average length of stay is about two weeks! In other words, it's already been decided that DR is being charged as an adult! I also fear this kid is capable of predatory behavior if housed in the MDJDC-- especially long term. JMO

The Miami Dade Juvenile Detention Center is a 98 bed, hardware secure facility that serves youth detained by various circuit court(s). Youth are detained pending adjudication, disposition or placement in commitment facility.

The facility provides supervision of youth in a safe, secure and humane environment. Services for youth include: education, mental health, substance abuse, and health care. Medical and mental health are contracted services. Educational services are funded by the Department of Education through local school districts.

A typical day in secure detention would involve hygiene, meals, school, structured physical and educational activities, and court appearance as scheduled.
The average length of stay in secure detention is approximately 15 days.

Disturbing babycam footage shows a 13 year-old Florida honors student standing over his sleeping mom in her bed, moments before he allegedly murdered her.

Derek Rosa was seen in an eerie black and white image released by Miami-Dade District Attorney's Office Monday, looming over his 39 year-old mom Irina Garcia in her bed on the night of October 12.

The time stamp on the static image shows 11pm. Rosa called 911 to report the murder around 11:30pm.

If it is Derek, the photo on the top R is even more disturbing.
 
Right, and where’s the knife? I’m assuming he knew he was on camera.

Since these are crime scene photos, I think it's safe to assume the knife is in police evidence, right? I don't think the State DA's office would release pictures of the suspect actually committing the murder with the knife in his hand -- bad enough to see his bloody hands throwing signs!

I just don’t understand how he has his whole family supporting him. I don’t get it…. If he’s evil, you think you can manage and control that!? (Directed to his father/supporters)

Because his family sees him as their 13-year-old boy. They surely realize he is troubled, but they can't just switch their love off, so they have to process it differently. It's much easier for us as outsiders to see him in a different light.
