LIVE BLOG - DAY 4 A.M.: Investigator delves into call, location, text records in Charlie Adelson’s murder trial.
12:15 p.m.: Lunch break
12:01 p.m.: FBI agent testifies on recording the Dolce Vita meeting
Cappleman summoned the next FBI agent. This agent said he was surveilling Charlie Adelson for the FBI’s undercover operation related to Markel’s murder.
He was present at the bump in a security role. Then the investigator attempted to watch a meeting between Donna and Charlie Adelson.
He also tried to record a conversation between Charlie and Magbanua at Dolce Vita.
“I was instructed to make my way to the Dolce Vita restuarant. At the time I arrived, I was handed some recording equipment in a bag... and I tried to position myself close to Mr. Adelson...” he testified.
The witness described the bag as a messenger bag made of leather with many small holes throughout the front. It was outfitted with audio equipment and it was in proper working order that day, he testified.
“So they were seated toward about as far back in the restaurant as you could go... and there was I think one table between us and them,” he said.

The defense objected to the prosecution submitting evidence related to the recording, but the judge overruled the objection.
Then the defense began to question the witness.
He asked the witness to testify about the noise level in the restaurant at the time the pair met. The agent testified that the audio wasn’t excessive, but it was noisy like most restaurants.
11:40 am.: FBI agent testifies on “the bump”
The undercover FBI agent who completed “the bump” is on the stand.
His image and identifiers may not be published to protect covert operations he is currently working, the judge instructed the gallery and media.
This agent said he was posing as a member of the Latin Kings, a South Florida gang of which Luis Rivera was a member.
He ran into Donna Adelson on a street in 2016 and handed her a printout of a news article about Markel’s murder and pretended to extort her. The printout had a cell number and $5,000 written on the front.
The bump was recorded with video and audio, the witness testified.
“The whole point of the bump was you knew Katherine Magbanua was getting paid over time, right?” Rashbaum asked.
“That’s what I was told to say to Ms. Adelson,” the agent said.
The team knew that Rivera was a member of the gang and had the agent pretend to be an associate of Rivera’s when extorting Donna Adelson.
The defense said the wrong date for the bump while speaking to the witness.
“What day was it, I always get it confused,” Rashbaum asked the witness.
The agent testified that he never spoke with Sigfredo Garcia. He does remember talking to Charlie Adelson on a phone call. He told the agent that he would call him back, but the agent testified that Charlie never did.
The operative said he sent Donna Adelson a text, but he didn’t remember the content of it. The defense characterized it as threatening, but he wasn’t sure.
“I don’t think it was that bad,” the agent testified.
Rashbaum attempted to read the message and mispronounced the word “p*to,” a vulgarity in spanish. The witness corrected him, and the defense attorney said his Spanish isn’t great.
“I’m going to defer to the witness on the Spanish,” Everett said, laughing.
Then, the agent testified about his approach to the operation.
“I was instructed not to be so gang-like to Donna Adelson, actually to be polite,” he said.
10:40 a.m.: Defense and prosecution question investigator on travels
Rashbaum is asking Corbitt about a party he says Donna and Charlie Adelson planned for Harvey Adelson.
The witness clarifies some points related to Wendi’s whereabouts the day of the murder and Donna and Harvey’s travels to Orlando in 2014.
One of the points both sides of the court are focusing on is that Donna Adelson texted her son Charlie that she was “outside” his house the day of the murder.
The defense is focusing on the house’s proximity to the turnpike and suggesting that the Adelson parents were passing it.
The prosecution is focusing on Charlie’s response, which was “10 minutes,” and suggesting that she visited his home that night.
Katherine Magbanua testified Monday that she believed the Adelson parents visited her then-boyfriend Charlie’s home that night and delivered him the money that was used to pay for the hit.
Magbanua suggested that Donna Adelson may have washed the money before dropping it off at her son’s home. On the witness stand Monday she said that the money was in an envelope and was moldy when she opened it.
The South Florida convict also testified that Charlie told her his parents had been at her home right before she arrived there. Magbanua said Charlie rarely stored large sums of cash in his home, leading her to believe his parents visited the home and delivered the money.
A little off topic but noteworthy: Ruth Markel is back in the courtroom again.
The defense asked to re-cross examine the witness, and the judge said he usually didn’t allow it but he’d allow one question. Rashbaum said he had three questions, and the judge told him he could have one question and to pick carefully.
Rashbaum conferred with co-counsel Kate Meyers, and they asked Corbitt about Wendi’s location at the time of the murder.
The phone records indicate Wendi’s phone pinged at a phone tower relatively near her ex-husband’s home that day, but the defense emphasized that it was not the nearest cell tower to Markel’s home.
10:15 a.m.: Ruth Markel is asked to leave
Tallahassee Police Sgt. Chris Corbitt is back on the stand testifying about cell records around the time of the 2014 murder. It’s defense attorney Daniel Rashbaum’s turn to question him.
The Markel parents, Ruth and Phil, have sat in the gallery for all of the trial so far. But as Corbitt testified Tuesday morning, an alarm connected to Ruth’s phone or watch began to ring.
Circuit Judge Stephen Everett ordered a bailiff to escort her out of the room.
After his order, the prosecution and defense met with the judge. The judge addressed the courtroom, saying this would be the last warning for the gallery to silence their phones or be asked to leave.
