I've previously read this was a strategic move by WA to delay the hearing. Didn't this (delay) also result in a different Judge?

Maybe it was some tactic, I paused on that page. Still hard to read it all but from what I can tell it seems like her attorney is withdrawing and alleging that Dan not paying his portion per the Marital Settlement Agreement & so because of that, her attorney is not paid and seeking to withdraw. But JMOO

A lot of people with experience, i.e.,in jail/prison actually use incarcerated. It's how it's used throughout most of the arrest to trial to prison process so a lot of felons/ex cons use it.

During the defense opening -- they used the argument that the prosecution's initial Dolce Vita wiretap wasn't good enough evidence to charge CA in 2016, and there is no difference in the audio they want in evidence in 2023!

This was the first warning they were not going to give up trying to keep this recording out of evidence.

Good that Judge Everett allowed the audio in -- even if the reason was KM validated the tapes. JMO

Doesn’t matter the context, this DV tap loses his defense in any normal galaxy. You have him telling his mom to go to the police if she’s being bribed after thr bump, here it’s CA telling the supposed master extortionist KM and her hitmen pointers and facts when he’s supposed to be so petrified of them lol, and showing he was willing to shoot someone who rolled up at his house for extortion because he’s a damn periodontist and they’d be just a dead gangbanger in the driveway. He says the police will believe him over the gangsta.

Would he seriously be saying this to the woman who is supposedly bribing him? How can he argue there is any first level bribery? And him, continuing to speak code to his mother in private conversations, so that what, the FBI or the police won’t find out that he is being extorted and fearing for his life From the first extortion? It’s laughable.

Law enforcement did an excellent job identifying SG, LR and KM, and following up with the investigation. That took a lot of effort.

CA's attorney dug himself going so hard for the extortion defense. Now how does he even spin these dolce tapes into making any sense with that defense. He must have been thinking they weren't going to get in...

Also is this guy considered a good attorney in Florida? Every day I'm less and less impressed.

For clarification, the "Bump" occurred on April 19, 2016, months before there had been any arrest for Dan's murder.

What's clear is that as early as April, investigators had LR and SG on their radar, and were preparing to present evidence to the grand jury.

(FBI undercover would have also been aware that LR had already been sentenced to BPO so it was interesting to hear the 'brother' tell DA that LR ("Tato") was incarcerated).

I'm curious if CA was aware of LR, and that he was in custody since May 2015. Didn't I read LR reached out to KM to post his $250K bail?

I wonder if KM ever asked CA for $$$ to spring LR from jail, or if KM thought this ask might be too close to home for SG (after the couple was now reconciled).

In May 2015, LR was indicted on one charge of Conspiracy to violate the RICO Statute. LR's arrest was part of a sting by the Feds where they took down 23 gang members from across Florida.

By Nov 2015, LR entered a guilty plea agreement for his single count of conspiracy to violate the RICO Statute, and the US Attorney agreed to recommended LR sentenced to the low end of the sentencing guidelines or 151 months (versus 260 month/20 years).

On Jan 22, 2016, the Court accepted the US Attorney's recommendation and sentenced LR to 151 months in prison with 3 years supervised release.

Twelve + years was a big hit for LR for essentially being associated with the LK since he wasn't charged with any predicate offenses under RICO. IMO, I think part of LR was relieved to be picked up for the lesser federal offense and was thinking about a future murder charge when he Motioned for a Reduction of Sentence Based upon Retroactive Amendment 782. His motion was denied in June 2016.

On May 25, 2016, SG was apprehended during a traffic stop, and arrested for possession of a controlled substance.

On June 17, 2016, a grand jury in Leon County indicted SG and LR on charges of first-degree murder in connection with Markel's killing. Both defendants were facing State of Florida death penalty upon conviction.

On October 1, 2016, police arrested KM; she too was charged with murder.

Days after KM's arrest, on October 4, 2016, LR pled guilty to the charge of murder as part of a plea bargain in which he was sentenced to 19 years in prison, which would run concurrently with another sentence (i.e., Federal RICO Violation) he was already serving.
