Noor Salman trial: Judge denies defense's motion for acquittal

"The judge in the Noor Salman trial denied her attorneys’ request to throw out the charges against her Friday.

Salman and the jurors were not in court — jurors have Fridays off from the case, and Salman waived her right to appear for the legal arguments. They will be back Monday, when the defense will begin putting its witnesses on the stand...

As the hearing began, U.S. District Judge Paul Byron noted that he is required to view the evidence in a “light most favorable to the government.”...


Jurors will be able to decide whether the evidence they heard from FBI investigators and other witnesses is credible. But for this hearing, Byron said he is required to presume that the evidence the government presented is credible and err on the side of sending the case to the jury....


Byron on Thursday said he was concerned after an FBI agent testified that within days of the shooting, agents knew cell-tower records offered no evidence Salman and Mateen drove around Pulse the week before the shooting. He questioned why he was not given the information sooner after Salman’s arrest in January 2017. It was among the factors Byron cited in his decision to keep her in custody until the trial.


“We drove around the Pulse nightclub for about 20 minutes with the windows of the car down. Omar was driving slowly, looking around and at one point stated ‘how upset are people going to be when it gets attacked,’ ” FBI Special Agent Ricardo Enriquez wrote. Salman added a note in the margins in her own handwriting — “I knew he was talking about himself doing the attack on the Pulse.”

Salman also talked about trips to Disney Springs and City Place in West Palm Beach, which agents were able to verify.

Those issues did not come up in court Friday. Byron said Thursday that he is open to discussing them at a later date...."

"ORLANDO, Fla. - Attorneys for Noor Salman are calling for a mistrial after they say new details from prosecutors reveal that Pulse gunman Omar Mateen's father was an FBI source and is currently under a criminal investigation.

According to a motion filed by the defense, prosecutors sent an email on Saturday that stated Seddique Mateen was a confidential FBI source from 2005 through June 2016.

The email also stated that Seddique Mateen is being investigated for money transfers to Turkey and Pakistan after documents were found in his home on the day of the Pulse attack.

Salman's attorneys claim the late disclosure of the information prevented them from exploring whether or not Seddique Mateen knew of his son's plans to attack the nightclub on June 12, 2016.

The government email to Salman's attorneys also states that in 2012, "An anonymous tip indicated that Seddique Mateen was seeking to raise $50,000-$100,000 via a donation drive to contribute toward an attack against the government of Pakistan."

According to the motion, the defense states that the decision not to give Noor Salman a polygraph was possibly "based on the FBI's desire to implicate Noor Salman, rather than Seddique Mateen in order to avoid scrutiny of its own ineptitude with the latter."

The defense also said Seddique's connection with the FBI played a role in a 2013 investigation into Omar Mateen for allegedly making threats against coworkers.

On June 11, 2016, Salman and Mateen both told Mateen's parents that he could not come to a mosque for Ramadan dinner because he was having dinner with Nemo. Nemo said he was in Baltimore at the time, but wasn't surprised to hear he used him as an excuse.

Salman's attorneys claim the late disclosure of the information prevented them from exploring whether or not Seddique Mateen knew of his son's plans to attack the nightclub on June 12, 2016.

The government email to Salman's attorneys also states that in 2012, "An anonymous tip indicated that Seddique Mateen was seeking to raise $50,000-$100,000 via a donation drive to contribute toward an attack against the government of Pakistan."

According to the motion, the defense states that the decision not to give Noor Salman a polygraph was possibly "based on the FBI's desire to implicate Noor Salman, rather than Seddique Mateen in order to avoid scrutiny of its own ineptitude with the latter."

The defense also said Seddique's connection with the FBI played a role in a 2013 investigation into Omar Mateen for allegedly making threats against coworkers.

“Mateen’s father played a significant role in the FBI’s decision not to seek an indictment from the Justice Department for false statements to the FBI or obstruction of justice against Omar Mateen” during its 2013 investigation into his alleged threats," the motion stated...."

Making a general statement here, not about this case in particular: Any defense attorney/defendant will seek the undermine the credibility of any investigative or law enforcement agency involved in the case. Sometimes it will be valid, sometimes not, but they will always raise suspicion and cast doubt. It does not surprise me to see it.
