Now the question on everybody's mind will be "are we ever going to find out WHAT the tests revealed"?

Thanks Spanish for the updates today. Would the grand jury who made the indictment on 1st degree have knowledge of the tox results? Anyone know?

They may, which it would be up to prosecutor whether or not to present that as evidence

Thanks. That was fast!

Should have said this earlier --
:usa: DON'T FORGET TO VOTE!

Hi! My first thought when I read this your being optomistic! I really dont think they could determine what he was on, if anything, Well see!

As I understand it, all cases where 1st degree murder is being charged must go in front of the grand jury.

Also, I could be wrong but once a case has went in front of the grand jury, aren't all of the facts the grand jury had to make their decision made public?

See, this is the kinda stuff I dont grasp. why do we need a grand jury? We have witnesses who happen to be LE that found him with a cheek in his mouth. Is that not enoguh?

The grand jury serves a very special function in Florida’s criminal courts. The only charge a State Attorney cannot file based on his or her constitutional authority is first degree murder. All first degree murder cases must be presented to a grand jury.

The grand jury is just considered due process of law. A mistrial could probably be declared if everything wasn't done one step at a time. That's the LAST thing that needs to happen.

I dont think so I think the grand jury stuff is totally hidden

I don't live in Florida, but many of you do. I'm not sure I understand the total process. Too technical for me. Anyways --
What about the Florida Sunshine Laws which allowed for a lot of shared info in the Casey Anthony case?
I think it has also helped in the Sievers case.
Yet, not as much was shared in the Billings case. I don't know if it is media driven to get the info made public, but it seems to allow access to the info.
Federal agencies don't fall under it though. However, I think we will find out the tox results sometime soon. The grand jury went for first degree murder which I think indicates more than a sudden mental illness.

What is the Sunshine Law?

:cow: MOO ... I want to know if he was on any drugs.

Think that may be correct.

Yesterday the Grand Jury upgraded his charges.

Tuesday afternoon, a Grand Jury upgraded the charges from second-degree murder to two counts of first-degree murder in connection with the deaths of Michelle Karen Mishcon, 53, and her husband John Stevens III, 59, of Hobe Sound who were killed on Aug. 15.

Investigators at the time said Harrouff was not on cocaine, pot or opiates during the attack but have not ruled out other drugs.

Sheriff William Snyder told WPBF he wasn’t shocked at the Grand Jury’s decision, saying, "I think the big factor in this case is that we arrived while this was in progress and there was no doubt to us what occurred."

Snyder says the next step is to now prepare for trial, though it may still be months away. The Sheriff’s Department will be focusing on creating a case and issuing subpoenas.

Sounds to me from what we do know, a conviction should be easy for prosecution. I hope they have some dang good Psychiatric doctors on LE's end.
Side note, I noticed he is not in the suicide protection outfit, wearing orange and white in the court appearance.
Another side note, before all this he got to eat and drink what he chose, like we do! Now that choice is made for him, I wonder if he likes the menu....

I think he looked surprisingly healthy in the newest video, especially compared to the day he was arrested.
