No trial date has been set.

A trial date is set for Robert Howard, the man accused of kidnapping and killing 12-year-old Naomi Jones.

In 2017, the convicted sex offender was charged with first-degree murder. Jones' family will have to wait until March 2020 to see the man accused of killing their loved one go before a jury. By then, it will have been almost three years since Jones' body was found in Eight Mile Creek in Escambia County. Th State Attorney's Office is seeking a death sentence.

Assistant State Attorney Greg Marcille says death penalty cases require more evidence and expert testimony than other cases. He says in death penalty cases several motions are filed. Some may question the constitutionality of the death penalty and may have to go before a judge. He says it is common for death sentence cases to take years to get to trial.

"We do work hard on them, but we want the case to be done correctly by the State Attorney's Office. We want to ensure everything is prepared and the defense attorneys are ready because with the nature, they are required to do the same thing. That can lead to continuances," Marcille said.

He is confident the case will be tried starting in early March but says other issues could push it back. Marcille says the attorney assigned to the case has two other death penalty cases scheduled around the same time. Depending on how long those take, it may impact this trial's date scheduled for March 4. It's also hard getting the time needed from a judge to prosecute death penalty cases, with some trials taking more than two weeks.

Naomi Jones murder trial set for March, suspect Robert Howard faces death penalty

Court proceedings are scheduled to begin next month in the murder trial of Robert Howard, an Alabama sex offender accused of killing 12-year-old Pensacola girl Naomi Jones.

In a hearing Friday afternoon, attorneys argued whether the specific details about the condition of Naomi's remains were important evidence or just gory details meant to draw an emotional response from jurors.

State prosecutors said they plan to suggest to jurors that Howard may have committed sexual battery against Naomi before her death. However, her remains were too badly damaged from her time in the water for a medical examiner to draw any definite conclusions.

Prosecutors want an expert to be permitted to testify that, among other things, wounds Naomi sustained during sexual battery may have attracted marine life to the girl's remains.

Defense attorneys counter that there is no evidence or testimony to suggest Jones had any open wounds, and that the testimony would just be a roundabout way of suggesting to jurors that there was evidence of a sex crime when no such evidence existed.

A judge is weighing both arguments and is expected to issue a ruling in the coming days. Jury selection in the case has been set for March 16.
