What is always alarming to me is how parents who abuse their partners still are allowed around their children.

In this case, and many others, women and men have no choice but to allow these abusers to visit with their children, not only endangering the children, but themselves as well. Heaven forbid a parent tries to protect themselves and their children from harm- they'll get arrested for doing so. Yet the abusers always seem to walk free, perhaps take a parenting class or two.
 
I'm kind of thinking if an abuser tries to kill the other parent, the abuser should be serving a long sentence for attempted murder. I agree - how are the kids safe to be alone with that parent? Makes zero sense to me.
Yes! And the burden should not be on the victim to press charges for DV. The state should press charges on their own if there is evidence. The victims are too often intimidated into dropping charges. If there is physical proof of abuse, that should equal prosecution by the DA (and immediate loss of custody/visitation). Imagine how many lives that would save!

Yes Yes Yes!!! I completely understand being afraid to press charges - the horrible years after the event being intimidated, bullied, scared, etc. You just hope you can appease the person to prevent any danger and suffer on egg shells and pray you get through the years of "co-parenting." Nicole should have had complete protection after the attempt on her life, for God's sake. It's high time that the numbers of abused/murdered former partners/spouses be taken seriously and new laws/protections be put FIRMLY in place.

K-9 teams are out in St. Cloud this morning to help in the search for a missing woman, Nicole Montalvo. Meanwhile, her estranged husband, who is a person of interest, will appear before a judge this morning on unrelated charges:

Estranged husband of missing Osceola County mother makes first appearance in court

Christopher Otero-Rivera is a person of interest in the disappearance of the 33-year-old Montalvo. However, he has not been charged with her disappearance.

His appearance on Saturday morning was for a violation of probation.

During his appearance, Otero-Rivera didn't say anything except for his name and date of birth. The judge appointed him a public defender, who asked for a bond of $1,500 citing it was a misdemeanor. The state asked for no bond.

The judge, stating that she doesn't have a warrant, decided to hold him on no bond and his appearance will be bumped to Sunday so they can get the proper documents in order.

Well this is not going to end well IMO as most of us predicted ....

Exactly. The "negative effects" of the children not visiting the abuser are minimal - if non-existent - and statistics prove that the most dangerous time for women is when they leave or try to divorce the abuser - who usually uses the children as pawns in these cases to get to the mother. (Yes, it's usually the man who kills the woman, and often the children along with her.) Why not err on the side of caution to prevent these murders?

And what has happened with the son - why doesn't the news or LE say "the son is safe"? That one sentence should be allowed for them to say without giving up too much information, no? It scares me that there has been no mention of the child being found safe.

El alguacil del condado Osceola confirmó que hallaron lo que creen son restos humanos en la parte posterior de la propiedad donde la madre hispana, Nicole Montalvo, fue vista por última vez, allí viven el padre y los abuelos de su hijo.

La mujer fue vista por última vez el lunes 21 de octubre alrededor de las 5:00 p.m. dejando a su hijo con sus abuelos y padre en una residencia ubicada en Hixon Avenue en St. Cloud.

Se suponía que Nicole debía recoger a su hijo en la salida de la escuela Harmony el martes 22, pero nunca llegó y su teléfono celular ha estado apagado.

Lo agentes no han determinado si los restos corresponden a un hombre o una mujer.
 
Ugh I’m very worried that the whole family was a witness to her murder on that property after 5pm on Monday... always hate to wonder what the little ones have had to experience and witness... and hate to think of grandpa and grandma being complicit in this horror...
