Miami-Dade Attorneys' Billings Under State Scrutiny, Burdening a Teetering Death Penalty System

Feb. 24, 2022

A state commission has recently taken action against seven Florida defense lawyers — all hailing from Miami-Dade County — as part of an investigation it says has uncovered fraudulent billing practices, referring some lawyers to law enforcement, the NBC 6 Investigators found.

With some defense attorneys suspected of submitting questionable billings now blocked from getting state funds for new cases and a shortage of eligible attorneys to take on death penalty cases, stakeholders say the death penalty system in Miami-Dade is “broken” and at risk of a “constitutional crisis.”

Since 2020, NBC 6 found the Justice Administrative Commission (JAC) in Tallahassee has suspended or blocked seven attorneys statewide from being appointed by judges to new criminal cases as part of its investigation into billings.

The NBC 6 Investigators found all seven are Miami-Dade defense lawyers, including several who’ve handled some of the county’s most notorious murder cases.

They have represented some of the most notorious accused killers in recent county history, including:
  • Jorge Barahona, still awaiting trial 11 years after he was charged with murdering his 10-year-old adoptive daughter, Nubia;
 
I’m not surprised that there are investigations. Miami is a world of its own. It isn’t really like anywhere else in Florida.

Okay - something weird happening with Carmen's case - from my notes:

Plead guilty to 1st degree murder & aggravated child abuse on 2/21/20. Plea deal gives her a life prison sentence in exchange for testimony against her husband. Sentencing will be after she testifies against her husband as agreed.

But now she has a trial date coming up?? Did she rescind her plea too??!!

All I see is this entry and nothing about taking back her plea...

The case has been moving through the courts some 11 years, and switching attorneys will only add to that timeframe.

“Although there has been a tremendous work and money spent on the representation in this case, I feel that the court basically does not have a choice,” the judge said in court.

Yes I know that the court site says that - but they have added a trial date for her - the same as Jorge. That's what I was questioning in my post above yours. Maybe the clerk made a mistake & updated her site the same as Jorge's - ??

Yes, and if memory serves me correctly - he got different lawyers (again!) after these guys...

11 years is WAY too long - like @mickey2942 - longer than Nubia has been alive!!
 
JB has nothing to look forward to but death row. So why not obfuscate the legal process for as long as possible?

Maybe this is a textbook case against charges with the death penalty. I believe that he was charged with the death penalty to get a quick plea. Backfire.

At this point in time, a trial is almost a joke. Who can remember back that far? Where are the witnesses now? I have no doubt that JB will pull another stunt to stall the process. On and on.
 
It truly is ridiculous how more is done for the person how has took Nubia's life than anyone cared for Nubia. This should not be allowed. I'm sure he wouldn't be doing this if he had to pay for his own lawyers
