Trial of man charged in girlfriend's murder placed on hold

Now the trial must wait until the state makes a case for why Rodarte's petition should be denied. The defense will get an opportunity to respond before the appeals court hands down its ruling.

Both sides are expected to appear in Duval County court on Sept. 23 for a status hearing.
 
It looks like we will indeed get to see much more at the first district court level during this process, including possibly live stream of the arguments if it goes to that.

This is so effing ridiculous.

I think he's got a good public defender that is pushing it, possibly to make the point that he has been overcharged and they should plead it out.

I kept in the back of my mind that there might be a plea deal if the state gave him a manslaughter charge (maximum 15 years without a weapon , maximum 30 years with a weapon) which as of yet is not an option that they have offered?

From what I've read so far, that may be the more appropriate charge *for a conviction* than a second degree murder charge. (a la Michael Drejka who was just found guilty of manslaughter 10:40 pm last night for shooting a man at a convenience store in Florida

His telling the officers that the scratching of his neck was not from her during a passionate struggle though actually ends up not helping his case. As the Miranda warning says, his words can and will be used against him.

Savannah Gold's parents: 'We are seeking justice for our daughter' News4Jax with three minute 13 second newscast, including an interview with her parents and article.

"In that time, I was looking. I went to Bonefish. I went to the bank, trying to secure footage. I went to try to get her phone pinged," She**i Gold said. " I was doing everything because I knew something was wrong."
Gold's family is disappointed by the delay.

"This person has taken the most beautiful thing in our lives away from us and we can not allow that person to take more control over our emotions," said Da**el Gold.

"My cancer has come back twice, but chemotherapy, surgery, nothing is going to keep us from those hearings. We have been to 26 hearings out of the 27. We have had to be in the same room with the person that took our daughter's life. We need this to end," said S**rri Gold. "We are seeking justice for our daughter."

“I feel like she gave up a lot because I was sick,” Sh**ri Gold says. “She had an art, sports, academic scholarship to SCAD [Savanna College of Art and Design], and she didn’t want to go, because I had just gotten over surgery and chemotherapy, and she wanted to stay here with me.”

“There were times where I was supposed to have chemo, and we rescheduled,” she said, “because we were going to be at the hearings no matter what.”

Appeals court orders delay in Mandarin Bonefish Grill killing. Jacksonville.com article that I missed last week so adding it now.

Judge Marianne Aho heard testimony over two days including testimony from an assistant medical examiner who said no drugs were in Gold’s system and she did not have any broken bones or fractures.

The Medical Examiner’s Office ruled that the 21-year-old Gold died by homicidal violence but could not give a specific cause of death because much of Gold’s body had been badly burned and it was also in a state of decomposition when Rodarte led police to it.

Aho denied the motion Aug. 22 and ordered that that the trial proceed on Aug. 26. Rodarte’s team filed an appeal.

Rodarte’s trial could be postponed for months.

This is heart wrenching to read.
 
Trial delayed in case of man accused of murdering Bonefish Grill coworker

The accused killer, Lee Rodarte, appealed his Stand Your Ground claim, delaying the trial indefinitely.

The man accused of murdering his co-worker at a popular Mandarin restaurant in 2017 is taking his Stand Your Ground claim to the First District Court of Appeal.

Lee Rodarte, who is accused of killing Savannah Gold and dumping her burned body in a Westside lake, appealed a judge’s denial of his immunity motion.

Florida’s Stand Your Ground law allows someone to use deadly force if they have a reasonable fear of death. Such claims are typically filed early in a case before formal charges are filed. Rodarte’s petition was filed in July, two years after Gold’s death.

The appeals court automatically stayed court proceedings, putting off Rodarte’s trial..

The court asked the state to respond within 30 days as to why the Stand Your Ground motion should not be granted. Rodarte will then get another 30 days to respond.

ETA, the First District court is in Tallahassee Florida.

Wait, what?!?!? I hadn't been following this case recently and just saw this - he's using a Stand Your Ground Defense?!?! Against a tiny little girl? OH PLEASE!!! And then he burned and dumped her? COME ON!

I can't believe the judicial system has to entertain this nonsense for even one second. Poor Savannah's family. Stuff like this makes me so mad!
 
There are a few items that are new, due to the person that he wanted as a witness for his trial being transported for trial, back to his incarceration.

But there is also one from the court of appeals. I'm not understanding this, but I will follow. It is now showing a case number for the court of appeals to follow. ( links for such or above, I got this off of the Duval County site and need to look at the court of appeals site to follow up later.)

There may be another website to follow this, but I have not found it. Other than the court of appeals site above which I don't see anything about it right now. And I don't see anything in the media either.

Hello - I shall be leaving on a Holiday to California!! And won't be around WS for at least 2 weeks (9/18 thru 10/2). So am going to post the hearing/trial that is coming up the following week while I am gone. Please keep 'good' notes while I'm gone! LOL! I will definitely be way behind on all my cases I'm following.... but will try & peek in mid-way thru my vacation.

Sorry for not reading back...do we know what the motive was for this horrible crime?


The defendant has given two or three different stories for the motive.

The latest one is self-defense and he wants the case completely kicked out, and not even go to trial. ( good old stand your ground Florida case, in which his car, additionally, could be considered his castle) Pffft

Right now, today is the last day for the prosecution to respond to the Appellate Court of the first district that the defense went to because they said that the judge could not Nix their request.

Nonwithstanding, they could have gone/can go with that defense without asking for it to be kicked oh, so they are just delaying it. MOO.

I just hate that I think perhaps it's going to affect the testimony of her mother that has had stage 4 cancer, and the prosecution may have to do something to have her testimony taking a head of the trial for posterity so that he cannot say he was not able to face an accuser and her testimony cannot come in. Not sure how that works, but it makes me so sad. Perhaps they are just pushing and pushing for the family to say they will agree to a lesser charge. Which might not actually be a bad idea considering as noted in my previous postings above and opinions. Moo.

I checked on the Appellate Court, and as of right now the prosecution has not responded but they have until end of day. The submissions shown in the below screenshot are not online, they have to be paid for.

@Niner, hope you are enjoying the West Coast! Attached is the latest update on the next pretrial which I would think would coincide with the next iteration of the appeals court back and forth that should take a few more months.( now that I look at the time frames, that's strange because I think the next one should be 4 more days past this to capture the next iteration on the deadlines of the Appellate Court

Motion to extend the time frame for a response was submitted at exactly 30 days to the Appellate Court by Steven Edward Woods, only to request an extension of time.

SMH, cautiously optimistic on the reason why.

It appears it was transferred to the AAG in Tallahassee. And darn it if they didn't ask for a delay even more so.Yep, this is very strategic by the defense as they knew it would be a big delay once turned over to that office on appeal?

Attached information. The email that was presented in court records (screenshot below) and perhaps reason for the cancellation of prelim/ delay, has to do with SE, who has been mentioned in post above as to relevance to this case.

I've seen no activity on the appeal case as that is not readily available on their website. I'm sure it's moving through the system as the time frames for both of them prosecution and defense) have been met for initial filings, although it often times takes up to 6 months and I think we're only two months into it? I would need to go back and check my records.
