If they knew it was sexual, then why would they think a crime had not been committed?

(imo) they knew a crime had been committed. they thought they could cover it up because they were too insulated from the real world. pappa joe had controlled whatever needed to be controlled in their little niche of the world for many many years. they figgured they (as his agents) could do the same. the greeks had a word for it: hubris. it might even lead a president to dirty trick his allies in the press, and trample the constitution in the process, because he assumed his buddies in the press cared more about their shared philosophy than they do about their freedoms. big mistake: hubris.

Spanier is trying again to get his travel restrictions loosened, both domestically and internationally:

A defense filing posted on the Dauphin County court's website Monday argued the travel restrictions aren't needed to ensure Spanier will show up for legal proceedings.

"The ability to travel within the United States and internationally for meetings, conferences and speaking engagements is a prerequisite in Dr. Spanier's profession," his lawyers argued. "In the absence of any reason to believe these terms are necessary to achieve the purposes of bail, the travel restrictions are excessive, unconstitutional and should be stricken."

I guess he's in demand for his top-secret job.

What do you mean by 'technical aspect'? TIA

Very good to see you post. :)

A private organization does not need "legal proof" to determine guilt in a disciplinary action. It is a lower standard of evidence. Because of that, the results of disciplinary investigation are suppose to be kept secret; the person who releases them can be subject to libel, because the claims may not reach the standard of legal proof.

Freeh, under orders, released it publicly. So, if there is something in there that Freeh got wrong, and its detrimental to Spanier, the would be grounds for a libel suit.

That's modified because Spanier is a public figure. That modification makes a big difference.

Then shouldn't Spanier sue the Board or whoever else ordered the report released?

Actually, it is the person doing the releasing that assumes responsibility.

I've seen reference to at least one case where a secretary of a private organization was ordered to publish disciplinary action regarding a member, by the group, and the secretary was sued.

Spanier - A man without a country?

The following is part of an article written by Mark Dent from todays Pittsburgh Post Gazette.

Former Penn State president Graham Spanier looks down the court during Penn State's men's basketball game in January against Nebraska at the Bryce Jordan Center.

Former Penn State president Graham Spanier was at the campus recreation building July 12 to play racquetball.

By Mark Dent / Pittsburgh Post-Gazette

UNIVERSITY PARK, Pa. -- He looks strangely familiar, this pale man at the Penn State recreation center wearing a powder blue Penn State T-shirt and thigh-hugging shorts, wielding a racquetball racket. He has silver hair, wide eyes and an odd yet worldly smirk. But surely that can't be him, can it?

As many people in State College have found out, that is him. That is Graham Spanier. Just your average ousted university president preparing to work up a sweat.

That's him on campus, that's him walking downtown, that's him at the Waffle Shop, that's him ... everywhere and always.

In his previous life as a respected university president, Mr. Spanier was known for being a goofy everyman, popping up in random places. He'd perform magic tricks for new students and play music at the popular student bar the Phyrst.

In his present life, facing a preliminary hearing later this month for his criminal charges related to the Jerry Sandusky child sexual abuse scandal, these random appearances haven't gotten any rarer. They just strike with the thick air of peculiarity and novelty, eliciting a "who invited him?" reaction.

Mr. Spanier still visits State College's best-known restaurants, such as the historical Corner Room and The Tavern, where employees say he has eaten lunch twice in the last six weeks (the Turkey Bacon Deluxe, if you must know). Mr. Spanier came to the Allen Street Grill for dinner about two months ago, also ordering a turkey sandwich. He arrived before his dining companion.

We are getting some tweets. MM on the stand. Test.: Paterno said, "don't trust Baldwin, don't trust Old Main."

"Old Main" refers to administration.

Tweet CDT:
Mike McQueary testifies #Paterno told him #PennState botched handling of #Sandusky sex abuse bit.ly/13rY55x

Harmon testifying. Schultz asked if the report was on file, and did NOT report the 2001 incident.

Looks really bad. Clearly shows a cover up. I wonder if there are more cover ups we do not know of especially before 1998. :puke: :stormingmad:

I've read some suggestions that Baldwin will not testify at the preliminary meeting. The said that there will be three more witnesses.
