"Tiffany Moss is not presenting a defense in the capital trial against her.
Shortly after 2 p.m., the state rested its case, following testimony from Dr. Michele Stauffenberg, the medical examiner who performed the autopsy on Emani Moss.

The jury was led out of the room following the state's conclusion, after which Gwinnett County Superior Court Chief Judge George Hutchinson asked Moss if she would testify in her defense.

When Moss said she would not testify, Hutchinson asked if she would present a defense.

Moss said no, to which Hutchinson advised her he would bring the jury back in so she could rest her case in their presence.

When the jury returned, Hutchinson asked Moss to present her first witness. She declined; Hutchinson told the jury "the defense rests."...

The jury will reconvene Monday morning for the remainder of the case, Hutchinson said."

Medical examiner's testimony will be one of the most important in the Tiffany Moss trial
The medical examiner's testimony could be the one to prove the death of Tiffany's Moss's stepdaughter, was murder

"..."The medical examiner’s testimony in a death case in the most important in a murder trial," explained Patterson.

"They’ll determine how long she had been dead before the body was burned, rigor mortis, all of those things to make sure the state can prove this was an actual murder."

The two other things to look for in this trial is Tiffany Moss’ former defense attorneys filing a motion to reappoint them as her attorney. She’s acting as her own attorney right now.

But Patterson said allowing her old attorneys to represent her in the middle of the trial could reverse any possible conviction, so a judge isn’t likely to let that happen.

Speaking of reversing a conviction, the judge allowed the court to recognize Tiffany Moss is taking notes, even though she’s not cross examining witnesses.

Patterson explained that’s important if she’s convicted and there’s an appeal.

"By her taking notes, the Supreme Court will be able to say that she actively participated in her trial. And if she didn’t actively participate in her trial, that could be grounds for a reversal of her conviction"..."

Tiffany Moss' standby attorneys surprise judge with request

"GWINNETT COUNTY, Ga. - The death penalty trial of a Gwinnett County woman charged with starving her stepdaughter to death entered its third day Friday....

As a medical examiner showed autopsy photos of 10-year-old Emani Moss' burned 32-pound body, jurors held back tears and a few wiped their eyes.

“She was more or less skin and bones,” Dr. Michele Stauffenberg said. "Her face looked very thin to me."

Moss never looked up from the defense table.

Channel 2's Tony Thomas, who was inside the courtroom for the trial, said Moss' standby attorneys appear to be getting very concerned and took another step to try and intervene Friday morning.

The attorneys asked to meet with the judge privately. It seemed to surprise him, Thomas said. District Attorney Danny Porter objected.

The judge met with them but didn't make any ruling on what was discussed....

Jurors will return Monday morning to hear at least one closing argument in the case. No one knows what Tiffany Moss will do.

The jury will then have its own private meeting to decide the woman's guilt or innocence."

"...Moss, 36, was convicted on all counts of murder, felony murder, cruelty to children and trying to conceal Emani’s death by burning her body. Moss showed no emotion as the verdict was read aloud....

The trial now moves to the sentencing phase of the death-penalty trial.

Prosecutors will first have to prove what’s known as an “aggravating circumstance” for the case to be eligible for capital punishment. In Moss’s case, the jury will be asked to find the crime was “outrageously or wantonly vile, horrible or inhuman” and that it involved “torture, depravity of mind or an aggravated battery to the victim.”If the jury makes such a finding, the prosecution can then present additional evidence in favor of a death sentence...."
