9/12/24 Docket update: Order on Defendants' Motion to Dismiss under the Supremacy Clause. For John Charles Eastman & Shawn Micah Tresher Still. On 6/5/24, The Court of Appeals sua sponte issued a stay of all proceedings pending the outcome of an interlocutory appeal granted for 9 co-defendants. In response to her direct request, the Court of Appeals also granted a stay for co-defendant Hampton on 6/26/24. These orders did not apply to Defendants Eastman & Still, & both defendants have informed the Court that they have not requested & do not currently desire a similar stay of proceedings. Defendant Eastman loses his bid to toss the top rackteering count of his indictment. The Judge also rejects his attempt to toss the case under the Supremacy Clause, but he rules 3 perjury/false filings counts are outside the State's reach. Judge McAfee on Thursday said that the two dropped charges fell under federal jurisdiction, rather than under Georgia state law. The dropped charges against Trump include conspiracy to commit false documents (Count 15) & conspiracy to commit forgery (Count 11), according to court documents. Judge McAfee allowed the rest of the case to move forward, including eight charges against Trump, out of the original 13. "President Trump and his legal team in Georgia have prevailed once again,” Sadow said in a statement. [“The trial court has decided that counts 15 and 27 in the indictment must be quashed/dismissed.”]
9/19/24 Update: Evidentiary hearing on 9/19/24. On Thursday, Fulton County Judge Rachel Krause heard from the first witness in a hearing over an open records dispute involving Fulton County DA Fani Willis. The judge did not rule on Merchant's request to compel Willis to testify. The DA did not appear in court Thursday. Thursday's hearing comes a day after Willis asked a judge for an “emergency” order blocking a subpoena requesting her testimony in an ongoing open records dispute. The subpoena, issued by Merchant, sought Willis’ sworn testimony at a hearing on Thursday in a running legal clash over Georgia’s open records law. Merchant alleges the DA's office has deliberately flouted the state open records law. The DA's office, disputing that, has called the case an effort to harass the DA. The first witness who did appear Thursday was Dexter Bond Jr., who is the Deputy of Operations at the Fulton County DA's Office. He had multiple back & forth exchanges with Merchant as she questioned him about email communications related to the media monitoring company. The hearing concluded & is expected to start back up on Friday 9/20/24 @ 10am. The appellate court scheduled those oral arguments for 12/5/24-nearly a month after the presidential election. A trial cannot move forward until the Court of Appeals reaches a decision in their ongoing appeal seeking the disqualification of Fulton County DA Fani Willis from the case. *Scott Graham Hall – (fake GOP elector tied to Coffee County breach) Plead guilty (9/29/23) & sentenced to 5 years of probation in exchange for testimony moving forward (including at trials of other co-defendants), a $5K fine & 200 hours of community service. Probation becomes non-reporting after 2.5 years, assuming he does not violate his probation during those initial 2.5 years. And will have to write letter of apology to Georgia citizens.
*Sidney Katherine Powell (68/now 69) took a plea deal & plead guilty to 6 counts of conspiracy to commit intentional interference with performance of election duties & sentenced to 6 years probation, required to testify at future trials, pay at $6K fine & #2,700 in restitution to the State & write an apology letter to the citizens of Georgia & admit her role in the January 2021 breach of election systems in Coffee County.
*Kenneth John Chesebro (61/now 62) – took a plea deal (10/20/23) & plead guilty to Count 15 Conspiracy to commit filing false documents. All other charges dismissed. Sentenced to 5 years probation, $5K restitution fine, 100 hours of community service & an apologize letter to the citizens of Georgia & testify against all other co-conspirators truthfully. Also no communication with media, witnesses & co-defendants, recorded proffer with prosecutors, provide documents & evidence. Resides in Puerto Rico & Judge will see if he can get probation transferred there. As part of his plea deal, Chesebro admitted that he conspired to put forward fake GOP electors in Georgia with Trump & former Trump lawyers Rudy Giuliani & John Eastman. Giuliani & Eastman have both pleaded not guilty in the Georgia case & now face the prospect of Chesebro taking the witness stand against them.”
*Jenna Lynn Ellis (38) – Took a plea deal to charge of aiding & abetting false statements & writings. Ellis plead guilty on 10/24/23. Sentenced to 5 years probation, $5K fine, apology letter to the citizens of Georgia, 100 hours of community service & testify truthfully against other co-defendants. Ellis who pleaded guilty last year in Georgia to a felony charge for trying to overturn the results of the 2020 presidential election in that state, is barred from practicing law for three years in Colorado. Ellis agreed to a stipulated disciplinary order with Colorado’s Office of Attorney Regulation Counsel that was approved Tuesday by a judge. To reinstate her law license at the end of the three-year suspension she will have to file a petition.
 

Fulton County District Attorney Fani Willis is trying to get some of the charges dropped against former President Donald Trump and others indicted in the Georgia election interference case reinstated.

In March, Fulton County Superior Court Judge Scott McAfee dropped six of the charges in the indictment against Trump and others saying the charges were too vague.

It asks the appeals court to reverse McAfee’s order and reinstate the charges-- which would add three more counts against Trump.

Willis has also asked to schedule oral arguments over her motion. We are waiting to see if the judge grants that request.
 

The DA's brief, filed on Tuesday, states Willis wants to reinstate charges against Trump, attorney John Eastman, attorney Ray Smith, former New York Mayor Rudy Giuliani, attorney Robert Cheeley and former White House Chief of Staff Mark Meadows.

"The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," the brief stated. "The indictment included an abundance of context and factual allegations about the solicitations at issue, including when the requests were made, to whom the requests were made, and the manner in which the requests were made."

It is remarkable that the US is on the eve of another election and they are still trying to get one of the candidates to answer for alleged crimes he committed during the last election!
 

A Fulton County judge ruled Monday afternoon an employee at the Fulton County District Attorney’s Office did not act in good faith.

While the judge has ruled in favor of the plaintiff she’s still considering the penalty for the District Attorney’s Office.

There was no testimony presented indicating District Attorney Fani Willis directed the employee to delay documents.
 

So, this case is about materials for Michael Roman's defence in GA being delivered in an untimely manner. And they want documents about GA's hiring practices. Another side distraction to the actual charges to be heard. :rolleyes:

They are very good at delaying, delaying, delaying. Alleged crimes of election interference in 2020 still not heard - and the next election is two weeks away.

No, Willis has not been dismissed. Apparently, that decision will be made by a state appellate court in December.

CNN online October 22, 2024 article by Katelyn Polantz entitled ‘Rudy Giuliani must give control of luxury items and Manhattan apartment to Georgia election workers he defamed, judge rules’:


There is also mention of a prior year’s New York Yankees World Series ring. Seems there might be some dispute on it IIUC. Giuliani’s son has apparently tried to indicate his father had gifted it to him. MOO
 
Tuesday marks the deadline for Rudy Giuliani to turn over his personal property to two Georgia election workers.

How will the items be transferred? The Associated Press reports that Giuliani can send the items to a place that Freeman and Moss choose. If he doesn’t agree, then the women may have to rent a truck and send it to his apartment or wherever the items may be.

Their lawyers are expected to receive the apartment ownership documents.

Giuliani has appealed the judgment and asked the New York judge to stop Freeman and Moss from selling any of his assets until after his appeal is completed. The judge denied his request.


Meanwhile, a judge in Florida is hearing the case regarding Giuliani’s condo in Palm Beach, Florida plus four Yankees World Series rings that Giuliani’s son claims were given to him as a gift

In the article it says for the Georgia case he has oral arguments hearing on 12/6 - from my notes in August I have 12/5... maybe a typo on their part??
