Who: Trump’s personal lawyer, former New York City mayor (a.k.a. “America’s Mayor”), and U.S. attorney for the Southern District of New York known for using anti-racketeering laws to take down mobsters. Giuliani allegedly led Trump’s scheme to steal the 2020 election; his role involved filing lawsuits to support his election fraud claims and pressuring election officials in key swing states.

Charges: Giuliani has been charged with 13 counts: one count of racketeering, one count of conspiracy to commit impersonating a public officer, two counts of conspiracy to commit forgery in the first degree, one count of conspiracy to commit filing false documents,two counts of conspiracy to commit false statements and writings, three counts of false statements and writings, three counts of solicitation of violation of oath by a public officer.

Reading about Cathy Latham on this fundraising website, she seems to have had a good reputation as a teacher, a church member and a Mom (according to the write-up by her daughter). I believe it. (Full disclosure: my husband is a retired teacher. :))

I really don’t think that any of these lower level people who have been indicted got into this thinking they were committing a crime initially. I think most are basically decent people who, in their MAGA fervor, were misled by the Sydney Powells, the Rudy Giulianis, the John Eastmans, the Jenna Ellises…attorneys all...who convinced them that the election was stolen from Donald Trump by means of the voting machines, and that the only recourse was a new batch of electors and gaining access to the corrupt voting machines.

They willingly gave their common sense, ethics and morals over to keeping Donald Trump in the White House. They were duped in a way, but they must have known deep down that what they were doing was wrong and illegal. Surely a longtime teacher of U.S. History and Economics like Cathy Latham was not dumb or naive about the electoral system with which she willfully attempted to interfere.

And the tragedy is that Cathy Latham’s misplaced loyalty to Trump is not reciprocated. She will receive no help or recognition from him. Her reputation and retirement is in shambles. She may serve time in prison. And for what? In service of Donald J. Trump and The Big Lie. What a waste.

Officials with the Fulton county court handed the indictment to judge Robert McBurney.
Proposed trial date on 3/4/24. Judge Scott McAfee presiding. Though McAfee was assigned the case soon after the indictment was handed up on Monday evening, it could be transferred to a different judge later in the process.
8/17/23 Update from CNN: Fulton County’s sweeping indictment against Trump & 18 additional co-defendants also includes details involving 30 “unindicted co-conspirators” – people who Fulton County District Attorney Fani Willis alleges took part in the criminal conspiracy to overturn the 2020 election. Some of the co-conspirators are key Trump advisers, like Boris Epshteyn, while several others are likely Georgia officials who were the state’s fake electors for Trump. One of the unindicted co-conspirators who appears multiple times in the indictment is Georgia’s Republican Lt. Gov. Burt Jones. Willis was barred by a state judge from investigating Jones after she hosted a fundraiser last year for Jones’ Democratic opponent when he was a state senator running for lieutenant governor. 8/14/23: Page 15 of GA indictment says there are 30 un-indicted co-conspirators. “I am giving the defendants the opportunity to voluntarily surrender no later than Friday 8/25/23 at noon” says Fulton County DA Fani Willis. 8/15/23 Update: Mark Meadows officially filed to move the election interference case from Fulton County to Federal court. The motion, filed in the U.S. District Court for the Northern District of Georgia, argues that the charges filed by Fulton County District Attorney Fani T. Willis (D) covers Meadows’s conduct while he was a federal official working as the top aide to then-President Trump. In the motion, Meadows’s attorneys cite a federal law known as the “removal statute,” which generally allows “any officer … of the United States” who is facing criminal prosecution in state court to move those proceedings to federal court if the case relates to actions that were part of the individual’s duties as a federal official. 8/21/23 Update: Two co-defendants in the Georgia election case have joined Meadows, the former Trump White House chief of staff, in attempting to move their charges to federal court. 8/16/23: A state agency is moving ahead with plans that will determine whether Lt. Gov. Burt Jones faces criminal charges as part of a scheme to overturn the 2020 presidential election in Georgia. Pete Skandalakis, executive director of the Prosecuting Attorneys Council of Georgia, said he has reviewed the Fulton County indictment & hopes to appoint a special prosecutor to consider Jones’ actions soon. Jones is one of 30 people who prosecutors said participated in a conspiracy to overturn the election but were not charged in a Fulton County indictment released late Monday. But Jones may yet face charges & his fate will rest with a special prosecutor who will determine whether further investigation is needed.
8/16/23 Update: Per DA's office & presiding Judge - It is expected that all 19 defendants named in the indictment will be booked at the Rice Street Jail. 8/16/23 Update: Former Trump White House chief of staff Mark Meadows is seeking to move the Fulton County, Georgia, prosecution against him to federal court so that he can try to get the case dismissed under federal law. On Wednesday, a federal judge scheduled an 8/28/23 hearing for Meadows & others to present evidence about whether to move the case. The judge noted the state court case can proceed at this time. In the filing, Judge Jones said the notice of removal & the attached indictment “do not clearly indicate that summary remand of this matter is required,” meaning there is no need for a higher court to send the case back to a lower court for further action. Judge Jones also ordered Meadows to give Fulton County DA Fani Willis a copy of the notice of removal & the order for the hearing. Once Willis receives the documents, she is allowed to submit a written response by Aug. 23.
8/16/23 Update: [Proposed] Pretrial Scheduling Order. Arraignment for various defendants shall take place the week of 9/5/23. Discovery: Defendant has until 10 days after arraignment to opt into reciprocal discovery. If defendant elects to participate in reciprocal discovery all parties shall serve discovery materials then in its possession to opposing counsel no later than 9/29/23. Motions hearings: All demurrers & claims of immunity are to be filed within 10 days of arraignment. All particularized motions & notices shall be filed on or before 10/31/23. on motions filed by 10/31/23 shall commence on 12/11/23 & continue until completion. Generalized & omnibus motions will not be considered by the Court. All motions in limine shall be filed at least 5 days prior to the call of trial. Final pretrial conference held on 2/20/24 & trial shall commence on 3/4/24.
8/17/23 Update: Fulton County DA Fani Willis has asked a judge to set a trial date of 3/4/24 for Trump & his 18 co-defendants. Willis’ proposed schedule also requests arraignments for Trump & his allies the week of 9/5/23. She hasn’t changed her Aug. 25 deadline for them to surrender at the Fulton County Jail.
8/17/23 Update: A former Justice Dept. official who served in the Trump administration & is one of 19 defendants in the Georgia 2020 election probe is seeking to pause an ethics case against him, citing the charges he's now facing in the Fulton County indictment. In a 13-page filing in D.C. federal court, lawyers for Jeffrey Clark on Thursday argued that an ethics violation case brought by a licensing authority for attorneys in the nation's capital should be put on hold until the resolution of the Georgia charges because "they involve substantially the same allegations." The D.C. Bar’s Office of Disciplinary Counsel, which regulates the conduct of attorneys admitted to the Bar in Washington, began a disciplinary proceeding against Clark in July 2022.
8/18/23 Update: Attorneys for Trump are expected to meet early next week with the Fulton County DA's office in order to negotiate terms of the bond package for Trump following this indictment last Monday. The meeting between Willis & Trump's attorneys is expected to occur prior to any surrender by Trump at the Fulton County Jail.
8/20/23 Update: The political team had pushed for Trump to be booked at the Fulton county jail on Wednesday, his legal team has been opposed. Trump’s lawyers thought Thursday was a more realistic option & intend to finalize logistics with the district attorney’s office on Monday, the people said. At the meeting with the Fulton county district attorney, Fani Willis, Trump’s lawyers are expected to negotiate the scope of his surrender, including whether the former president will have his mugshot and weight released.
8/21/23 Update: Consent Bond Order for Donald John Trump. Bond $200K. The order was signed off on by Superior Court Judge Scott McAfee. The order, which was signed by Fulton County District Attorney Fani Willis & Trump's attorneys, says that Trump "shall perform no act to intimidate any person known to him or her to be a codefendant or witness in this case or to otherwise obstruct the administration of justice." Also the "Defendant shall make no direct or indirect threat of any nature against the community or to any property in the community; The above shall include, but are not limited to, posts on social media or reposts of posts made by another individual on social media." Trump said Monday night that he would turn himself in Thursday, 8/24/23 in Fulton County Rice Street Jail. Only Trump so far has explicit and expanded witness intimidation restrictions.

Moran. In order to protect Meadows from arrest prior to Court's upcoming hearing on removal on Monday, 8/28/23. (Case No. 1:23-cv-03621-SCJ) DA Willis has made clear that she intends to arrest Meadows before this Court's Monday hearing & has rejected out of hand a reasonable request to defer one business day until after this Court's hearing. 8/23/23 Update: Rudy Giuliani is set to meet with the DA’s office Wednesday to discuss a bond agreements. Giuliani is expected to have a lawyer with a Georgia license to represent him during the bond negotiations. It is unclear if that attorney would represent him throughout the case. 8/23/23 Update: Rudy Giuliani's bond order is in: $150,000. It also includes a provision that others' did not: If he doesn't submit to booking by Friday at noon, the consent order is void. Sidney Powell has been booked at the Fulton County Sheriff's Office. $100,000 bond.
8/23/23 Update: Motions to delay arrests from Jeffrey Clark & Mark Meadows are denied. Federal judge says that Meadows has to turn himself in just like everyone else.

* Attempt at a delay tactic. Oh gee, I don't have my ID. Guess I can't get booked today.
* Attempt at some bureaucratic snafu that he can exploit later.
* Doesn't have enough in bank to cover any checks he would write or credit on his credit cards to cover expenses. The ol' "forgot my wallet, can you pick up the bill?" trick. (Does anyone even carry a checkbook anymore?)
* More nervous than he let on.

Well the people on the lower end of the ladder are going to have to plead or cooperate I'd think - there's just no way they can raise the necessary funds to defend a RICO case. I'd expect more fake electors to try to save their own skin by testifying against the COS and lawyers involved. Then it's anyone's guess if any of the attorneys or Meadows would flip against Trump - I think we can assume the one who absolutely won't is Giuliani.

If I were Willis though, I'd be pretty damned tempted not to cut a single deal. Her prima facie case is strong already and we haven't seen much yet. My view is they had a chance to hop off the train before the derailment and chose not to - now I want them all to go down. I'm a petty and vindictive soul apparently when it comes to attempting to overthrow an election.

I'd also argue that even IF Cathy Latham didn't know she was doing something wrong in extending her hospitality to the folks who breached the election equipment (snark definitely intended) she damn well knew it was wrong to lie under oath and that deception alone constitutes consciousness of guilt. Why lie about it at all if you believe, in your heart of hearts, you were doing a noble - LEGAL - thing?

None of the people used in the fake electors schemes were pulled off the street randomly. All of them had been involved in politics at various levels for years. I think it's going to be difficult for them to play dumb and pretend they didn't know what they were doing.

I don't think Willis should cut deals, either. These people have had ample opportunity to proffer already and they've chosen otherwise. Attempting to subvert an election outside of judicial process is a very serious crime. I have no doubt that if the tables were turned and the Democratic party attempted a similar coup, the GOP would be screaming for hard labor at Leavenworth before they face a firing squad.

Having a true-crime-watcher moment here when I read that Chesebro has filed for a speedy trial....and I'm reminded of the Lori and Chad Daybell case. (Never expected that experience might come in handy in this context!)

Lori and Chad were originally to be tried for murder and conspiracy together, but Lori wouldn't waive her right to a speedy trial and the combined trial was severed into two. It was a process requiring hearings, etc. to sever the trials, but in the end, Lori got a speedy trial and Chad awaits his day in court.

FWIW, Lori was speedily convicted.

Justice Alito also wrote in Zedner vs. United States that the purpose of the Speedy Trial Act is not only to protect the defendant's right but also to protect the public's interest to a speedy trial. That's likely going to get mentioned in filings when defendants try to game the system to trials years from now.

Last night on the X interview, the defendant "decried all of his four indictments, and said Willis 'is saying, you don’t have the right to challenge an election.'"

We have repeated and can repeat some more, Trump was NOT indicted for challenging an election. He was charged with attempting to overthrow an election.

His actual charges are in the indictment, which I hope people are reading before they believe he is charged with challenging an election.

I believe Cathy Latham will be angry at Fani Willis and the grand jury, not at the Trump criminal enterprise for which she sacrificed her good name and committed perjury. Victimhood runs deep from Trump on down. That’s part of the MAGA appeal...standing with Trump against the big, bad swamp that’s out to get you.
