yes, the Rosenbaums were treated differently. If you listen to the statement of the young mother from ThaCrysCat`s video (31 min), and the home invations. Too bad that Laila could not live with her.
I have seen the statement of mother Rosenbaum. She is afraid for her son. First she played down the injuries.
Then the prosecutor reacted very well. I like the prosecutors' team. I have not seen the other statements yet. But very interesting your thoughts about it. What, the defense rest in the middle of Thursday? A bit short.
 
Another forgot to mention...it was Jennifer Rosenbaum's birthday on the day Laila died. I thought I heard that in her police interview but I wasn't quite sure who she was talking about, but Joseph's mother confirmed it in her testimony today.
Very strange.
 
I typed up the 49 charges as read into the record during yesterday's hearing. I've no idea why felony murder is repeated at counts 2, 4 and 6. The evidence for the charges is described underneath each block of charges in non-bolded type.

Death of Laila Daniel Nov 17th 2015. Cause of death – blunt force injury to abdomen, pancreas, liver and small intestine. Only 2 people in home at time were Jennifer Rosenbaum and Millie Place. Injuries occurred within 1 hour of symptoms being visible to persons in home.

Cause of injury blunt force trauma (as above). Defendant was negligent in leaving the children in Jennifer R’s care, knowing that she had previously abused Laila. Evidence comes from Millie testifying that when Jennifer would spank her and Laila with a belt on their skin it occurred in the bedroom when the defendant was present in the room, he did nothing and she denied he was asleep. So he had knowledge this abuse was going on. Also in interview Millie said that when they had bruises Joseph would put cream on her bruises. Corroborated by CSI photo of cream in defendants’ bedroom. On date of incident Joseph was caring for the children until Jennifer came home, he had assisted Laila in the bathroom and would have seen those injuries that were on Laila’s body at that time. Also when Millie spoke to her therapist she said she heard Joseph say to Jennifer in argument “to kill Laila”. It can be inferred that they were arguing about the abuse that Jennifer was inflicting on the children and Joseph was warning her that she was going to kill Laila if she continued. He was a caregiver, he was responsible for these children, he was the foster father, he bathed and changed the children.

Heartbreaking. There are so many wonderful foster parents out there, too bad these sweet little girls ended in the hands of some of the few bad ones. Kids can be frustrating but what's so shocking here is that with foster kids if you can't handle them you can call up their worker and have them moved out of your home or get some respite care. No need to abuse out of poor coping skills and frustration, Jennifer just liked to hurt children.

Defense has spent a whole day with a stream of witnesses who saw the girls after they were fostered and reported they looked happy and loved and they never saw any cuts and bruises. Prosecution countered each with questions like 'would you expect an abuser to abuse the child in public?' - No, 'if you'd seen these injuries [photos exhibited] would you have reported it as suspected child abuse?' - Yes.

All witnesses seem very shocked and upset to see the photos.

Joseph's mother took the stand to praise Jennifer and Joseph to the hilt and said she will never believe they did this. She did seem a bit more uncertain by the end however when she saw the photos and was told about the lies that Jennifer told to doctors. She was crying throughout most of her testimony. She said she would NOT expect Joseph to tell her if he was involved in abusing the girls, but she would expect him to tell her if it was Jennifer doing it.

They called a nurse who examined Millie in 2017 [two years after Laila's death] with a suspected sprained ankle which turned out to be a fracture, when she was in the care of Peggy Banks. They were trying to make the point that Peggy wasn't arrested for child abuse because she didn't take Mille for an x-ray for 3 days, and the Rosenbaums are being treated differently by LE. Turns out on cross-examination by the state that Peggy was following the advice of the nurse to have Millie wear a splint and see if it improved, and the nurse said a fractured ankle is not suspicious for child abuse.

I think their biggest witness (going by defense opening speech) will be the expert who will testify about the one case where a child had a split pancreas as a result of the Heimlich Maneuver. It is the only reported case in the world. He survived after an operation. This was discussed by the pathologist during her testimony. I'm not sure what else there is going to be to say about it.

As a nurse practitioner in the emergency room, it's pretty standard to instruct patients to wait a few days to have xrays taken. A lot of times swelling will make it harder to identify fractures in the small bones of the foot and ankle Kids are especially difficult to see because of their grow plate.

Also the nurse practitioner.could not identify the fracture on the stand. That with the fact the orthopedist did not cast Millie makes me wonder if there wasn't a discrepancy in the treating providers' & the radiologist who read the films. That happens frequently as well.

I think the prosecutors were brilliant in showing the pictures and then asking if they would report it to CPS.

I am new here as well. This case breaks my heart for so many reasons. Thank you guys for sharing so much good information!

There are just too many injuries on both children. I worked for a number of years in a kindergarten, more than 30 children, and luckily we only had one broken arm.
You're absolutely right, it'll be interesting how the defense will use Heimlich Maneuver as the cause of the fatal injury.

He seems a bit unpredictable to me. Goes over the top sometimes if witnesses carry on talking after an objection has been raised. He could just say wait, but he likes to tick them off. Mind you, that first witness yesterday who wouldn't give a straight answer to the questions was a real fruitcake imo. He did not help the defense because he just came across as wanting to steer the outcome and not at all impartial.

So true! I think sometimes pain isn't always taken seriously in children. I do feel the only reason the children were not treated & their pain was ignored is so the FM would not be in trouble. I can understand why the GG & nurse practitioner would take the watch & see approach for Millies foot xray The fracture in Laila's is one of the most painful you can have. My heart breaks for both children. They were failed by so many adults.

I am too Showing the bruise pictures and asking if the defense's witnesses that are mandated reporters if they had concern for abuse, was absolutely brilliant.
