1/26/23 Update: Event (#316): Hearing on challenge to Grand Jury composition before Judge Peed. Attorneys' of record all present. In the pretrial motion hearing, several witnesses including the Effingham County Clerk of Court were called to testify by the defense representing Crocker Sr., Mark Anthony Wright & Kimberley Wright. The motion debated today was whether the grand jury who indicted the three defendants on October 24, 2019 was properly seated. Their defense attorneys said the grand jury was compromised & they’re asking the judge to dismiss the indictment that charged them with murder in the death of the Crocker children. The defense brought in an expert witness that studies jury selections. That witness said one person that made it onto the jury that indicted the defendants was put on list of candidates twice. “That person had a higher chance of being selected in that group of people who were summoned.” Former Clerk of Superior Court Elizabeth Hursey who served in 2019 said duplications are common for many reasons. The defense also questioned the people who were excused from the grand jury. No ruling has been made. Next Motions hearing re DNA evidence on 1/27/23.
1/27/23 Update: Event (#319): Ex-parte hearing before Judge Peed. Ms. Bell present for defendant & addressed concerns. Event (#320): Motion hearing re grand jury composition continued. All attorneys & defendant present. Crocker, Sr. was interrogated by police for 8 ½ hours. The defense said the first 4 hours weren't recorded, but they want the court to listen to the second 4 ½ hours of interviews. Instead of reviewing those in court, the lawyers agreed to allow Chief Judge F. Gates Peed a private review in an effort to save time. On Friday morning, the state was originally scheduled to examine a witness about this but canceled. In turn, Judge Peed told both lawyers he wants written briefs on the grand jury challenge by the end of February. State prosecutors filed a motion to present audio & video evidence when the trial comes. Court will meet again for two days in March (3/23 & 3/24/23) for what is expected to be the final pretrial motions hearing.
