*Motions Hearing (@ 9am ET) - GA – Mary Frances Crocker (14) & Elwyn John Crocker, Jr. (‘JR’) (14) (Mary died Oct. 18, 2018, Elwyn died about Nov. 30, 2016 & both discovered Dec. 20, 2018 buried in backyard, Guyton) – *Elwyn John Crocker, Sr. (50/now 54) (“father”) arrested (12/20/18), charged (1/29/19), indicted (3/12/19) & arraigned (4/17/19) & re-arraigned (2/19/20) with 2 counts of malice murder, 2 counts of felony murder for the deaths of Elwyn, Jr. & Mary, 1 count of sexual battery, 4 counts of cruelty to children, 2 counts of false imprisonment & 2 counts of concealing a death. Plead not guilty (2/19/20). No bond. DA will seek DP.

3/24/23 Update: Event (#339) Motions hearing on 3/24/23 (& from 3/23/23 hearing) before Judge Peed. Ms. Bell, Mr. Wood & defendant Crocker & Mr. Breedon & Ms. Baker are present from DA's office. Motion (#340) Defense's response to State's Motion #1. Defense's objection to the admission of text messages. Filed by Jerilyn Bell. Crocker’s defense team is asking a judge to block evidence from searches & seizures of their client’s property claiming those were a violation of his Miranda rights. They’re arguing that by the time members from the Effingham County Sheriff’s Office read Crocker his Miranda rights, he had already confessed to concealing Mary’s death. The defense says the warrant to search Crocker’s property came from information he gave before being read his Miranda rights. Three members of the sheriff’s office testified Thursday that they did not detain Crocker at first & that he freely went in for a recorded interview. They said while taking a smoke break during that interview, Crocker told them about Elwyn Jr. being buried 10 feet away from Mary. That’s when sheriff’s office members say they read Crocker his Miranda rights & took him into custody…testifying that no evidence was obtained without a search warrant. Prosecutors say all search warrants in the case fit with how previous cases in Georgia have worked. “The entire interview is admissible. There’s no Miranda violation under Abbott here. He was not required to be Mirandized until he was in custody. And he wasn’t in custody until after that smoke break,” said prosecutor Matthew Breedon. Day two began with Judge F. Gates Peed hearing arguments about what evidence should be allowed into the trial. State prosecutors want to use text messages and email conversations between other people charged in the case. They say those messages will help show a conspiracy to harm and conceal the deaths of Mary & Elwyn Jr. Crocker’s defense team pushing back saying the state’s request isn’t specific enough and that their client isn’t responsible for messages that other people send. “Any messages that are sent from Mark Wright or Candice Crocker should not be permitted unless the state can prove that Mr. Crocker saw or responded to said text messages,” said defense attorney Jerilyn Bell. State prosecutors also asked to include the internet searches of Crocker’s brother-in-law Mark Wright who is also charged in Mary’s death & concealing Elwyn Jr.’s. Judge Peed heard arguments about state prosecutors wanting to include other allegations against Crocker involving violence, sexual assault, and child molestation. They’re also petitioning to use audio & visual aids during opening statements in trial. Judge Peed also sought to resolve which side is responsible for getting information from an FBI DNA analysis. Crocker’s lawyers emphasized the importance of that evidence & any testimony related to it as all three defendants in this case face the death penalty.

Rest of the charges were Nolle Prosequi (dismissed). Sentenced to life without parole & credit for time served (12/20/18 to 10/21/20) to be served concurrently. In plea deal she must testify against the other 3 defendants.

Elwyn Crocker Senior was the only defendant that appeared before a judge Wednesday.
Crocker will be tried first but it’s not clear when Crocker’s case will go to trial.
The next motion hearing is set for the end of June.

5/10/23 Update: Elywn's hearings on 5/4 & 5/5/23 are cancelled. All remaining motions will be heard by 5/17/23 @ 9am & any other motions to be filed by 4/30/23.
5/17/23 Update: Pending motions hearing was held before Judge Peed. Present: ADA Matt Breedon, Jerilyn Bell & Samuel Wood for the defendant & defendant. Addressed DNA & Motion 119. Other motions to be held on a date TBD at the end of June. Exparte hearing also heard. Order: Request to install all recording & or photographic equipment for May 17, 2023 hearing filed by Billy Tyson of WTOC. Verbally approved by Judge Peed. (#472 to 474). There are about 120 motions filed & majority are from Crocker’s defense. In August there were around 60 pretrial motions filed. Attorneys have met more than half a dozen times to discuss motions like DNA evidence the defense says they need from the FBI are expecting the state to request. Prosecuting Attorney Matt Breedon accused Crocker’s defense of filing many motions at later dates to push the trial back. One of Crocker’s defense attorneys, Jerilyn Bell, says they are doing everything they need to do to make sure every claim made matches the circumstances of Crocker’s case before it goes to trial. Crocker will be tried first but it’s not clear when Crocker’s case will go to trial. The next motion hearing is set for the end of June.

Plead not guilty (2/19/20). No bond. DA will seek DP.

No bond. DA will seek DP.
Wright is brother of Elwyn Sr.'s wife, Candice & overheard a family discussion about Mary's death & called an aunt, who tipped off authorities. Judge F. Gates Peed has also imposed a gag order prohibiting attorneys and investigators from discussing the case outside court.

Two doctors were expected to testify during a pretrial motion hearing Thursday, as all three defendants were in court but defense attorneys argued against it so that didn’t happen.
