Braunschweig (dpa) - In the rape trial against the suspect also in the Maddie case, a former fellow prisoner is to be heard as a witness by Christian B. The Criminal Chamber will probably comply with a corresponding request from the public prosecutor's office, announced the presiding judge in the Braunschweig Regional Court. The prosecutors had requested the interrogation of the man the day before because the defendant in prison is said to have talked to him about several rapes in Portugal.

According to the court's previous planning, the man could be heard by the criminal chamber at the end of September and thus become one of the last witnesses in the proceedings, which is in the home straight. The previously known program for the trial against the 47-year-old German is coming to an end, the taking of evidence could be closed in the coming weeks. With regard to the possible witness, the question of his credibility should be in the center. The probative value of narratives behind bars is also likely to be questioned above all by the defense.

The sex offender, who has been convicted several times, is accused of three rapes and two cases of sexual abuse of children, which he is said to have committed in Portugal between 2000 and 2017. However, the trial is rather attentive because the accused is also suspected of murder in the case of three-year-old Madeleine "Maddie" McCann, who disappeared from a Portuguese holiday resort in 2007. The Maddie case is not the subject of the current proceedings. The presumption of innocence applies.

As one of the final points for the proceedings, a psychiatric expert began his report on Friday. The witness first generally gave general terms such as pedophilia, sadism and masochism. He has not yet established any connection with the accused. He is currently still in prison for the rape of a 72-year-old US-American woman in Portugal in 2005. The prison sentence for this he had served in the spring of 2025.“

From that report it seems uncertain whether or not the witness will be allowed to testify

From this -
With regard to the possible witness, the question of his credibility should be in the center. The probative value of narratives behind bars is also likely to be questioned above all by the defense.
- it suggests that he will only be allowed to testify if the credibility of his testimony passes the smell test, the primary one being, when and to whom did he make his official statements regarding these alleged conversations.

I'm not clear why he's only now being brought forward as a witness at such a late stage in the proceedings.

It's like he's just come out the woodwork, why wasn't he called before, did he make statements before the publicity concerning the trial? If so why wait til now, did he need coaxing, one must think the defence have no knowledge unless his evidence was previously shared under discovery.

Until we know when he reported these alleged conversations to anyone official, it's impossible to say.

We'll just have to wait and hope we get clarification on this.

It could maybe also be just a last shake of the dice for the prosecution?

If it's the Coup de Grace why wait til now, they wouldn't have needed to go down the bias judge route either. But like you say we'll have to wait.

Even if so, it is sometimes beneficial for us to be reminded every so often of exactly how bestial CB's crimes are as well as the lasting effects they have on the survivors.

He broke that woman's jaw at some stage of the degrading punishments he inflicted on her, which resulted in her being made fearful in her own home and unable to sleep without a light on in her room for the rest of her days.

"MM" case: CB.'s confession to an informer would be unlawful

However, if C B. was persuaded to make a confession with the help of an informer, this confession could not be admissible in court. According to the Code of Criminal Procedure (§ 136a), prisoners must voluntarily disclose their knowledge.
Statements by Christian B. in conversation with the prison inmate had been elicited by a ruse from the public prosecutor's office.

Absolutely certain that CB's legal team will be arguing the bit out about this issue. And why wouldn't they given that
  • they have nothing but CB's right to innocence until it is otherwise proven as in the DM case et al
  • they have done nothing but malign all witnesses for the prosecution in one way or another which seems to have resulted in a winning streak for them and their very dangerous client
If CB's fellow prisoner had been tasked with pumping him for information that would have been in relation to the MM case. I doubt that CB said anything relevant to that because he never was explicit about that at any time - not even to his partners in crime who have their own interpretation and opinion, but never his. And I am struggling with the "spy" story.

As far as his bragging and boasting about his sex crimes is concerned that appears to be out with the "spy" remit which seems to have been aimed solely at MM. Having been divulged voluntarily and with relish and corroborating shouldn't fall foul of the criminal code.
But no doubt all will be revealed in the fullness of time
My opinion

@Niner , Dr. Christian Riedemann a forensic psychiatrist , gave evidence today and is to continue on the next date 25th Sept, also the court have granted the wish of the prosecution to hear the ex con.

A brief summary, CB refused to see the doc, he could only go by case files, because of his heterosexual relationships he would not describe CB with a sexual sadism disorder nor a core paedophile.

Thanks for that info! :)

I wonder what a forensic psychiatrist will have to add to the mix ?
If CB has refused to speak to him directly it is bound to present some difficulty in enabling an assessment.
He can only generalise and will be unable to go into specifics of the case particularly as CB is protected by the right to the presumption of innocence.

There is just so much information which must be missing from the files. His lifestyle meant it was very difficult to keep tabs on him.

I don't think he had any convictions for burglary. Yet according to his friends he was a prolific home invader doing quite well on the proceeds of his crimes.

He also managed to keep a relatively clean sheet regarding his drug dealings for which which he travelled extensively. The Silt conviction is the only one I can think of.

No-one could ever catalogue what he was getting up to in the huge gaps between the crimes he was caught doing, probably not even CB himself.
No one was charged with the DM rape in 2005 and there is a fair chance he will walk away from the abuse indictment in Messines. Despite being caught in the act and immediately taken into custody from there.
Therefore the present five charges probably cannot be consulted for psychological assessment which really doesn't leave a lot to work with.

Whatever Dr. R. comes up with, it will never give the full picture of the man and his crimes because the information is incomplete.
