Is it the State that's the hold up?

I believe post autopsy, the Coroner releases remains to funeral home designated by next of kin. I recall BSR's dad made inquiry about release of baby remains right after the first interview -- but he's not the parent.

I'm wondering if it's the birth mother that hasn't sought the remains from the State?

ETA: Maybe birth father made claim and defense stopped the order pending completion of her trial.... (I recall paternal grandparents present at trial).
I really don't know. I thought maybe it was because the bones were evidence and couldn't be released until after the trial. I didn't think they were withheld for just being mean. imo
 
I do know the Defense wanted it noted on the record (jury not present) that the state didn't return the remains to the family and wanted to provide proof that arrangements were made by the family, for her burial with plots etc.
The state may have released the remains to Tre...IMOO
 
I think its unrealistic to assume Skyler is going to go off to college now, and have a blast (and so what if she does, let her smile maybe laugh, hell). Shes been made out to be a monster, I think the prosecution tried her in court if public opinion in their press conference by announcing she burned her baby, they never backpedaled or reassessed the situation once they did find out there was NO charred remains and NO proof of excelerant. They steamed straight ahead for her. If she does go to college, she deserves to go to college, it's her right & the best thing she can do for herself. She was found not guilty of murder or harming her baby, not guilty of neglect and the jury added a note stating they dont believe she harmed her baby either and I believe that says alot. (They werent required to add that opinion)
Her peers have spoken she did not murder or neglect Annabel.
I think she's been through enough, I think her family has suffered with her and I hope she remains on house arrest for her safety a bit longer and then probation for a time with court ordered psychiatric care at her expense. I hope she doesnt get a day in jail, hate me if ya like. She should change her name & move away and be the best person she can be moving forward and away from very poor choice and toxic family. But not before requesting her baby's remains be returned so she can bury her in the plot her family has for her.

Eh. She's in a situation of her own making. I think she should be able to live her life after whatever sentence she is given is completed, just like any other felon. She will be just fine. Just like she stated in her texts immediately after the birth. I didn't read anything about this case until the trial started so I certainly hadn't been tainted by the prosecutions rhetoric - which I agree was extreme. However, NONE of this would have happened if BSR would've just called 911 in the moments directly before or after her daughter's birth.

Assuming she can recover from the visibly precarious physical state her eating disorder has her in currently. Not saying this is impossible or even unlikely, I just think she's got a lot of work to do if she wants to take the opportunity at the second chance at life she's just been handed.

She does have a lot of work to do. And I do genuinely hope she is able to have a fulfilling life, but I'm very skeptical with the family dynamic they have of her becoming mentally healthy.
 
Respectfully disagree . The victim is the baby. The baby never had a chance at life because it’s mother chose not to let anyone know she was pregnant. No one knows if she was born alive, no matter what a jury decided. Because of BSR’s actions not to get an abortion and carry it to full term without planning for it to have a healthy birth in a medically controlled environment, we will never know if there might be a 2 year old little girl running around today. The fact that her paternal grandmother has been in court visibly distraught suggests that she would have liked to have had the chance to know her. I’m guessing Trey has long gotten over any embarrassment by now. Any one — family or not— has the right to make a victim impact statement to the judge before sentencing is handed down to impress on the court how it has affected them. She will be sentenced on the count of abusing a human corpse as found guilty on. I know it has affected MY sensibilities and I’m not related.

BBM. The justice system in Ohio must respect the jury verdict and this Court will do so.

But the law in Ohio is also quite clear that an unmarried father has NO custodial rights until after the child is born and he petitions the court. Has Trey done that? Of course his mother has every right to mourn the loss of her stillborn grandchild but I doubt the court will allow her to make a victim impact statement about a stillborn grandchild.

Under Ohio law, unmarried mothers automatically have custody of their children. Once paternity is established, unmarried fathers have equal standing to seek custody and parenting time, but they must initiate legal action to secure those rights.

Didn't BSR's dad testify in part as a "victim representative" or something like that for baby Annabelle? Would that have any bearing on whether the remains can be released at his request even though he isn't her parent?

I don't believe so as release of remains is a legal, custodial matter. If birth mom was deceased, grandfather could be next in line.

The victim representative is something I recall from CA trial. A deceased victim under age 18, is entitled to a representative. It wan't clear to me why BSR's dad (defined as the representative) was being referred to as the character witness for baby's mom. I don't imagine the ghost of Annabelle feels warm and cozy about her mommy dearest. JMO

Perhaps another member more clear on this role in criminal trial - anyone?

According to this link, a victim can be of any age in Ohio. I'm wondering if this court appointed the grandfather a victim representative so that he can receive the still held remains and have a proper burial. It's pretty outrageous that the remains are still being held.

This is sort of random, but does anyone know why the prosecution called her Brooke during the trial, when she apparently goes by her middle name, Skylar? Was there some tactical reason for this? It seems odd not to just call her what she is known by, but I'm sure they had their reasons.
