Tuesday, October 9th:
*Trial Continues (Day 2) (@ ET) - SC - Heather Rachel Elvis (20) (Dec. 19, 2013; never found) - Tammy Caison Moorer (41/now 45) charged & indicted (2/27/17) with kidnapping & indicted (April 27, 2018) with conspiracy to commit kidnapping.
9/17/18 Update: South Carolina’s Supreme Court rejected an effort by Horry County prosecutors to move the cases of Sidney and Tammy Moorer under one judge. The decision seemingly paves the way for Tammy Moorer’s trial related to the kidnapping of Heather Elvis to move forward next week on 10/8. Defense filed motion for change of venue, but were denied.
10/8/18 Update: Pretrial motions started about noon with Judge Benjamin Culbertson granting the defense’s motion to sequester witnesses. The State could call Sidney Moorer. Defense asked for a change of venue, but judge denied. After more than 6 hours a jury has been selected. 12 jurors have been seated and two alternates were named. Jury is made up of seven men and five women. Two alternates, one woman and one man. Opening statements will start tomorrow morning 10/9.
*Sidney StClair Moorer (38/now 42) charged & indicted (March, 2017) with kidnapping & indicted (April 27, 2018) with conspiracy to commit kidnapping. Will be tried separately.
2/21-22/14: Both arrested. 2/24/14: Both charged with murder. 3/17/14: Judge denies bond, but on 2/2/15 both get new bond hearing & post bond. 3/14/15: Tammy violates gag order (3 times) & charged. 3/10/16: Murder charges are dropped for both of them. August, 2016: Syd tried for kidnapping; mistrial declared when jurors could not deliver unanimous decision. 8/30/17: Sidney StClair Moorer accused of obstruction of justice charge for allegedly lying to investigators about phone call on night Heather went missing and found guilty 8/30/17 rec'd 10 years with year served. Eligible for parole Oct. 13, 2018, parole hearing would be 45-60 days after this date. 4/27/18: Both indicted on conspiracy to commit kidnapping. 7/25/18 Update: State files (7/13/18) Joinder Motion to try both defendants in one trial. March, 2017 GJ indicted Sidney for kidnapping & obstruction of justice and Tammy for kidnapping. On April 27, 2018 and additional indictment against both for conspiracy to commit kidnapping. Tammy's trial is set for Oct. 8, 2018, pending motion outcome. Motion denied, trial starts 10/8. Sidney will be tried separately.

I think JerseyGirl mentioned earlier on in the thread she might follow live coverage and leave the tweeting to others. (Not sure if that still stands though.) I'm setting my alarm for 2am (that'll be 9am trial time). I won't be watching live coverage though as I don't have earphones and I can't have the speakers up loud enough to hear as my family will be sleeping. I don't mind though, I will watch the video/s later on in the day when/if they're posted.

It took nearly seven hours for a jury to be selected Monday because this is a high profile case.

A handful of potential jurors knew someone on the potential witness list, and some knew family members of Heather Elvis. When the jury pool was asked if they knew anything about the case more than half stood up.

Judge Culbertson called in those who stood up one by one to ask additional questions to make sure they seat an unbiased jury.

Judge Culbertson ruled in favor of the prosecution to suppress an alibi for Tammy Moorer because the defense did not give the state enough notice of witnesses to Tammy's alibi.

The state also asked the judge to allow a statement from Sidney Moorer to police, but for that to happen there was discussion about Sidney Moorer being brought in from Lee Correctional Facility to see if he will testify or plea the 5th.

The prosecution called Carmen Rodriguez to the stand on Monday. Rodriguez was an employee with the Horry County Sheriff's Office and said Tammy Moorer came to the police department with concerns about being harassed. Rodriguez said Tammy Moorer willingly gave a statement at that time and ws not in custody. An audio recording of the statement was played in court. Judge Culbertson will allow the audio to be included in trial, but part of it must be redacted.

Sidney Moorer, prosecutors said, may be transported from a prison in Bishopville to appear before the court this week and there may be a possibility he will testify. Because his charges are still pending, the judge advised Sidney Moorer’s attorney to be present.
Following dismissal of the jury for the remainder of the day, Carmen Rodriguez, a former employee of the Horry County Sheriff's Office, was called to testify by the state. She said she was previously assigned to a task force formed to assist Horry County police, which included the S.C. Law Enforcement Division (SLED), in connection with the case. She also acted as a liaison between the Elvis family, the solicitor’s office and police department.

She said Tammy Moorer met with her at the police department in January 2014, before the couple had been charged. She said Tammy Moorer complained her family was being harassed and threatened. Rodriguez said during that time the Moorers were two of about five or six persons of interest in the case.

Rodriguez said the conversation with Tammy Moorer was taped. Tammy Moorer was not read her Miranda rights nor was she detained the day of the talk. The court listened to their brief conversation.

Rodriguez claimed she did not know their conversation had been videotaped until roughly three weeks ago when she was subpoenaed to appear in court.

Rodriguez said authorities’ investigation indicated Sidney Moorer was purportedly captured by video on a pay phone dialing Elvis early one morning. Rodriguez said she could tell it was Sidney Moorer in the video due to the way the hair of the individual in the video was styled and how the person walked.

Rodriguez said that Tammy Moorer had admitted to her that she was present when her husband spoke with Elvis on a cellphone and heard her voice.

McCollum asked what Tammy Moorer said that made one think “that she admitted something against her interest.”

Rodriguez replied, “It was probably the fact she was with him in the car when he made the 1:30 a.m. phone call. At the time that would’ve been significant to me.”

Nancy Livesay with the 15th Circuit Solicitor's Office said, because of this, it is believed the Moorers had the last known contact with Elvis.

Before court wrapped up for the day, the judge held a hearing to discuss one witness' testimony.

After listening to a tape and arguments about a hotel receipt that the witness said was in Sidney Moorer's name, but was found in Elvis' car, the judge ruled only parts of the testimony could be heard by the jury.

Opening statements will be heard when court resumes at 9:30 a.m. Tuesday.

Just some initial thoughts as the trial for TM begins.

I sure hope HE gets justice.
I know the prosecution has a tough case ahead of them. Im trying to prepare myself for any outcome so I dont end up with a huge disappointment. I do hope the jury can see and understand what many of us already know had to have happened that night.

There is not any other answer to what happened to her. We know about the phone call she got while on her other date to beg her to meet up and after she called her friend to try to decide what to do, we know she went back out that night. And she has never been seen again and her car was found at the Landing which happens to be very close to the defendant's house. And the video of a speeding truck leaving the scene.
Yeah, there is no other possibility as to what happened and we know who is responsible. Both.

There are a couple main obstacles the prosecution has to overcome. Trying a case without a body has been done before although it adds to the difficulty for the prosecution. I am glad they are proceeding though because in too many cases LE chooses to wait and the case never goes to trial at all. So I do think its time to try the case and present whatever evidence they can at this time. I just hope its enough.

Another good thing the prosecution is doing is charging for kidnapping. That should help make it a little easier to prove rather than a murder charge since HE has never been seen again after that day and since LE has not been able to recover her body. Kidnapping can have a severe penalty in years of prison time so it is the right move for the prosecution. Its also the right move for LE because she may not ever be recoverable. That Mickey Mouse fire pit has always concerned me as well as the ocean being so close. Its time to try the case and not wait any longer.

The other obstacle is I wish the judge would have allowed them to be tried together in one case. I think it would have been a little easier since IMO I believe both were involved that evening. And since that cannot happen now I wished that SM would have been tried first rather than the other way around because I think it would have been easier too. It concerns me that she is going first for the kidnapping charges. SM did have a previous trial but I think it was related to obstruction of justice charges and the kidnapping was off the table at that time. So if they are going to have separate trials I had wished SM would have gone first since it was him that made the phone call to her and more evidence could have been shown to help prove what happened to HE.

These are the reasons I am trying to prepare myself for any outcome. We know this trial is going to be a tough battle. I am hoping LE has all their ducks in a row and can present a strong case. All they have to do is help the jury see what so many of us already know had to have happened that night. There is no other explanation as to what happened.

The bottom line is she was contacted and lured away from her apartment to never be seen again. And the ones who lured her away had to be responsible because of the location where her car was found and the video of a speeding truck leaving the area as well as other evidence. With this particular defendant there is an obvious motive too. Mainly hatred of her because she could not stop her husband from cheating and seeing her.

Most ordinary people would just divorce a cheating person if they wont stop their cheating ways. In this case we dont have an ordinary defendant.

Praying that the prosecution can make the jury see and know what had to have happened here. And no matter the outcome, many prayers for HE and her family members to give them the strength to endure this trial and any more trials that may come in the future.

I’m recalling some old conversations about if she was dumped in the water how she could have been swept out to the ocean??

I would really like to revisit Heather’s case again from a recovery location/disposal site point of view; many of us have seen a lot of cases over the last 5 years and have learned a lot.

As I’ve said before I do believe SM’s work history could play a big part awareness space wise as far as where Heather could be, jobs he worked, work equipment/locations, concrete idk...

Maybe between a comparison of the timelines presented in both SM’s trial and Tammy’s trial, we can compare these evidentiary logistical FACTS and try to dig in again timeline/mileage wise in order to brainstorm some new possible search locations?

(They had some time though, and did some traveling...sigh.)

Searching the forum now if there is a search type thread. Or what the last current threads are that are available for posting.

Maybe we can gain some insight through this trial as to whaaat she/him/they possible did with Heather?
We talked about sooo many things from bridges over county lines to the forest to the ocean to aaaalll kinds of other stuff...What did they do with her?!

I realize this is a trial discussion thread so sorry for derailing somewhat, just some thoughts going in to trial.

ETA: Well DUH of course, it’s the MAIN thought going into trial—-Where is she?!!

I think she was thrown in a dumpster at LongBeard's. I think she is long gone.

Rodriguez said the day they talked, she showed Tammy Moorer a room key and receipt from an inn. She explained Monday the key had been found in Elvis’ car and she told detectives to go back to the business it was from to find out when the card was issued. They produced a receipt that had Sidney Moorer’s name on it, which possibly indicated the two had visited each other. Rodriguez estimated the stay was at least a few weeks before Elvis vanished.

What do we know about these attorneys, judge, etc? Tia.

Judge is all business, he's not a show boat and he's not into antics. I think I read that it's his decision about live streaming the trial and I wouldn't be surprised if he says no to that, will be very disappointed though. I want to see her squirm! If it's not live that's a win for her, I want her on camera all week while the truth comes out.
