Second motion to compel evidence filed in Heather Elvis case

A second motion to compel evidence through discovery has been filed for a Myrtle Beach man charged in the disappearance of 20-year-old Heather Elvis, according to court records.

Kirk Truslow filed the motion Oct. 20 with the 15th Circuit General Sessions Clerk of Court on behalf of Sidney Moorer. The motion asks Nancy Livesay, the assistant 15th Circuit solicitor prosecuting the case, to produce certain evidence.

Human remains in Florida not linked to Heather Elvis case

On Friday, Gary Davidson, a public information officer for the Volusia County Sheriff’s Office, confirmed that officials ruled the remains were not Heather Elvis.

“Yes, we’ve pretty well concluded it’s not her,” Davidson said. “Heather Elvis went missing approximately three months before the remains were found here. The experts who’ve examined the remains are confident that they’re older than three months.”

Heather Elvis search warrant appeal back in court Nov. 13.


"Attorneys for the Carolina Forest Chronicle and other Myrtle Beach area newspapers are scheduled to appear in court next week to argue for the release of search warrants in the Heather Elvis case.

A hearing has been scheduled for Thursday, Nov. 13 at the Horry County Government & Justice Center in Conway. Circuit Court Judge Steven John is expected to preside."

Eleven months have passed since Heather Elvis was reported missing in Myrtle Beach.

As the trial date for the two suspects charged with Heather's murder draws closer, WMBF News Anchor Michael Maely sat down with her parents.

Terry and Debbi Elvis shared their feelings on the trial and the painful wait for answers.

It has been 11 agonizing months, since Terry and Debbi Elvis have seen their daughter, Heather.

“It just gets worse; every day for me is harder,” Debbi said. “I never thought it could possibly be harder than it was, but it's harder.” “In so many different ways it's harder.”

“It's hard, every day's hard, every night's twice as hard,” Terry shared.
 
Former NASCAR driver aims to bring attention to Heather Elvis case

[Former NASCAR driver Jeremy] Mayfield said he wants to help find Socastee woman Heather Elvis, who has been missing since December of last year.

On Saturday night, Mayfield had a Heather Elvis ‘Missing’ decal on his car for the KOMA Relaxation Drink Modified Series ‘Gobble Till You Wobble 125’ at Myrtle Beach Speedway, and after finishing 13th in the race, detailed how passionate he is about the cause.

Judge refuses to order release of Elvis search warrants

Judge Steven H. John of the 15th Circuit Court has refused an appeal to force authorities to release search warrants issued early this year seeking unspecified information related to the Heather Elvis case, but the attempt by media to get them is not over, said Jay Bender, attorney for the S.C. Press Association.

Editorial | Heather Elvis secrecy similar to lack of transparency in Ferguson

The common denominator between Michael Brown and Heather Elvis is not race, gender or violence.

It’s government secrecy.

Racial angst and anger over Brown’s death surely drove the pillaging and plundering of Ferguson, but police secrecy fanned the flames.

Despite a grand jury review of mountains of evidence, details of which are now public, police hiding the facts as the case initially unfolded only made Ferguson folks angrier. Disclosing them later on didn’t quell the angst.

The lack of transparency in the Heather Elvis case has been chilling. Long before there was even a gag order, police were overly secretive and reticent to say anything meaningful. Police redacted the original police report in such a way that it suggested someone who’s never been charged was a person of interest. The media was needlessly whisked away from Peachtree Boat landing for an organized search of the Waccamaw River.
 
Newspaper taking Heather Elvis search warrant request to S.C. Supreme Court


Waccamaw Publishers, parent company of several Horry County community newspapers and myhorrynews.com, is taking its effort to secure the release of search warrants issued in the Heather Elvis case to the South Carolina Supreme Court.


In a petition and complaint filed Monday afternoon, Waccamaw Publishers asked the high court to order Horry County associate chief magistrate Aaron Butler to release the warrants, which Horry County police executed in the early morning hours of Feb. 21.
 
Discovery motion filed on behalf of Myrtle Beach man charged in Heather Elvis disappearance

After filing two motions to compel evidence through discovery, an attorney for a Myrtle Beach man charged in the disappearance of 20-year-old Heather Elvis filed a motion for prosecutors to continue to provide evidence as they discover it.

On Monday, Myrtle Beach attorney Kirk Truslow filed his first supplemental motion for discovery on behalf of 38-year-old Sidney Moorer, who is charged with murder and kidnapping in Elvis’ disappearance. Sidney Moorer’s wife, Tammy Moorer, 42, also faces the same charges.
 
Horry County search warrants itemize findings from Moorer, Caison homes

Horry County police investigating the Heather Elvis case seized 13 cell phones, six computers, and various financial records after executing search warrants at the homes of Sidney and Tammy Moorer and their parents, according to documents obtained by Waccamaw Publishers.

Horry County police also seized $10,600 in cash and two shotguns from the Moorers’ home at 8786 Highway 814 in February, but police returned the weapons a day later, documents show.
Police took two swabs from a shotgun, but the warrants don’t specify from which shotgun the swab was taken.

As a result of the search warrants, police took Sidney and Tammy Moorer into custody on Feb. 21.
 
"Heather's roommate, Brianna Warrelmann, joined the family at Thursday night's vigil. Brianna hasn't said anything over the last year.

However, Thursday night she revealed the details of her last conversation with Heather.

Warrelmann was out of town the night Heather disappeared. She said she was visiting family in Florida, but they were on the phone late at night. She said Heather was telling her about Sidney.

"She told me that he told her that he left his wife and he wanted to see her, and that he missed her and he wanted to be with her. And my immediate instinct was don't do it - don't do it. You've been doing so good. She hadn't talked to him, she hadn't talked about him," Warrelmann explained."

Family, residents mark year anniversary since Heather Elvis disappeared

The family of Heather Elvis lit candles held by dozens of community members Thursday to symbolically give back to the people who have given them so much during the year since their daughter disappeared.

During the more than two hour vigil held at Peachtree boat landing Thursday night, praise and worship music was played by a band, a sideshow of photos showing the 20-year-old as a child and young woman rotated on a screen and community members offered prayers.
