State, defense moving forward after bond granted to Sidney, Tammy Moorer (with video)

Myrtle Beach, SC (WMBF) - Experts weigh in on how both sides, the state and the defense, will move forward after Sidney and Tammy Moorer are granted bond.

"This case is emotional, there's no doubt about it," William Monckton said. Practicing law for more than 22 years, and a former solicitor, Monckton is familiar with both sides.

Monckton says it is unusual for bond to be granted so close to the trial date. "Whether the Moorer's are in jail or out on bond, isn't going to change any of the evidence that's already been discovered, the interviews that have been discovered, the evidence is almost static. It's not going to change unless something new occurs," Monckton explained.

State says Heather Elvis case will not be affected by suspects' release

The state says their case isn't phased by the Moorers' release, and now they are honing in on evidence they say will be enough to see a jury.

"There hasn't been a day where we haven't worked on this case and we will continue to do just that," Solicitor Jimmy Richardson said.

Though Friday's bond hearing was about whether or not the Moorers were a flight risk, or a threat to the community, Richardson says they knew there was a chance the Moorers would get out.

HORRY COUNTY, SC (WMBF) - A crowdsourcing account for the couple accused of the murder of Heather Elvis has been removed.

Couple charged with kidnapping in connection to Heather Elvis case

The YouCaringdotcom online fundraiser for the Caison-Moorer Family Assistance had raised $730 of its $5,000 goal. The beneficiaries of the account were Polly Caison and the Moorer family, according to the account.

Tuesday, the website removed the account, according to Leonard Lee, spokesman for YouCaringdotcom.

Horry County search warrants itemize findings from Moorer, Caison homes

Horry County police investigating the Heather Elvis case seized 13 cell phones, six computers, and various financial records after executing search warrants at the homes of Sidney and Tammy Moorer and their parents, according to documents obtained by Waccamaw Publishers.

Horry County police seized $10,600 in cash from a safe, a torso of a mannequin with white a white tank top and a Bi-Lo receipt dated Dec. 18, 2013.

Search warrant returns didn’t state a specific time on the receipt. Unspecified items were photographed as well.

CONWAY, SC - A judge is expected to consider a motion filed to lift a gag order in the Heather Elvis case on March 4.

Solicitor Jimmy Richardson confirmed Circuit Court Judge R. Markley Dennis will preside over the hearing, scheduled to begin at 9 a.m. at the Charleston County Courthouse.

A hearing to decide whether a gag order in the Heather Elvis case should be lifted is on hold.

Circuit Court Judge Markley Dennis was scheduled to preside over a hearing that had been scheduled for 9:15 a.m. Wednesday, but the hearing has been cancelled, according to a news release from the 15th Judicial Circuit.

The release said the gag order will remain in effect.

Tammy Moorer's defense attorney accused in court filing of violating gag order

Myrtle Beach attorney Henrietta Golding, who’s assisting prosecutors in the Heather Elvis case, has accused defense attorney Greg McCollum of violating a gag order prohibiting public comments, according to court documents.

In a memo filed Tuesday, Golding asks Circuit Court Judge Steven John to "take whatever steps it considers appropriate" to enforce it, document show.

Debbi and Terry Elvis, parents of Heather, issued the following statement:

"Although we would like to see the trial completed sooner, rather than later, our main concern is that it be a fair and just trial. Since all parties seem to be in agreement on the continuance, it must be what is best for the case. We will continue to rely on the judgment of the court officials in what is best for everyone involved. As always, our focus is on finding our daughter, Heather."
 
Solicitor's office estimates $44,000 in expenses prosecuting Heather Elvis case

Horry County solicitors have spent about $41,000 so far prosecuting the Heather Elvis case, according to public records obtained through an S.C. Freedom of Information Act (FOIA) request.

The solicitor’s office provided an itemized list of expenses ranging from $422.63 to $28,098.03 with the grand total coming in at $41,427.73, records show.

Jimmy Richardson, solicitor for the 15th Judicial Circuit, anticipated spending an estimated $3,000 for additional legal services provided by private attorney Henrietta Golding, who’s assisted the solicitor’s office in the Elvis case.

Richardson said he’s not yet received an invoice from Golding, but added that Golding with the McNair Law Firm in Myrtle Beach performed 10 hours of work and charges $300 an hour. That brings total expenses in the Elvis case to about $44,000.

Elvis was 20 years old when she was last heard from Dec. 18, 2013.

Denis said Horry County police have received many reports of online bullying or threats from the Elvis family, some of them stemming from supporters of the Moorers. He said several Elvis family members have had “back and forths” between members of the Moorer family.

“Several people from both sides of that ugly situation are in contact with people at Horry police and victim’s advocates constantly,” Denis said. “People have posted different kinds of misinformation and made bizarre and inappropriate posts on social media channels.”

Horry police have investigated every complaint of online bullying from the Elvis’, but so far none have been deemed prosecutable by the solicitor’s office,” Denis said.

Most of the complaints center around Terry Elvis, Heather’s father.

“To our knowledge, there have been numerous posts of very derogatory information concerning the Elvis’, mostly Terry Elvis,” Denis said.

There are at least half a dozen Facebook pages revolving around the Elvis case, ranging from supporters of the accused Moorer couple to groups solely focused on finding the missing woman. Several of those Facebook pages have more than two thousand followers.

Jimmy Richardson, 15th circuit solicitor, said he’s heard from Terry and Debbie Elvis many times regarding online threats against the family, but the prosecutor can only deal with cases where arrests have already been made. He said he sends all reports to the proper authorities, but has encouraged the Elvis family to civilly sue their harassers.

“There may very well be civil ramifications from slander or libel,” Richardson said. “But through a criminal process, you can’t lock somebody up just because you don’t like what they’re saying.”

Attorney seeks release of Tammy Moorer's property seized in Heather Elvis case

Tammy Moorer's attorney has filed a motion asking for the state to return property seized when Horry County police searched her home as part of the Heather Elvis investigation.

In documents filed April 7, Myrtle Beach attorney Greg McCollum is requesting the release of "any and all items seized from the Moorer residence that have not been reviewed and/or examined at the time of this motion."

Heather Elvis case prosecutors, defense attorneys due back in court next week

Prosecutors and defense attorneys assigned to the Heather Elvis case will be back in Horry County circuit court next week.

The trial of Sidney and Tammy Moorer, who’ve been charged with murder, kidnapping and other counts in connection with Elvis’ disappearance, was originally scheduled to start the week of May 11.

But with the case continued to an unspecified date, attorneys will instead spend the time arguing a series of pretrial motions. The first hearings will get underway Tuesday, May 12.

Relative of Heather Elvis looking to succeed retiring Horry County clerk of court

Renee Norris Elvis says she wants to bring a more pleasant working atmosphere to the Horry County Clerk of Court.

The Conway native and Socastee resident is the second to announce her candidacy for clerk of court. Elvis thinks niceness is a crucial attribute to the clerk of court, something she says she’ll bring to the office if elected.

“Most people go to the courthouse under a stressful situation,” Elvis said. “They don’t want to be there in the first place. It is our duty to bring some relaxation to them in that process when they have to be there.”

Melanie Huggins-Ward, the current clerk of court, plans to retire at the end of her term in 2016, Huggins-Ward said.

The clerk of court provides the services of the judicial system to the general public, and also serves as custodians of judicial records for family, civil and criminal court.
Elvis is the aunt of Heather Elvis, who was 20 years old when she was reported missing in December 2013.

Heather Elvis was last known to be at the Socastee Boat Landing at around 3:41 a.m. Dec. 18, 2013, and has not been found.

A prayer vigil is set for 6 to 8:30 p.m. Thursday at Peachtree Landing for Heather Elvis, according to a post on the Facebook page Find Heather Elvis.

Elvis, who was 20 at the time, was reported missing Dec. 19, 2013, after Horry County police found her car, which was registered to her father, parked at the Peachtree boat landing. Elvis&#8217; keys, cellphone and purse were not found in the locked car and she remains missing.
