SLED, FBI called in to assist Berkeley County in human skull investigation

The State Law Enforcement Division and the FBI have been called in to assist local law enforcement after a hunter found a human skull Friday in the woods behind Cainhoy Elementary School.

The Berkeley County Sheriff’s Office said Tuesday that investigators received information from another jurisdiction about a case that involves a location within the Huger area that may be related to their investigation. It also said that due to the terrain and other logistical issues, Sheriff Duane Lewis enlisted the assistance of state and federal agencies with the investigation.

FBI supervisory agent Don Wood said federal agents were assisting. SLED spokesman Thom Berry also confirmed that agents were in Berkeley County assisting.

Dateline NBC's social and digital series 'Missing in America' began in December 2013 with a question to our Facebook community, "Do you know anyone who has simply vanished?" The response was overwhelming. Since then, every Monday, we have featured the story of a different missing person brought to our attention from a member of our online communities.

Heather Elvis was last seen on December 18, 2013, when she was dropped off at her apartment near Myrtle Beach, South Carolina after a date. She was reported missing the next day. Days later, Heather's car was found at Peachtree boat landing on the outskirts of town. In February 2014, more than a year after Heather's case captivated the nation, Sidney and Tammy Moorer were charged with murder and kidnapping in the case. According to NBC affiliate WMBF in Conway, South Carolina, the husband and wife have been out on bond since February. A trial date has not yet been set. Heather's body has not been found. Anyone with information in this case is encouraged to call the Horry County Police Department at (843) 915-8477.
 
Elvis family starts petition to remove judge from daughter's murder trial

MYRTLE BEACH, SC (WMBF) – The family of missing woman Heather Elvis has created an online petition to remove Judge R. Markley Dennis, Jr. from their daughter’s murder case.

The petition outlines three reasons why the Elvis family is seeking to have Judge Denis recuse himself from the trial of Tammy and Sidney Moorer, the couple accused of kidnapping and murdering Heather Elvis in December 2013.

The petition states that the family has undergone hardship by having to travel three hours round trip to the Charleston court where Judge Dennis presides for hearings in the case, forcing them to close their business while they travel.

Family, community set to remember Heather Elvis two years after her disappearance; trial date still not set for Moorers

The loss has manifested itself differently for her and her family. She’s reacted with a sense of calm and difficulty feeling, for her mother it’s been an overwhelming sadness, and for her father, it’s been anger, she said.

Heather Elvis’ father, Terry Elvis, said to him the grief and struggle without answers is still so acute, it almost feels like it all happened yesterday.

“Everyday is pretty much the same. Nothing’s changed. We’re still in limbo looking for our daughter,” he said. “It hasn’t been easy. The constant disappointment of things not moving forward has been very hard to deal with.”

“Tammy is ready to move forward with the court date. You know, it’s been two years and they’re [the Moorers] ready. I can speak for her,” Greg McCollum, Tammy Moorer’s defense attorney, said. “She’s looking forward to having the matter heard, and going to court and getting a resolution.”

Many questions about Elvis’ disappearance remain, and a gag order prevents involved parties from saying what they know about the case -- which has fueled speculation and rumors.
 

New trial date coming soon for couple charged with murder of Heather Elvis

Tammy and Sydney Moorer, the couple charged with the kidnapping and murder of Heather Elvis, could soon be back in court, according to attorneys for the two and 15th Circuit Solicitor Jimmy Richardson.

Syndey Moorer's attorney Kirk Truslow says all parties on the case plan to meet after the holidays for the definitive date.

Moorer is scheduled to appear in Horry County Magistrate Judge G. Derek Blanton’s courtroom at 3 p.m. Monday in regards to a civil suit filed against him in July after Portfolio Recovery Associates LLC/ Synchrony Bank, a debt collector, said he repeatedly defaulted on payments on a Toys R Us credit account, totaling $6,603.32, court records show.

A court date in the Heather Elvis case has not yet been set. On Wednesday, Horry County Solicitor Jimmy Richardson and defense attorneys for Sidney Moorer, 39, and Tammy Moorer, 43, who is also charged in the kidnapping and killing of Elvis, will have a conference call with Dennis at which time hearing dates may be discussed, Richardson said.

MYRTLE BEACH, SC (WBTW) – The parents and sister of missing woman Heather Elvis held a press conference Friday afternoon to speak on the murder charges against Sidney and Tammy Moorer being dropped in Heather’s case.

While the Myrtle Beach and surrounding community learned the charges would be dismissed Thursday, the Elvis family says they were not surprised by the development in their daughter’s case.

“We actually found out earlier than the last 24 hours,” said Debbi Elvis on receiving the news that murder charges against the Moorers would be dropped. “The Solicitor’s office has been really kind in keeping us informed of what they were doing.”

Gag order still preventing release of Moorer case files

CONWAY, SC (WMBF) - The murder charges for Sidney and Tammy Moorer are dropped, but the gag order tied to their case is still in effect as of Friday.

At this point, all parties involved are waiting to see what the judge decides to do with it moving forward.

That gag order, signed March 2014 by Judge Stephen John, prevents any side from talking about the case or releasing any documents outside the courtroom.

The court order does allow for written releases from the parties involved in reference to the case.

However, any release must first be approved by a court order.

WMBF News tried to get any court documents related to the dropped and current charges, but because of the gag order, they could not be obtained just yet.

At this point, the Horry County Clerk of Court and the 15th Circuit Solicitor's Office are both waiting for the judge’s ruling before releasing any information in reference to the case.
 
Bri Warrelmann, Heather Elvis's best friend and roommate, issued a statement exclusively to Crime Watch Daily about the case on Saturday, March 12.

"I would like to make a formal statement. I have kept pretty silent these last two plus years. To this day people assume to know where I stand and what I think. Even go as far as question my character and morals. I am harassed and verbally attacked through various social media pages on a daily basis. Everything I post is questioned and picked apart. When I lived in Myrtle Beach I attended college for criminal justice so I am no stranger with how everything works. I truly believe in our justice system. (modsnip)
 
A Facebook account in the name of Sidney Moorer celebrated the dismissal of murder charges in a post dated March 10.

The post also made various accusations against Horry County police, the solicitor’s office and Circuit Judge Steven John, one of two judges presiding over the case.

In a news release the solicitor’s office sent to local media Tuesday, Richardson said, “in preparation of trial on kidnapping and obstruction of justice charges, the state on March 10, 2016 dismissed, with leave to re-indict the charges of murder and two counts of indecent exposure against defendant Sidney Moorer.”

Editorial | Gag order allows police, prosecutors to evade public scrutiny

Why have we stopped searching for Heather Elvis? It’s a valid question, but shockingly difficult for anybody to receive an answer.

Horry County police and prosecutors have been shutting the public out of the process since Sidney and Tammy Moorer were charged with murder more than two years ago.

Now that murder charges have been dismissed, Solicitor Jimmy Richardson should step up to the plate and immediately ask Circuit Court Judge Steven John to repeal the gag order the judge signed in March 2014.

Sidney and Tammy Moorer will go on trial starting June 20 on the remaining kidnapping and obstruction of justice charges, court documents state.

According to a scheduling order filed Tuesday, the Horry County clerk of court's office will mail out 800 juror summons and questionnaires on May 2. Responses are due by June 2, and the Horry County sheriff's office will be notified of any no responses on June 3

Attorney in Heather Elvis case wants key evidence thrown out

MYRTLE BEACH, SC (WBTW) – Numerous motions have been filed by the attorney for Sidney Moorer requesting an abundance of evidence be withheld from an upcoming trial related to the disappearance of Heather Elvis.

The documents, dated April 4, were submitted by attorney Kirk Truslow on behalf of Sidney Moorer to request certain evidence be prohibited on grounds the evidence is “irrelevant, more prejudicial than probative, and / or hearsay.” The evidence that Truslow would like to have thrown out includes:

  • Staged photographs of the Moorers posing with a firearm while on vacation
  • Statement of Sidney Moorer’s wife, Tammy Moorer, made in any form to or about Heather Elvis or the Elvis family (to include text messages, email, Facebook posts or any other form of communication)
  • Any and all communication between Sidney and Tammy Moorer, electronic or otherwise
  • All photos obtained from the Moorers explicit in nature
  • Any “other prejudicial and non-probative evidence”

Motion filed to include Tammy Moorer at Sidney Moorer pre-trial hearing Monday

The attorney of Heather Elvis kidnapping suspect Tammy Moorer has filed a motion requesting that she be included at the Monday pre-trial for her husband Sidney Moorer, who is charged with kidnapping and obstruction of justice in the case.

“She has wanted to move this case along to court for quite sometime now,” Greg McCollum, Tammy Moorer’s defense attorney, who said Tammy is ready to appear in court Monday.

MYRTLE BEACH, SC (WBTW)- Sidney Moorer is scheduled to appear for a pre-trial hearing Monday on charges related to Heather Elvis’ disappearance.

Last month, the solicitor dropped murder charges against Tammy and Sidney Moorer, but the couple still faces a kidnapping charge.

Criminal Defense Attorney Stuart Axelrod says he’s been following the case for years, and he simply doesn’t see how the case can move forward.

“They don’t have a body, they had the murder charge, they dismissed the murder charge, and now they’re going to try to go forward on a kidnapping charge,” said Axelrod.
