Hunter Biden indicted, federal gun charges, Sept 2023

In his potentially damning testimony, IRS agent Gary Shapley said that during a 2022 meeting, Delaware U.S. Attorney David Weiss—a holdover from the Trump administration who led the Hunter Biden probe— told FBI and IRS agents that he was not the "deciding official on whether charges are filed." Garland, who was appointed to his post after Weiss opened his investigation, has repeatedly said that Weiss had full authority over the case.
...
The attorney general also referred members of the press to the June 7 letter Weiss wrote to the House Judiciary Committee in which he said he made his decisions independently.

Weiss never made such a request, Garland said Friday, and always had full authority to file charges wherever and however he saw fit against President Joe Biden’s son. And Garland added that if Weiss — first appointed U.S. Attorney by Donald Trump — agrees to testify before Congress, the Justice Department will not stand in the way.
...
The transcript included a message Hunter sent to a business associate alluding to “sitting with his father,” seemingly suggesting that his father was aware of his business dealings. Shapley acknowledged the investigation didn’t turn up evidence to prove that, instead finding that it was likely untrue.

I wouldn't call that clear evidence, as if Hunter Biden couldn't be lying.

It seems clear that someone is being untruthful. hmmm

First son Hunter Biden was at father Joe’s Wilmington, Del., home the same day he used the future president as leverage in a text message sent to a Chinese business associate to close a deal, photos found on his abandoned laptop show — and other evidence suggests the elder Biden was around as well.

White House press secretary Karine Jean-Pierre and National Security Council spokesman John Kirby repeatedly refused to comment on the president’s whereabouts on July 30, 2017, during a raucous briefing Friday.

“It’s not an unreasonable question to ask whether the president of the United States was involved, as this message seems to suggest, in some sort of a coercive conversation for business dealings by his son … If he wasn’t, then maybe you should tell us,” said New York Times reporter Peter Baker.

Jean-Pierre claimed in response that White House counsel’s office spokesman Ian Sams had addressed the matter — though journalists were unable to immediately locate Sams’ response.

(…)
When Jean-Pierre repeated her answer, saying Sams “has dealt with this,” a reporter for The Post pressed further, “Yes or no, was the president involved in the shakedown attempt?”

“I just answered the question … It’s not up to you how I answer the question,” Jean-Pierre snapped.

Weijia Jiang of CBS News followed up, “Can you just remind us what your colleague said?”

“I would refer you to them and they will share their statement with all of you,” Jean-Pierre said.

The Post again pressed, “There’s evidence that the first son was at the president’s home and that the president was there two days prior.”

Jiang, whom the press secretary was calling on, took up the line of questioning, saying, “To follow up on my colleague … was the president there or not?”

“I would refer you to my colleagues at the White House counsel. They have addressed this and I would refer you to them,” Jean-Pierre said.

A journalist sitting in NBC’s front-row seat took a slightly different approach, asking Jean-Pierre if she had asked President Biden about “whether he was there with his son on July 30.”

“This is not a conversation that I’ve had with the president. Again, I would refer you to the White House counsel,” Jean-Pierre replied.

Sams, the much-cited spokesman for the counsel’s office, did not immediately respond to The Post’s request for him to share the comment following the briefing.

My cousin.
This was over 20 years ago, he was fighting with girlfriend and she called cops on him and told he had a weapon (gun). Because of previous charges he was not allowed to have a gun, he was arrested and charged, 5 year sentence.

When you say fighting do you mean an argument or a physical fight? If she called the cops then I think it must have been a physical fight and domestic violence is a crime. So not only was he in the act of committing a crime he had a slew of prior charges related to not being able to own a weapon. That means the circumstance surrounding your cousin are very different than the circumstances around HB. So not the same at all, IMO.

A message sent "hours before" a pic in a car with other people is still not clear evidence.

President Biden and Hunter are enjoying a weekend at Camp David.

WASHINGTON — President Biden spoke Saturday with the leaders of the largest NATO countries in Europe about the stunning mercenary mutiny by the Wagner Group in Russia — and then took no questions from reporters as he departed for a weekend trip to Camp David with his scandal-plagued son Hunter.

They were arguing/fighting she knew he was not allowed to be in possession of a firearm, she called police and reported him. Done 5 years.
She didn’t have to say anymore, he was not suppose to have a weapon.

I think tax evasion by an attorney should require some jail time. I hope the Judge rejects the plea deal.

I can't see why the plea deal would be rejected. The back taxes have been paid. Hunter was off his face during that period. He hasn't evaded or obstructed the tax dept, which keeps the charges at misdemeanor level. He just didn't pay his taxes at the time they were due ... likely due to the effects of his addiction.

There are many people who are on a payment plan with the tax dept. Gradually paying their back taxes. They don't get charged for this misdemeanor of owing back taxes. Their businesses don't get closed down. One of my clients is on a constant (and constantly revised) tax payment plan. His back taxes are never paid in full - year in and year out.

The gun Hunter had (illegally) was in his possession for 11 days. Link
Again, he was off his face during that period.

My biggest hope for Hunter is that he can stay off crack. He has had at least 15 tries at rehab.

imo

I object to the preferential treatment he seems to be getting because he's the son of the President. According to the IRS whistleblowers, they wanted to charge him with felonies but the U.S. Attorneys appointed by Biden refused. These agencies need to be allowed to do their jobs and keep politics out of it.

The IRS whistleblowers said the recommendation called for Hunter Biden to be charged with tax evasion and filing a false tax return – both felonies – for 2014, 2018 and 2019. The IRS also recommended that prosecutors charge him with failing to pay taxes on time, a misdemeanor, for 2015, 2016, 2017, 2018 and 2019, according to the transcripts, which were released Thursday by House Republicans.

It appears that this 11-count charging recommendation also had the backing of some Justice Department prosecutors, but not from more senior attorneys, according to documents that the whistleblowers provided to House investigators.

Any felony charges won't hold. Because he didn't evade or obstruct. Prosecutors would know that they have to prove evasion or obstruction.

A misdemeanor failure to pay can be escalated to a felony in some cases. According to the Department of Justice manual, those involve individuals who fail to file tax returns or pay a tax “but who also commit acts of evasion or obstruction.” In that case, the charges would be brought as felonies under sections 7201 or 7212(a). That’s not the case here—likely because Biden paid the tax due and was cooperating with authorities.

What I object to is the preferential treatment. I have a real aversion to corrupt politicians and their families. lol

Yes, I know. :)

I just don't know that it is preferential treatment. If they arrived in court on felony charges, I think it is likely a judge would say "so, he has paid his back taxes and he is cooperating with you, why are we here on felony charges?"

As I explained earlier, there are lots of people who owe back taxes. They don't get charged or go to court. When the tax dept catches up with them, they opt for a payment plan.

It might be anti-preferential treatment that Hunter is up on misdemeanor charges. Because, to me, those charges are more severe than the general population would receive, from my working experience.

Oh, we got audited once. Took a year to get it resolved. I had inadvertently made a typo in our daughter's SS number. One digit wrong. I'm betting if my Daddy was President, it wouldn't have taken a year to prove our daughter really was a dependent. lol

Biden’s approval rating takes another hit. Due to Hunter Biden’s issues?

“We have to make sure, as a special agent for IRS Criminal Investigation, that we treat every single person exactly the same,” Shapley told CBS News on Tuesday.

“And that just simply didn’t happen here.”

It wasn't that Hunter wasn't filing taxes because he was stoned. He was, but neglecting to report this income from Ukraine, That is a conscious decision. And while he was heavily using drugs, he was also, at least according to him, negotiating these high end deals to earn these millions. And sense when does being stoned get you out of trouble for gun crimes? It doesn't anyone else, because voluntary intoxication is specifically not a defense. This administration has made a big deal about gun crime and keeping guns out of the wrong hands. But apparently you get a pass if you were stoned when you illegally obtained the weapon. I'm sure that argument wont work in 99.99% of criminal cases pending.

That is not what I said. In fact, I said very little about the gun other than he only had it for 11 days (and provided the link).
I realise that there are a lot of people who use drugs who have guns in the US, and probably a lot of people who lie on their gun applications.

I also explained (via my own work experience) that people who pay their taxes late are not usually charged unless they refuse to pay and don't cooperate with a payment plan and other necessary actions.

What we have heard is that Hunter has paid his taxes and is cooperating.

My references to Hunter using drugs - in particular crack - was to show his potential for disorganisation during that period (not as any kind of legal excuse).

"IRS Supervisory Special Agent Gary Shapley told the committee under oath that, as an investigator for the IRS, he obtained messages Hunter Biden sent on the WhatsApp platform, including one in 2017 that he read demanding payment from a Chinese businessman named Henry Zhao.

In the message, Shapley said, Biden appeared to suggest that he was sitting with his father, then the former vice president, saying, “I will make certain that between the man sitting next to me and every person he knows and my ability to forever hold a grudge that you will regret not following my direction.”

Lowell writes that the screenshots of these messages as tweeted by Smith, “both include a photo of Mr. Biden not from 2017 but from the White House Easter Egg roll in April 2022 (long after the purported message was sent); both images portray the message in a blue bubble, when WhatsApp messages are in green;

So, what else is faked?
