8/23/23 Wednesday, Bench Trial Day 10: State witnesses: Davenport Police Detective Geoffrey Peiffer continues testimony. Deputy Adam Wojciechowski. Kelly Kruse, a pathologist who is an associate state medical examiner. Joseph Adams, who lives outside of DeWitt. He said he knew Jerod Brink, who died about two months ago. Michael Tate, a criminalist with the Iowa Division of Criminal Investigation. Tate works in the firearm & tool-mark section of DCI. Retired Davenport Police officer Bill Thomas will read the deposition from Jerod Brink, who recently died. Sean Johnson, a detective with the Davenport Police Dept.

After listening to the testimony about the lighting conditions where Breasia remains were found I was thinking about how dark it must have been at the time of the morning when Dinkins was at the pond. According to historical data there was about a half moon that night.

The gentleman that pulled Dinkins out of the ditch said it was still dark at that time. That time of year it doesn't start getting light until around 5:00 AM. Twilight start time for Dewitt, IA on July 10, 2020 was at 5:03 AM

With it being dark, I think it would have been hard for Dinkins to have seen Breasia to get a good shot, unless he was very close to her and she was not moving or walking. Where the remains were found between the road and the pond, it doesn't seem like a likely place to just stop and stand there. If Dinkins fired the gun and missed while Breasia was standing still, she would have likely turned around and started to run away from him, not stood facing him while he shot again. From seeing Dinkins in the body cam footage on the very same day Breasia went missing, I don't think Dinkins could have out ran ten year old Breasia.

I think it's possible Dinkins did something like choked Breasia to incapacitate her and then shot her while she was lying on her back on the ground. I don't want to even think about what else I think Dinkins did to Breasia while she was likely out cold, before he killed her.

A geologist from the FBI's trace evidence unit testified Thursday that dirt under the car Henry Earl Dinkins drove during the early morning hours when Breasia Terrell disappeared can be linked to dirt from the road near where her body was found.

Before Thursday, Scott County Attorney Kelly Cunningham had not showed any physical evidence linking Dinkins to the place where Breasia's remains were found.

In an effort to establish that link, Cunningham called geologist and FBI analyst Ian Sanginor to the stand. He analyzed the soil found under the Impala and soil samples taken from a small area on 270th Avenue.

Sanginor told the court that three samples of the 10 samples taken from 270th Avenue were "inclusive" of three of the soil samples taken from the rear portion under the Impala, meaning that element in both soil samples matched.

Before Sanginor's testimony, Davenport police detective Sean Johnson returned to the witness stand Thursday morning and took the court through his interview with a key witness who died earlier this year.

The trial of Henry Dinkins, on trial for the 2020 kidnapping and murder of 10 year old Breasia Terrell, is in its 12th day (Friday). Dinkins and his family maintain that he is innocent. Dinkins asked for a bench trial, which means the judge makes all the decisions as compared to a jury trial, in which the jurors make the decisions.

Branden Stepanski, a criminalist with the Iowa DCI lab, was the first to take the stand..

Next, the state called Michael Schmit to the stand. He is a criminalist with the Iowa DCI lab. He told the court, “DNA is the building block of life.” He was assigned to build a DNA profile of a bone found at the scene where Breasia’s remains were found. He was able to build a profile from a cutting of the left femur bone.

The state will continue to call witnesses Monday.

I'm listening to one of DL's interviews. I know he gave helpful info. But the interviewer didn't give him breaks, didn't stop pushing when it was obvious he was upset and needed a break. I just wonder if he would have been able to give more helpful information had a littleore patience been given. Some parts sounded like an interrogation itself.

The bench trial for Henry Dinkins resumes on Monday. Davenport Police Detective Maureen Hammes is called to the stand. She has worked for the Davenport Police for 25 years, a detective for 15.

On July 10, 2020, she was dispatched to the apartment complex from where Breasia Terrell went missing.
When Hammes spoke to DL at the complex she said DL was a "normal kid" who wanted to show the detective the dog he was holding. She said DL did not seem to understand the severity of what happened.

On July 10 when searching the apartment, Hammes said she found bleach underneath the kitchen cabinet. She said the moment was captured on her body cam, which the prosecution played for the court.

O'Donnell plays a recording of the interview for the court.

On July 23, Hammes re-interviewed DL.
During the July 23 interview, DL offered more information. At that time, police had surveillance footage and some cell data, including footage of Dinkins buying bleach at the Walmart in Clinton.

The defense tells the judge said there is no credible evidence that Dinkins caused Breasia's death including no witnesses that he shot Breasia or was in possession of a weapon and no DNA was found.

The state asks the judge to deny the defense's request for a direct verdict.

The judge denies the motion for an acquittal.

When asked if the defense would present any evidence, Frese said Dinkins would not testify.

The defense rests its case and closing arguments will be presented tomorrow.

What kind of father tells his eight year old son he is going fishing and leaves him sitting in the car?

Yesterday was the first I heard of DL hitting his head while in the car because Dinkins needed to go fast to get through something. I think Dinkins may have drove the car down the entrance road to the pond where Breasia's remains were found and DL hit his head when Dinkins needed to drive fast to get back out.
 
The judge denied the defense motion for acquittal.

Dinkins won't testify in his defense and the defense rests without even producing one witness or a single piece of evidence.

If the judge could have skipped the closing arguments, I think he would have announced his guilty verdict right then and there and saved everyone from another day in court.

For me the big question now is, how long will it take the judge to come to a decision. I would imagine it will be a few days, so not to give the impression the judge didn't deliberate all the facts and evidence in the case and give Dinkins a reason to appeal.

The fate of a man accused in the death of a 10-year-old girl is now in the hands of a judge.

The trial of Henry Dinkins, on trial for the 2020 kidnapping and murder of 10-year-old Breasia Terrell, was in its 14th day and final day on Tuesday, with Judge Henry Latham presiding.

Closing arguments were given all morning until shortly before 12:30 p.m. Scott County Attorney Kelly Cunningham discussed the family dynamics, the relationship between Breasia’s mother and Dinkins and then the events of the night before the day she was reported missing on June 10, 2020.

Chad Frese, Dinkins’ attorney referred to the “fairy tale (the state has) spun.” He told Judge Henry Latham, “I’m going to submit to you that this case is being thrown in your lap because the prosecution doesn’t trust you. “

Assistant Prosecutor Liz O’Donnell said Dinkins returned quietly to the apartment after he and Breasia left in the middle of the night.

Latham said he will take the matter under advisement and return with a verdict as soon as he can. The judge has up to 60 days to make a ruling.
 
Since the Judge has 60 days.... :rolleyes:
