If someone was Mirandized in English, said he understood, and later said he was not proficient enough in English to understand and agree, would it matter?
I'm sure a defense lawyer could try that tactic.

Maybe LE used Spanish when they Mirandized him and it wouldn't matter.

If they didn't and a defense lawyer tried to say he didn't understand what was said, the State could call witness's to show his ability to speak and understand English.

We'll have to wait and see if this takes place. JMO

A two pack every year!? Haaaa, does she spray her significant other every time they argue or something? “Talk back to me again, and I’m gonna blast you in the face with bear spray again!”
 
I’m not sure how correct your statement is across the board, but I can say with some certainty that even smart people make terrible criminals. My favorite is when the defense attorney says “my client is a successful businessman, do you think he’d be stupid enough to do so and so?” Fortunately stupidity is not a defense.
Surprisingly that's quite a common defense. My client isn't stupid enough to have done something that was going to lead right back to him!
 
Something I've been watching for but haven't seen... has it been said if they've tried to locate a person with the name, birth date and social security number he used? If they really did come back verified by the SSA, could that mean that someone else had died to give him an identity to use? I know there are other ways of faking those things, but do they normally check things like that out? TIA

People whose identity is stolen aren't all dead. The person could be dead or alive.
 
The attack that Mollie suffered was not about sex. It was about rape, and rape is about power and control. Rape is not about sex, it is about power. I want everyone who is posting about motive, an accident (black-out), or why he did this, to please keep this in mind. Having a girlfriend has nothing to do with men who brazenly and violently blitz attack women.

I'm sure someone is going to ask how I know that Mollie was raped. I don't. I do, however, know that she was identified by the clothing with, or near, or something with her body. If the report was: "based on what she was wearing", that's one thing. Someone posted the quote a ways back.

Opportunistic predators that snatch women off the street during daylight are extraordinarily brazen. As with Hannah Graham, Mollie was probably hit really hard in the head at the time of abduction. I think it's possible that she was assaulted first at the top right dot in the police map, and possibly again at the bottom right dot on the map. I think he then googled for a body-dump location and took her to the corn field.

Also, he wants everyone to believe that he did this because Mollie threatened to call police (I don't believe this). He wants everyone to believe that he is the victim and it is her fault that he "blacked out". She caused him to black out, and it isn't his fault that he realized he had a dead body in the trunk.

I don't think this is the first time he has done this. It is too organized. I think this is the first time he did it this close to home.
 
It may not make a difference as the case has generated so much attention. If this were an case that was only reported on locally, I’d expect a change. I’m skeptical that it will be granted here because of the same reasons you are.

I don’t know if a change of venue will make much difference. Mollie’s case has been covered on various websites repeatedly that I visit here in the U.K for news not just the Daily Mail. It has even been covered in Australia. I want him to get a fair trial though so they can lock his cell for life and he can be forgotten ASAP.

I have not posted here much since the news broke. I am angry and depressed that the world has been robbed of another kind young lady, Mollie, who had a bright future ahead of her by a monster who has caused so much suffering.
 
I hope the University of Iowa memorializes Ms Tibbetts.

People might not be aware but the U of Iowa has had it's share of trauma. In about 1985 a farmer in crisis killed his family then went on a rampage in a bank at Hills (about 5 miles from Iowa City). The slain Bank President was the sheriff's brother.

Then in about 1993 a physics graduate student shot about 5-6 physics professors (including one of mine) on campus then headed down to Administration to kill the University President. He maimed a secretary however did not shoot the President. He also did not attack the famous James Van Allen, who was head of physics at the time.
 
My husband was so angry when I read to him what happened. He said, "ALL women should carry pepper spray on their arm and practice blasting it quick."
I've got bear spray. One time I had it in a back pack and my daughter wanted the water bottle out of it I told my daughter to be careful don't hit it by accident! She did. It burned her hand terrible!!
If you haven’t seen “Tiger Lady” you should google it. Easily my favorite female self defense accessory.

Yeah I absolutely agree with you. I don’t care one way or another, as long as it’s not an issue brought up on appeal. This guy is toast.
