I don't know what it means. I do think other charges could have caused them to waive it, and some of those might have to do with his illegal status/identity.

I was thinking you meant they may not be able to proceed if they haven't any proof of who he really is, or something. But I am interested in hearing a lawyers opinions on this, especially what the reasoning could be behind their actions. A poster mentioned they may postpone if they think the details of the crime are so terrible that they don't want them revealed, I am curious about that.

I've been thinking about CR's story and what I've heard about MT's personality, and it finally hit me what I felt seemed wrong. I really don't think MT saw him as a threat until it was too late. It seems to me that she was more annoyed with him than she was afraid, which is understandable considering the environment around her. If she was actually afraid, I think she would have immediately called 911 instead of threatening to (if that part of his story is true). I also feel like she would probably have held her ground more and looked for something to use for defense rather than try to outrun a man in a car. In my mind, I think that what outraged him wasn't her threatening to call 911 so much as it was her just turning her back on him and totally dismissing him. I get the feeling that she wasn't really even trying to run away from him, but she just continued her run as if he weren't even there. That can be pretty hard on an already vulnerable ego, or one who expects obedience from females. MOO

I don't think she had any reason to fear him at all before that day. I don't even necessarily think his ego was that damaged. When she saw the look in his eyes when he got out of the car, or when she saw him running up behind her is probably the moment she felt fear. I'll bet the fit bit data tells the story.

If he does plead guilty, which I hope very much he does...he has to admit to everything he did...which is why so few do. They often want to be able to at least keep their families on their side and believing in their innocence and victimhood.

I have seen too many cases where one parent who killed their spouse refuse to ever admit it and the kids end up never speaking again, due to some believing their parent, others not. I can think of a few now, but their names escape me at the moment. I think it may be harder for this guy to admit he did it to his parents than to a judge. Jmo

Why would he have to reveal everything he did? Does he have to reveal the details of the crime? Couldn't he just plead guilty without anyone ever knowing the why, how, and when?

I think it’s more the situation if the evidence of the crime is extremely incriminating toward the accused, what’s the point of attempting to have the charges dismissed? Additional legal and court fees would be incurred to accomplish nothing.

In cases of a Grand Jury indictment or if the evidence is perceived by the defense to be very weak, Preliminary Hearings serve a real purpose because if charges are dismissed, it eliminates the need for a more costly and lengthy trial.

Does even one person here think it’d have been worthwhile for CR to argue that LE did not have probable cause to file murder charges against him? Nope, never noticed.

Given CR implicated himself and led LE to her body, there’s just no way his murder charge would get dismissed at a preliminary hearing.

Ok, so maybe it was waived because they know darn well the judge would find probable cause? Therefore it wasn't necessary? ( along with unwanted publicity) That I understand. Unless of course, someone says otherwise. Maybe its just as simple as that?

I pictured the same thing (torso), and the head wound was something different and non-fatal from the initial attack. I originally thought he killed her at the cornfield, but if you go by the affidavit, it kind of sounds like he put her body there, as if she was already dead. In either case, I agree with you, maybe at least one sharp injury was to her head.

or maybe he bloodied up her nose and beat her upside the head and put her in his trunk. later, he went to his trunk and planned to leave her for dead, but she came to and he knew she would recognize him, so he butchered her.

This case is following along so closely to another case we followed. I said threads ago there would be no preliminary and am going on the record today to say he pleads guilty! Well, if he does, I hope we don't have to wait a whole year.

I don't think that ICE or CR's immigration status will matter as far as his continued custody as a guest of the State of Iowa, or his trial by the State. The 10th Ammendment to the Constitution gives Iowa primacy in this matter. The Feds can exercise their right to CR when he's dead, by shipping him home, thereby saving Iowa the expense of digging a hole.

I agree that there may well be more charges coming. Time will tell.

Waiting brings fullness!

The shipping charges might cost more than the hole, but I agree that it sounds like he's found permanent residence.

It seems to be moving very slowly to me as well today / this afternoon and evening, in terms of the usual number of posts on Mollie's threads "per hour" being fewer than in prior days. Maybe with CR in custody and the preliminary hearing that was originally scheduled for today cancelled by his new lawyers, there will be a lull until the trial or he pleads.

There were some crazy reports in MSM today about robocalls to Iowa residences related to Mollie's case that is probably off topic here, so maybe that's all being discussed elsewhere, and it's quiet here because this thread is not for discussing that type of stuff.
