Tylee): Conspiracy to commit 1st degree murder & grand theft by deception (for
Daybell, Vallow & Alex Cox) & other co-conspirators. Count 2 (for
Tylee): 1st degree murder. Count 3 (for
JJ): Conspiracy to commit 1st degree murder & grand theft by deception. Count 4(for
JJ): 1st degree murder. Count 5 (for
Tammy, 49, died 10/19/19): Conspiracy to commit 1st degree murder. Count 6 (for
Tammy): 1st degree murder. Count 8 & 9: Insurance Fraud (Two counts of insurance fraud related to 2 different life insurance policies he had on
Tammy). Plead not guilty. No bond. DA will seek DP.
Trial set to begin on 1/9/23 with jury selection. Trial will be held in Ada County.

3/17/22 Update: Status conference hearing on 3/17/22 regarding State’s motion concerning the jury & defense has filed an objection. 3/17/22 Update: No info on what took place. Next Motions hearing re to sever on 3/18/22, motions hear on motion to dismiss on 3/23/22 & motion hearing re motion for additional evidence re jury on 4/20/22.
3/18/22 Update: Daybell’s attorney argued Friday that his client’s murder trial should be held separate from Lori Vallow Daybell’s but prosecutors said having one trial will save money and is more efficient. John Prior’s motion to sever was held via Zoom before District Judge Steven Boyce. Daybell appeared next to Prior from the Fremont County Jail wearing a white dress shirt and dark tie. Daybell said nothing during the hearing. "We have a trial that is set for January & it’s fast approaching. There’s a significant amount of preparation that needs to be done & there is going to be a significant difference as to how I prepare in the event the case is joined or separate,” Prior said. Fremont Prosecuting Attorney Lindsey Blake asked Judge Boyce to wait on issuing a decision on separating the case until more information is available on Lori Daybell’s case. “It would be most appropriate in the interest of judicial economy & to preserve all rights of the parties that Ms. Vallow Daybell also be allowed to be heard regarding a motion to sever since this also affects her trial rights,” Blake said. “We believe that until a decision on the stay in her case is made, it would be premature to factor that into the decision to sever the cases.” The trial for both Daybells is scheduled to begin in January in Ada County & is expected to last ten weeks. Blake pointed out that if the cases are separated, there would be a “significant impact with regard to costs for the counties involved as well as time for all the witnesses.” “It would be 20 weeks to replicate the same evidence, require us to call all the same witnesses & use all the same staff & resources to do those trials,” she said. Prior argued that his defense strategy will be different based on whether the cases remain joined or not. He asked Boyce to issue a decision soon. Judge Boyce said he will consider the arguments & issue his decision in writing. Prior has also filed a motion to have the indictment & death penalty against Chad Daybell dismissed. A hearing on those issues is scheduled for 3/23/22.

*Lori Norene Vallow aka Lori Norene Daybell (46/now 48) – Fremont County: 5/27/21: Found incompetent to stand trial. All hearings put on hold. Competency review hearing was on 6/16/21, but Prosecutor Wood withdraws motion for contest competency. Status hearing on 7/1/21 was vacated. Scheduling hearing on 3/21/22.
*Madison County: Pretrial conference hearing on 8/17/21 & trial set to begin on 8/30/21 were both vacated.
