Sorry folks but I do agree that the State filing their Motion at the tail end of a business day, just a mere few days before this Change of Venue hearing - which has been scheduled for a long time now - doesn’t seem entirely fair to the Defense.

Doubly so if the they are required to give either side 7 days to adequately review their filings. The State seems to continue to be really slow with some things (grand jury transcript, these late filings, etc)

Wood is also now saying they don’t even want to have this Change of Venue hearing next week, not without Ms Vallow,
Wood says Prior has no right to make accusation that they waited too long, were “sitting on this legal brief” but then said they’d Motion to shorten timing for their filing…..effectively the one way out they seem to have get under the 7 day “rule” (which the State doesn’t think is even a rule”

Judge Boyce also said he will need “data” to support argument by the State to sequester a jury, seeming to allude that their filing doesn’t currently have that. He brings up the point of saving financial resources that go hand in hand with a Change of Venue hearing, and the associated costs of sequestering a jury vs. bringing a jury in from elsewhere in the State vs. costs for Sheriffs to transport defendants, etc
 
I think John Prior is doing a good job defending his client. It just happens that his client is a murderer of children so I want justice for them.

Both sides have agreed to a change of venue in Chads case but the argument is whether the actors are moved to a new county or if jurors from another county come to where the actors are and are sequestered. Defense asks for the whole trial to move. Prosecution today asked for jurors to come to them and be sequestered. They have a hearing next week and the judge will decide. The judge is concerned about the costs of sequestration.

I am totally against sequestration of jurors. It is very hard for them and they get bored and miss their families. That was proven in the Casey Anthony trial. At the end of the day, the jurors said they just wanted to end the trial and go home.
They got so bored, in fact, that they found her not guilty. After a while, you get fed up with the grandstanding by the defense and/or prosecutors.

I agree but that happens quite often in trials by both the prosecution and the defense. :confused:
 
Can anyone verify if Chad Daybell has a new hearing Oct 6, 2021 that Prior filed (again) to get the trial moved? I heard it on True Crime podcast tonight with Scott Reisch. I don’t know if it’s approved link, sorry mods…. That would be the Sept. 29, 2021 podcast. I thought everything was at a stand still but according to what I heard, a new filing was just released late.

Autopsy report sheds light on death of Lori Daybell’s fourth husband. She faces charges

The autopsy report for Charles Vallow, Lori Vallow Daybell’s fourth husband — who was shot and killed in 2019 by her brother — is now available to the public.

The eight-page report goes into greater detail about the findings of a Maricopa County, Arizona, medical examiner. Daybell is charged with conspiracy to commit murder in connection to Vallow’s death at the hands of her brother, Alex Cox, on July 11, 2019.

The report lists Vallow’s death as a homicide caused by being shot by another person. The report details that he was shot twice, once in the abdomen and once in the chest.

Cox told police on the day of Vallow’s death that he shot his brother-in-law in self-defense. Arizona police documents say those claims are not supported by evidence and indicate that Vallow planned an intervention that day to confront Lori over an affair with her current husband, Chad Daybell.

The report shows the gunshot to the chest was from front to back and in a slightly downward trajectory. Police say this shot was fired while Vallow lay on the ground, likely after being shot in the stomach while standing.

The shot to the chest damaged Vallow’s heart and the shot to the stomach damaged his left lung, according to the autopsy report.

Vallow tested negative for drugs and alcohol in his system.
 
Good question. I can only confirm what I see which is either MM or JA coming or going. I do know that there are other entrances to the Women’s Detention Center other than the one that MM or JA use. The other ones are often used by personnel or to transport inmates.

Covid cases have increased in Idaho to the point that the crisis standard of care has been enacted. I’m unsure of how that will or would impact someone such as LVD who needs immediate care for mental health. And I’m unsure of LVD whereabouts and technicalities of her treatments. I know telehealth has become a big thing for a lot of people but idk if that would be a route for LVD. I also know there are healthcare options available at the women’s detention center but idk if that would be sufficient enough if LVD was receiving specialized care. But there’s also a lot of logic to physically transporting a high needs case like LVD. I guess what I’m saying is there’s a lot of room for speculation on what and how LVD is treated but I just don’t have those specific answers. We can only hope we hear more through documents or hearings that take place.

Little late for Arizona to get on the bandwagon with a full autopsy on Charles Vallow and release the results.

Hindsight is 20/20, but seriously, they dropped the ball. I hope that this case, and video of LVD can be used as training for other officers, to be alert for clues to murder.
