FOX 13 INVESTIGATES - Tonight at 5:30, we take a look at this letter sent by the Church of Jesus Christ of Latter-day Saints. It states leaders should not involve themselves in any court case without speaking to the Church first.

This letter was sent the same day a judge ruled that Chad Daybell's case would move forward to trial. Some say the policy is unethical. Some say it's sound legal advice. Others say it borders on obstruction of justice, potentially impacting cases across the country.

My follow up: "Sure, but if someone is subpoenaed because they believe they might have information related to a case, are they still going to be discouraged not to get involved?" Penrod: "Uhm, I can’t speak to that... They just don’t want the Church involved."

FOX 13 Investigates: LDS Church urges leaders to not participate in ‘any type of court case’

FOX 13 has spoken to attorneys, members of the Church, and former members of the Church who have concerns about the way that statement could be interpreted as promoting “obstruction of justice.”

Doug Andersen, a spokesperson for the Church, released the following statement to FOX 13.

“A letter from the First Presidency, dated August 4, 2020, was sent to local lay leaders worldwide, reminding them of the Church’s long-standing policy of seeking advice from Church legal counsel before becoming involved in criminal or civil proceedings related to members of their congregation,” the statement reads. “This policy is intended to help leaders in their ministerial role to all those they serve, by not appearing to take sides in legal proceedings and to avoid implicating the Church in legal proceedings to which it is not a party. This policy is included in the General Handbook and similar notices have been sent in recent years to reinforce this policy.”

Rocky Anderson, an attorney and former mayor of Salt Lake City, said he believes the policy indicates “cultish control of members.”

Means is criticizing the Church of trying to "create a code of silence." He says the letter sent out on August 4, along with the findings of our FOX 13 investigation, are "alarming and concerning."

A new statement from the LDS Church does not directly respond to the accusations in Means' letter other than to reiterate: "The letter of August 4 serves as a routine reiteration of a long-standing policy and has nothing to do with any pending case."

Means says the church’s policy is “disturbing, and at worst, criminal” and goes against its own doctrine that a Latter-day Saint should “strictly obey every law of God, including the constitutional laws of the land in which he lives, and do it with a good and honest heart.”

Three people in Fremont County have told me a woman approached them yesterday asking if they would do a survey. The woman said she was hired by an anonymous firm in Boise and asked if they had heard of the Daybell case, if they thought Chad and Lori were guilty and if anything might change their minds during a trial. It's no secret the defense attorneys have mentioned possibly changing venues and this could be part of their strategy. Mark Means declined to comment about the surveys - but he and John Prior have 60 days from the time their clients are arraigned to request a change of venue. Chad is scheduled to be arraigned Friday, Lori is scheduled for Aug. 27.
 
Phoenix PD releases details on how third ex-husband of Lori Vallow was found dead

PHOENIX - FOX 10 obtained the Phoenix Police incident report on the death of Joseph Ryan, the third ex-husband of Lori Vallow. On April 3, 2018, police found the 59-year-old dead in his apartment around 6 p.m.

The report reveals Ryan’s neighbor, identified as Roy Zliniga, came out of his apartment with his dog. Zliniga noticed his dog scratching at Ryan’s door before he smelled a strong odor and saw flies inside the apartment. Investigators discovered Ryan’s body on his bed, in the “advanced stages of decomposition.”

A report from 13th August giving more information from the neighbor about Tammy's paintball incident on 9th October 2019:-


“We had spotlights going through everything,” Rhea said.

Following the incident, Boyd Price and his son, Matt Price, searched for the gunman in neighborhood sheds.

“Somehow (the gunman) knew Tammy would be there. He came around the corner of the house,” Rhea said.

Rhea recalled how frosty it was that night and anybody would have to be crazy to want to prank someone when it was freezing outside.

Chad Daybell's attorney asks for case to be dropped | East Idaho News

Chad Daybell’s defense attorney has filed a motion asking a judge to dismiss his client’s entire case.

John Prior filed the motion to dismiss with District Judge Steven Boyce Thursday stating there was not sufficient evidence presented at the preliminary hearing on Aug. 3 and 4.

BREAKING: Special Prosecutor Rob Wood & State of Idaho motion to join Chad Daybell and Lori Vallow’s cases together.
Official motions for joinder below.
“Charges against defendant & the co-defendant allege they participated in same act or series of acts & conspired to commit the alleged act or series of acts.”
Both sets of remains of Vallow’s kids Tylee & JJ were found on Daybell’s property (6/9/20).
So far, Daybell has pleaded not guilty to all four charges against him and asked for them to be dismissed.

Investigators say Lori Vallow and Chad Daybell spent the morning of January 26 on the beach. Hours later, body camera footage shows Vallow served with a search warrant before being detained. She doesn’t say much to officers but smirks and spends minutes intently looking at the paperwork.

RAW BWC FOOTAGE: Here’s the entire video released by Kauai PD after our records request. Investigators say Lori Vallow and Chad Daybell flew to Kauai from LAX via American Airlines on 12/1/19. They checked into Kauai Beach Resort multiple times. JJ Vallow and Tylee Ryan had not been seen since September.
