*Motions (to suppress) Hearing (@ 1:30pm) - IL – Julie Ann Hanson (15) (missing July 7, 1972 riding her bike to bro’s bb game, reported missing July 8, 1972, found later that day in cornfield near 87th Str. & Modaff Rd, about 2 miles from her home, Naperville; was stabbed 36 times & sexually assaulted.) - *Barry Lee Whelpley (27 @ time of crime/76/now 78) arrested (6/2/21), extradited from MN to IL (6/9/21) & re-charged, indicted & arraigned (6/24/21) with 2 counts of murder/intent to kill/injure, 1 count of murder/strong prob. kill/injure & 1 count of murder/other forcible felony. Plead not guilty. $10M bond.

4/19/23 Update: People present by Christopher R. Koch. Defendant is not present; defendant currently in custody of Adult Detention Facility. Attorney Terry Ekl appears on behalf of defendant. Matter comes on for status. Counsel waives defendant's appearance this date. On Defense motion, matter is continued for pretrial & status on out of state subpoena. Speedy trial demand tolled. Sheriff to transport. Matter comes on for pretrial, status on out of state subpoena & defense's motion to suppress defendant's interrogation at police station. State to file response to motion by 7/10/23. On Defense motion, matter is continued for hearing on motion. Speedy trial demand tolled. Defendant remanded. Next motions hearing on 8/10/23 @ 1:30pm. Case info on why the delay: Whelpley’s defense team has spent the last two years attempting to suppress statements Whelpley made to law enforcement officers – and his wife – during an hours-long recorded interrogation at his Minnesota home, before his formal arrest. His defense team claimed he was not read his Miranda rights prior to the at-home interrogation. Last year, Will County Judge David Carlson agreed, ruling that any statement Whelpley made at his home was not admissible. The question now is whether statements he made at the police station – after leaving his home – are admissible. His defense team claims they’re not. A hearing is scheduled for 8/8/23 related to his defense team’s motion. Whelpley is currently being held on a $10 million bond.
