Very interesting. Now I really need to go back to the original Probable Cause.

I wonder if the Mrs. is supporting her husband. Kinda seems like it based on the doc at the link. Could be lawyer jargon I guess...
looks as though she is, while at the same time, presumably, sharing his jail letter which was incriminating, although it's possible jail house people got to see that themselves..
 
I'm no pro, but I think if they have a warrant, consent is unnecessary. However, I recall a reference to consent being given by "the female resident" in the probable cause statement during initial questioning, taking BC to the station, etc. I'm wondering if the media source is inadvertently merging two separate visits to the BC residence.

I'm in a tough spot right now... I do know more than I think i can say here, which is frustrating to say the least. Tippy toes...

The defense is saying the warrant was for search of the car only, and they are saying the consent form was signed at the end of the interview with his wife. 5-6 agents were searching the apartment, taking pictures and removing electronics while two agents were interviewing her; it was only after they were basically finished that she signed the consent form.

It may be that initially when they sat her down, they told her that they needed her consent and she agreed, then they had her sign the form at the end.

His defense is also upset that they took him away and separated them, not allowing BC to invoke his right to refuse a search without a warrant and thus negate her consent to the search. I am by no means a legal expert, but my guess is that they will say they had probable cause to arrest him when they executed the warrant, as they had determined that it WAS his car YY had boarded on June 9th, and that he had lied to them when they questioned him on the 12th regarding the incident.

Sorry, can I ask where that info is from? I've never heard this. Was it in the PDF of the filings? If it is I must have overlooked it.....

That might be. They gave lots of legal precedent to support their motions, and not being a lawyer I skimmed over most of that.

Ive got to get some sleep, so I will check on it again tomorrow

We are about to enter a hectic time of this case -unless they do seek death, which will result in everything likely bring pushed back several more months.

I am keeping an eye out for more info on the Wayne County remains. I doubt they are YY, but it is still possible. The FBI got down there in a hurry and in force when those remains were found, and they were shipped off to Quantico ASAP.

I hope they take steps to protect the girlfriend at this point.
What she must be going through after that today, and reported on all media.. she must be very frightened.. they have impugned upon her character, integrity reputation and her mental and psychological state in a most vicious and sadistic fashion.
They want all the evidence seized to be returned and they have accused the prosecution of all kinds of unprofessional behaviour.

Is this 'interfering with a witness'?

Suppose her confidence becomes destroyed now and she refuses to testify as a result?

up to today, she was just a person he seemed to have met up with at the march.. she had never been identified as his girlfriend or as the person wearing a wire.

I am new to WS and don't know how to post pictures. But if you Google crime scene investigator suit you will see the "hazmat type suits" I was referring to. These suits are worn, not as PPE for the wearer but for protection of evidence from cross contamination. So regardless of what chemicals, etc that were at that plant, they were worn to protect any potential evidence. I cannot find the article from the search of the Johnson plant, I think it may have been posted by the Champaign Police Department's Facebook page.

The defense has some weight to a few their motions. However, since lake and Henry counties were searched for YYZ, one has to wonder why the request to move there and not some obscure county in Illinois. Could it be that she IS in one of those places and BC suggested them so he can feel superiority over the prosecution?
Rock Island is in Rock Island County, not Henry County. Henry County is where I am, though. They searched all the way over here in Henry? That's an hour west of Peoria!

Rock Island is one of the Quad Cities, 2 from Iowa and 2 from Illinois, right on the Mississippi River way over in Western Illinois.

They both make sense. I have a hunch they think he put her in a body of water. Lake would suggest dumping her in a marshy area near Lake Michigan or in he lake itself. Henry County would suggest he might have put her in the Rock River, with the idea that she would be washed into the Mississippi and never be found.
Henry County has Edwards River (not a good place to dump as it is narrow as a creek in my area), Green River, and the Hennepin Canal.

All mail can be read at the prison. It's all opened to look for contraband, and it's common for the correspondence to be read as well.

I'll wait to see what he says, but one of the Chicago newspaper articles said that "cadaver dog teams from as far away as Lake and Henry counties had been used in the search." That made it sound like they brought in dogs from those counties, not like locations in those counties had been searched. Not sure.

Also, doesn't the Rock River run along part of the northern border of Henry County? I thought that I-280 running along that river was basically the boundary between Henry and the adjacent county (name escapes me at the moment.....)

Rock Island County. Yeah, I believe it runs somewhere near Colona in Henry County. But we think of it as being mostly in Rock Island County. (Great place to spot eagles.) The Rock River is getting bigger and threatening to take over the interstate on I-74 (not far from the 280 exchange). What used to be wooded land on the edge of the highway is now under water.

I would be surprised if he came out here for dumping. I'm with you, thinking they simply borrowed our dogs.

I can't believe all this. Oh how I hope they find poor YingYing. He can't stop blabbing - 7 recorded conversations and blabbing to an inmate.
No way they will toss out all this evidence. He might get the change of venue but that's all. Even if they disallow the recordings there is still the testimony of the witnesses - especially the woman he attempted to abduct earlier the same day. Gold dust imo.
 
Ooh. Bring it to Rock Island and put some of my friends on the jury.

He ain't doin' no better here.

I used an iPad and was able to read the pdf. I should be able to download it on my laptop later.....
 
These motions to dismiss are going nowhere. They had every right to search the apartment even though the warrant was just for the vehicle. The girl was missing at the time and they did not know if she was alive or dead. For all they knew, she was locked up in that apartment.

The motion to dismiss is all slanted, spun, facts to help defend Christensen. It sounds good, but it's really just emotional appeals (a knock in the middle of the night! She was naked!) and sophistry. I'm a student and can see through it, the judges surely will as well.
