Lafayette police sgt is quoted as saying that it isn't currently clear if Elisard Moneus is Jacob's father. He says that he is a suspect in Jacob's death, but the charges are for a previous DV dispute and are not related to Jacob's death.

Edit…sorry, didn’t finish! Since they knew the baby to be believed to be in danger, all stops should have been activated. I know they are now saying the baby was probably dead before the Silver Alert was called, but they didn’t know that then.

It’s crazy.. They actually found him driving near Sheridan, IN. When they pulled him over & saw he didn’t have the baby with him, they arrested him & brought helicopters, firefighters & many LE were on foot looking for this baby.

Even if EM and the baby's mother was in a relationship or married doesn't mean that JM had to be EM's biological child, the child could have got EM's surname at birth due to the relationship. If EM later on began to be suspicious about the child's paternity, and asked for a paternity test, it's not sure the result had yet arrived, or unfortunately, the result had arrived and had shown he wasn't the biological father.

Lafayette Police Department officers met with the woman at the hospital, who said Eliasard got upset with her on Aug. 5 and they hadn’t talked since.

On Saturday, she’d been sitting in her bedroom watching TV with Jacob when Eliasard entered the room, took Jacob, then left the apartment with him. Thirty minutes later, Eliasard came back, went to the bedroom, and began striking her with a “tire iron or wrench multiple times.”

Eliasard left the home after the attack. The mom was unable to locate Jacob afterward. She then took herself to the hospital for treatment of a skull fracture and lacerations on her face.

Court documents say officers searched their apartment and found blood spatter. They could not locate the 3-month-old during the first search.

Eliasard later admitted to hitting his wife with a tire iron, saying he “hoped (she) was going to die from her injuries.” He also said the child was at the apartment during the attack, but denied leaving the apartment with him or knowing where he was.

During a second search of the Moneus’ home early Sunday morning, police found the child’s body in a lidded bucket by the kitchen trash can.

Awful… “open this” makes me think of appliances (like the oven or washing machine), or the toilet bowl tank, or ceiling access space.
uggh. 3 months is wee. No bigger than a bread box really. Microwave, crawl space access, oven, fridge, freezer, the possibilities are endless. :confused:

ETA just read that it was a bucket near the trash. Poor sweet baby.

Moneus' wife said they had been married about 11 months and that he was angry with her since Aug. 5. They had not spoken to each other through the week, according to prosecutors.

Eliasard Moneus appeared in court Monday afternoon for hearings about possible charges in allegations that he severely battered his wife, as well as possible charges alleging he killed his 3-month-old son, Jacob.

Prosecutors received a 72-hour extension to file formal charges.

A bond request form obtained by FOX59/CBS4 also indicates Eliasard Moneus “has few ties, if any, to the community” and “is a foreign national believed to be unlawfully present in the United States.”

An autopsy was scheduled to be performed on Eliasard’s son on Monday. The autopsy states that the preliminarily cause of death for the infant was asphyxia. The Tippecanoe County Coroner’s Office has preliminarily ruled the child’s death a homicide.

Three-month-old Jacob Moneus drowned in a bucket, Tippecanoe County Coroner Carrie Costello said, citing Monday's preliminary autopsy results.

Lafayette police confirmed Monday that the liquid in the orange bucket where baby Jacob was found appeared to be laundry soap.

There were no signs of obvious trauma to baby Jacob's body that might have contributed to the infant's death, Costello said.

Moneus sat alone at the defense table in the small courtroom without anyone from his Haitian community or the Greater Lafayette community to support him. He remained quiet except when asked if he understood parts of the hearing, during which he answered in his native language.

A Hatian Creole translator joined Monday's hearing by Zoom and relayed Magistrate Sarah Wyatt's explanation that prosecutors have until Thursday to file charges. The translator also detailed Wyatt's specific instructions about a no-contact order with his wife, whom Moneus is suspected of severely beating with a tire iron.

Eliasard Moneus was formally charged on Thursday in Tippecanoe Superior Court 2 on one count of murder, one count of aggravated battery, one count of criminal confinement, and two counts of domestic battery, online records say.

Moneus was arrested by IMPD in Lawrence before being arrested by Lafayette police and brought back to Tippecanoe County. He has been in jail ever since.

A judge has ruled Moneus will stay in jail throughout his court proceedings. He has another hearing set for Sept. 30.

“Would it be fair to say that you understand what I have read to you, but you disagree with some or all of the charges?” Wyatt asked to bridge the language difference.

“Indeed, I heard everything that you say, and I understand," Moneus said in response through his translator, "but when it comes to killing people, I don’t know about it.”

A bond request form filed Thursday modified prosecutors' language about Moneus' immigration status, stating, "The defendant is not a U.S. citizen and is a citizen of Haiti. The State is investigating whether the Defendant is lawfully present in the United States."

What is happening to our society? Another case of a man who hated his wife (more like his possession) so bad that he wanted to destroy her and everything dear to her. He probably thought he had killed her when he killed the child. He beat her with a tire iron so I am sure she was unconscious for some time and had no idea what he had done with the child…she just woke up and they were gone so she assumed he took the child with him. Poor woman.

That's not as off the wall as it may seem- I speak fluent Spanish, but were I to be tried for a crime in Mexico, I'd still ask for an interpreter. There are just too many little nuances of language that non-native speakers don't catch, that could be REALLY important in a court situation. (Also we want this... individual... to be provided with absolutely zero grounds for appeal at a later time, so better to cover all bases now.)

Kind of like.. oh, you have no trouble saying this to your wife, yet…

(I understand language is difficult, I have taken years of Spanish & still feel like I hardly know it. This situation is just upsetting to me)

On Thursday, Aug. 15, the 28-year-old appeared in court for an initial hearing and told judge Sarah Wyatt through a court-appointed Haitian Creole translator that he did not agree with some of the charges, according to the Lafayette Journal & Courier. The judge eventually entered a not guilty plea on his behalf, according to an initial hearing order obtained by PEOPLE.

Moneus could face 45 to 65 years in prison if convicted of murder, as well as 20 to 40 years in prison if convicted in connection with the alleged attempted murder of his wife, the outlet added. He also signed a no-contact order for his wife, and court records state that his jury trial is set to begin on Jan. 21, 2025. He is next due in court on Sept. 30.
