Yesterday afternoon's testimony: More to read at link http://www.9news.com/article/news/l...ear-more-evidence-in-blagg-trial/73-530455593

[Chris Buechner] detailed the searches for *advertiser censored* found on Michael Blagg’s home and personal computer, as well as the Powerpoint document he kept showing pornographic images.

Michael Blagg told investigators he only watched *advertiser censored* with his wife between 8 p.m. and 10 p.m. for “ideas.” Buechner’s testimony refuted that.

He claims Blagg would watch *advertiser censored* late at night and early in the morning, as well as intermittently on weekends.

..

Jim Hebenstreit and another Mesa County investigator took video from outside the home and recorded the messages that had been left on the answering machine.

Michael Blagg left five voicemails that day.

“Good morning gorgeous, I’m just calling to see how you and Abby are doing,” was how the first began.

Another began with “Hello my beautiful bride … I hope you’re out and about doing all kinds of cool and nifty things.”

In the final voicemail, Blagg says “Hello sweetie, it’s me. Starting to get a little bit worried about you. I’ll try to call you on your cellphone.”

Thanks again for the updates Tortoise!!!

This morning's update to read at link - http://www.9news.com/article/news/l...he-wanted-to-see-the-crime-scene/73-530679173

Two days later, on Nov. 12, 2001, Shirley saw her friend Jennifer Blagg drop her daughter off at school. She said she was not feeling well, but nothing seemed amiss.

..

The prosecution is expected to rest its case on Friday. Marilyn Conway, Jennifer Blagg’s mother, could possibly testify on Wednesday afternoon. Attorneys from both sides debated what she can and cannot discuss during her testimony before the lunch break.

In the previous trial, she testified that Jennifer Blagg was the victim of domestic abuse.

Thanks for the updates Tortoise.....:tyou:

Interesting afternoon in court in the #MIchaelBlagg case. Defense just requested a mistrial based on testimony from the victim's mother Marilyn Conway.

The defense made the request after Conway testified about a conversation she had with her son-in-law when she learned about his use of *advertiser censored*.

Conway testified that she told #MichaelBlagg that she didn't believe that her daughter would ever bring *advertiser censored* into her life, and said “I told I held him completely responsible.”

The defense argued at a break that the jury will have inferred that Conway was referring to Jennifer and Abby's disappearance, not the *advertiser censored* use.

The judge disagreed, but agreed to admonish Conway outside of the jury's presence that she needs to be careful not to include commentary about her opinions on Blagg's guilt or innocence.

Now I knew his first trial had been mentioned before today, by the defense! The guy who didn't mention the garage door being open in the first trial! Do they think the jury is asleep?

Troxell also pressed Scott on why he didn’t mention the garage door being open when he testified during Michael Blagg’s first trial.

He told the jury he was “was mistaken, apparently,” when he testified in 2004.

The judge nixed a request from Michael Blagg’s public defenders to declare a mistrial Thursday morning following what they said were improper statements made by the mother of his slain wife.

Tina Fang, one of Michael Blagg’s public defenders, had asked for a mistrial after Conway accidentally implied there had been a previous trial.

Chief Deputy Mesa County District Attorney Mark Hand said that Conway had mentioned the previous trial because she was confused by a transcript Fang had given her during cross-examination, and didn’t mean any harm. He also brought up the fact that the previous trial had been mentioned by accident multiple times during testimony.

Fang said she believed Conway was intentionally trying to cause a mistrial and asked that she be thrown out as a witness.

The prosecution is expected to rest its case on Friday, and the defense expects to take two weeks, give or take.

Testimony in the Michael Blagg trial continues all day on Thursday.

I can't think why Mrs Conway would have been trying to cause a mistrial. It seems the defense is grasping at straws to get this case to collapse.

DAYS BEFORE DISAPPEARANCE, JENNIFER BLAGG ASKED BEST FRIEND TO PRAY FOR HER

JEFFERSON COUNTY - Even though her testimony the day before prompted the defense to ask for a mistrial and call what happened an egregious violation of the Colorado and U.S. Constitutions, Marilyn Conway’s time on the witness stand on Thursday morning ended with little additional drama — and no redirect examination.

In fact, it was over so fast that the prosecution had to scramble to bring in their other witnesses when they suddenly found themselves in a place they hadn’t been in since jury selection began a month ago: ahead of schedule. And from there, following a day that was marked with contentious legal back-and-forth from the attorneys that took up large chunks of time and forced the jury to leave the room on multiple occasions, Michael Blagg’s second trial once again returned back to normal.

Edith Melson was the second person to take the witness stand this week to call herself Jennifer Blagg’s best friend. They met at their church in Simpsonville, South Carolina.

When Jennifer Blagg and her family moved to Grand Junction in 2000, they talked on the phone once a week. Those calls tapered off over time, but 10 days before Jennifer Blagg and her 6-year-old daughter Abby went missing, Melson received a phone call from her friend.

Jennifer Blagg said she and Abby were planning a visit. Melson said her friend seemed “upset” and had asked that she “pray for me.”

That was the last time she’d hear from the 34-year-old. On Nov. 13, 2001, her husband Michael Blagg called 911 and said when he returned home from work, he found the backdoor ajar and a jewelry box thrown on the floor of the master bedroom. There was a large splatter of blood on his wife’s side of the bed.

CRIME SCENE WHERE JENNIFER BLAGG WAS MURDERED WAS 'CONSISTENT WITH STAGING,' EXPERT SAYS
http://www.9news.com/mobile/article...sistent-with-staging-expert-says/73-531344771
JEFFERSON COUNTY - Jurors once again saw the blood-stained bed where Jennifer Blagg likely died as a crime scene reconstruction expert led the court through her analysis of what may have happened during the early morning hours of Nov. 13, 2001.

Iris Dalley took the witness stand on Friday morning. She’s an expert in crime scene reconstruction and blood spatter analysis who has been retained and paid by the prosecution since 2015 — shortly after the Mesa County District Attorney’s Office learned that it would once again have to prove that now-55-year-old Michael Blagg killed his wife.

So the CBI is testifying against the prosecution?

A preponderance of evidence is not evidence beyond a reasonable doubt. What's going on?

And I notice they didn't have samples of Abby's hair to check against the hairs found. Surely they could have checked for a familial match.

Deputy Mesa County District Attorney Trish Mahre says that she thinks there’s a preponderance of evidence that proves it was Michael Blagg, from the 911 call in which he knew his daughter was missing before he actually checked on her to witnesses that saw him carting trash through Ametek Dixson the day of the murder, to expert testimony that called what occurred a “staged domestic homicide.”

[...]

Another witness, Breanna Wieker, took the stand to discuss a strange man she saw walking across the street near the Blagg home at around 1 a.m. or 2 a.m.

First trial on 4-16-04 found guilty, sentenced to LWOP; due to a juror lying on Jury questionnaire, new trial granted; Venue change from Mesa County to Jefferson County.
*3/24/18 update: Pros rested their case on Friday, 3/23, and the defense will take about 2 weeks (3/26 to 4/6).

From the article in post #178

“There’s no eyewitness, there’s no smoking gun, there’s no ‘this is the definitive evidence that connects him to the crime,'” said Judge Tamara Russell....

No eyewitness to the murder, but he IS on camera disposing of stuff in his work place trash, and his wife just HAPPENS to be found in the same area??? I'd say that was a "sort of" eye witness.

and this:

She cited unknown hairs found in the Blagg’s master bedroom and in the tent where the body of Jennifer Blagg was found. Murphy only had known hair samples from Michael Blagg and a few from the body of Jennifer Blagg.

There were none for Abby.

What? No hair brush?? No hairs in her bed???

and again THANKS for the updates Tortoise!

Oh - question - is it true the Defense will take 2 weeks for their case? I must have read that somewhere in your articles or did I miss read to mean they are BEHIND 2 weeks in this case??
