Private investigator had one advantage police lacked in finding Lucas' body

Hours after Emily Glass led a private investigator to the body of 5-year-old Lucas Hernandez and after the investigator had been interviewed by detectives Thursday, he shared something with Sheila Medlam.

And it was this: Glass told the private investigator “that she put Lucas to bed Friday night (Feb. 16), that when she woke up Saturday morning (Feb. 17), he was dead,” Medlam said.

Marshburn told her he made a plan to put Glass in a truck and persuade her to tell where Lucas was.

His strategy, Medlam said, was to take her out in the truck and convey to her that people know where Lucas is and were “zeroing in on it.”

Marshburn declined to talk about Glass' reaction at the scene for fear of jeopardizing the prosecution's case. He also refused to say whether Glass had told him what happened to the boy.
He said it took him and Ward about four hours to actually find the body after they got to the general area, and had to work off clues rather than go right to it. They drove around with Glass as they talked and looked, he said.

"All those roads look alike, all those bridges look the same, all those woods — everything just looks the same. And then you go from winter to summer, I mean things just change, and you are dealing with a person whose mind is not even clear all the time," Marshburn said. "We had to do it step by step."

It wasn't police who broke the Lucas Hernandez case, but rather a private investigator from North Carolina.

He spoke to KAKE News from his home, taking us through the moments he found Lucas' body.

Wichita Police investigators have presented their evidence against the stepmother of Lucas Hernandez.

Police met with representatives of the Sedgwick County District Attorney's office this morning.

Emily Glass was arrested last Thursday, hours after Lucas' remains were found in Harvey County. Lucas had been missing since February.

She remains in the jail on a count of interference with law enforcement. Her bond is $250,000.

“Cold and callous,” Marshburn explained when asked about Glass’ demeanor. “She kept her sunglasses on, kept her arms crossed, didn’t say anything but short answers, and basically no emotion, not one time…..It was like staring at a photocopy of her mugshot.”

Marshburn explained that over the next several hours, Glass continued to evade his questions until he explained that the state could likely issue a death certificate for Lucas in seven months even without a body, and that Glass could still be liable. At that point, according to Marshburn, Glass’ demeanor changed and she began talking about Lucas, explaining the little boy simply died in his sleep.

Further, Marshburn said that after he told Glass detectives may push for drug testing using her hair follicles, she admitted to him she smoked “meth” while caring for Lucas and her toddler daughter. The PI said at that point he gained enough information from Glass to call law enforcement and possibly have her arrested, but he decided to press on, in hopes of her leading him to Lucas’ remains. Eventually, Glass did just that.

Lucas was clothed and buried under branches, but in open view to Marshburn once he peeked under the small bridge. His little body was fairly decomposed, lying in the exact way Glass described to Marshburn. His hair had turned almost white due to the sunshine hitting through a slit in the bridge and directly onto his head for three months.

Glass stayed in the vehicle while Marshburn looked for and found Lucas. When Glass realized Marshburn discovered the little boy, she reportedly didn’t cry or display any emotion. She then claimed she did Lucas “so wrong” but didn’t elaborate, never admitting she hurt Lucas in any way.

“You don’t give two craps about your stepson you put under this bridge, abused, and you killed,” Marshburn said, referring to Glass. “All you care about is what’s going to happen to you.”
 
This comes after Sedgwick County District Attorney Marc Bennett announced Wednesday that no charges would be filed at this time in the case of five-year-old Lucas Hernandez.

Wichita police presented their case against Glass to the district attorney's office Wednesday morning. Glass is the live-in girlfriend of Lucas' dad, Jonathan. She is also the woman who led a private detective said led him to the Lucas' body on Thursday, May 24.

No charges have been filed in death of 5-year-old Lucas. Investigation is continuing.
 
DA: No charges today in Lucas Hernandez case, Glass to be released

No charges will be filed Wednesday in the death of Lucas Hernandez, according to District Attorney Marc Bennett.

Bennett said investigators are continuing to follow newly developed leads and are awaiting the results of forensic examinations.

The investigation is not final until the autopsy is complete and the toxicology results are available, Bennett said in a brief statement Wednesday afternoon.
 
Stepmom of Lucas Hernandez is released from jail days after boy's body found

Emily Glass — who police say led a private investigator to the body of 5-year-old Lucas Hernandez — walked out of the Sedgwick County Jail on Wednesday after District Attorney Marc Bennett announced that he would not be filing charges in the boy’s death that day.

A veteran Wichita defense attorney said that her release from jail at this point doesn’t mean much.

Glass was booked into jail late Thursday, May 24, after her stepson's body was found underneath a rural Harvey County bridge. She was booked on suspicion of interference with a law enforcement officer and obstruction and held on a $250,000 bond.

Once a person is booked into jail on suspicion of a crime, as Glass was, they must be released from jail within a limited amount of time if they don’t get charged.
