8/3/22 Update: Plea hearing was rescheduled on 8/18/22. 8/18/22 Update: Plaintiff appears by attorney Hurst & defendant with attorney Toth. Phelps pled guilty Thursday to involuntary manslaughter in the death of her 17-month-old son in a house fire & also pled guilty to endangering a child. Phelps admitted to leaving her son, Nicholas Ecker Junior, home alone back in February for a long period of time. As part of the plea agreement, Phelps is expected to cooperate with prosecutors & testify against the boy’s father, Nicholas Ecker, Sr. As part of the deal, prosecutors are recommending that Phelps serve 10 years behind bars with no probation. Also as part of the agreement, charges against Phelps of intimidating a witness & violating a protection order would be dismissed. Presentence investigation ordered. Sentencing will be in person, defendant ordered to personally appear. A judge denied a request to release/bond. She’s scheduled to be sentenced on 10/6/22.
*Karlie Mae Phelps (28) arrested (3/2/22) & charged (3/11/22) with violating a protection order & intimidating a witness (on 3/2/22). Plead not guilty. Surety Bond $350K. Posted bond (3/11/22).

A Johnson County judge sentenced 28-year-old Karlie Phelps to 18 years in prison. She previously pleaded guilty to involuntary manslaughter and child endangerment charges stemming from the fire that killed her 17-month-old son.

But... in these sentences it says:

In a clarification, the Johnson County District Attorney’s office said that while a judge sentenced Phelps to prison, the judge also granted Phelps’ request for dispositional departure. With that request, Phelps will serve three years of probation instead of prison time.

If Phelps violates any of the terms of her probation she will serve the remainder of her sentence in prison.


Does that mean she is NOT going to prison for 18 years?? But on probation for 3 years? Am I reading the right??

Anyone know?

Thanks for posting this - but it still doesn't make sense to me! LOL! :D

So for Count 1 - 216 months equals 18 years. And she was granted 3 years probation.
Count 2 - 1 year to run concurrent.

So after 18 years in prison she will be on 3 years probation? Yes / No ?? :)

That is the way it sounds to me also. I guess maybe we might hope for a better article explaining better information. :eek:

I don't know, but I suspect that she's out or will be soon. It says ISP granted -that's Intensive supervised visitation. And she wasn't referred to the DOC, she was referred to the county and already being screened for work release ? Vinelink doesn't show her in custody anywhere, but I'm gonna look some more. Per vinelink

She previously pleaded guilty to involuntary manslaughter & child endangerment charges stemming from the fire that killed her 17-month-old son. In a clarification, the Johnson County District Attorney’s office said that while a judge sentenced Phelps to prison, the judge also granted Phelps’ request for dispositional departure.
