Shocking video showing the killing of a Kentucky judge in his chambers was played Tuesday at the preliminary hearing for the former sheriff accused of his murder.

Shawn “Mickey” Stines, 43, who officially resigned Monday as sheriff of Letcher County, appeared in court in a jail uniform and handcuffs as prosecutors presented their evidence in the murder of District Judge Kevin Mullins.

Judge Rupert Wilhoit found probable cause to refer the first-degree murder charge to a grand jury. Defense attorneys did not deny that Stines shot Mullins, 54, last month, but suggested Stines was experiencing an “extreme emotional disturbance” at the time of the shooting.


“I think they’ve established probable cause for manslaughter first, but not murder,” defense attorney Jeremy Bartley told the judge.

"I was told Sheriff Stines tried to call his daughter, and tried to call his daughter from the judge's phone also," Kentucky State Police Det. Clayton Stamper said.
Surveillance video capturing the entire shooting was played during the hearing. A woman could be heard shrieking from the back of the courtroom as Stines was seen firing his weapon several times at Mullins.
After the first series of shots, Mullins tried to take cover behind his desk. Stines is then seen walking around and firing more shots.
Just as Stines is about to exit the room, he stops and fires at Mullins again.
"He was mostly calm [after the shooting]," Stamper said. "I talked to him, but he didn't say anything about why this happened. He was calm. Kind of afraid. Basically all he said was, 'Treat me fair.'"

Bartley also argued that the charges against Stines should be amended down to manslaughter due to Stamper’s testimony that claimed there was no evidence to show the shooting was planned and was the result of “extreme emotional disturbance.”

The Commonwealth objected to this motion, which was ultimately sustained because Mullins was not believed to be armed at the time of the shooting.

Kentucky State Police Trooper Matt Gayheart told FOX 56 News on Wednesday that contrary to how it was stated in court, investigators won’t know if her number was saved in Mullins’ phone until forensic reports come back in a few weeks. However, the call log reportedly showed her number had been called prior to the shooting.

Surveillance video showed that the shooting occurred just moments after the calls were made.

Stamper said that Stines’ daughter has been interviewed with a parent present, but her phone was not collected as evidence yet.

State law says an outgoing sheriff must make a settlement — pay off all bills and remit all collected taxes — at the end of his term. The incoming sheriff starts with little or no money in the accounts, and any tax bills that have not yet been collected.

That means Stines’s office won’t have much to work with until it begins collecting taxes this month.

Stines has already hired some of his staff, but he won’t be able to hire most until money starts flowing. He said Billy Jones, a Blackey native who has retired from the Nicholasville Police Department, has been approved by the Letcher County Board of Education to serve as school resource officer at Letcher County Central High School, and the sheriff ’s department will receive reimbursement from the school board for his salary. The department also receives part of the money for circuit court bailiff Mike Enfusse and new district court bailiff Ben Fields.

Stines, 38, worked for seven months as a Neon police officer in 2001, for about a year for Sheriff Steven Banks in 2002, and has been a bailiff under Webb since Webb took office in January 2003.

ETA: Billy Jones was sworn in as the new Sheriff when Stines arrested/retired, and Ben Fields was terminated Feb 2022 after a civil suit filed against Fields and Stines (in Capacity as Sheriff). Fields was later criminally charged for SA of the Plaintiffs.

Caldwell said in her ruling that while Congleton was engaged in protected political speech, she could not prove that was the reason she wasn’t rehired. Caldwell said she present affidavits from two other deputies, Eugene Slone and Barry Engle, both of whom ran for sheriff and lost, and there was nothing in the affidavits showing that Stines refused to rehire her because of her political activities.

In a suit filed Jan. 31, Sabrina Adkins alleged that when she couldn't afford to pay for home detention, Deputy Ben Fields told her she would receive "favorable treatment for sexual favors," then met her six times late at night last year in a district judge's chambers where he forced her to have oral sex and sexual intercourse.

Letcher County Sheriff Shawn Mickey Stines fired Fields Feb. 2 for "conduct unbecoming," according to a letter provided to The Courier Journal under the Kentucky Open Records Act.
