Is there a chance she could get a longer sentence than her original sentence of 40 years? I ask because IIRC, Dalia Dippolito could not be sentenced to longer than her original sentence when she had a re-trial.

Not sure how sentencing works. Keep in mind these cases were tried in different states with different laws.

I believe the jury in this case has to recommend a sentence to the judge. Then the judge can decide if it sounds appropriate but is not required to impose what jury recommends.

I have to say that IMO if a law prohibits a harsher sentence it should also prohibit a more lenient one if the jury does not recommend leniency.

Also keep in mind that even though most jurors do not fall for a defendant's story on face value alone, one juror in each of the Arias trials believed some of the lies vomited by the killer about why she "had to kill" Travis. Zervakos stated after the fact that he believed some of Jodi's tales of Travis being abusive.

You never know what a jury is going to do and I don't think this one will acquit but it is possible they won't reach a unanimous verdict. It only takes one to throw it all away.
 
Not only did Shayna Hubers admit Thursday that she fired six shots while killing her boyfriend, she rather casually offered almost as many reasons for unloading the gun on him.

Hubers, testifying for the second day in her murder retrial, originally told police she wanted to put Ryan Poston out of his misery after the 2012 shooting in his Highland Heights condo. She said Poston was twitching after the first shot and that it was too painful for her to watch.

But under cross examination from Commonwealth Attorney Michelle Snodgrass, Hubers volunteered three more reasons.

"One was that when I first shot him he let out a really loud noise that sounded like an animal. It was a very animalistic noise. I scared me. It freaked me out," Hubers said.

"I also wasn't sure when I first shot him where the shots had entered or if I had just made him more angry and therefore he was more a threat - it would make the situation even more severe.

"And thirdly, I had the mistaken belief that there was another gun on the table. And though there wasn't another gun on the table at the time, I thought there was."

Snodgrass them reminded Hubers of a private comment she made after her arrest, when she said the shooting had given Poston the nose job he wanted.

Snodgrass: “And, you were concerned enough for Mr. Poston that you wanted to make sure he didn't have to live with a deformed face, weren't you?"

Hubers: “I said that.”

Has it not been proven that she used others phones to send herself and Ryan texts? IMO this is not a reliable text and most likely a lie.

Can LE tell if the text actually came from her phone, another cell phone or was that the text rerouted to look like it came from Ryan’s cell phone?

Are any of her relatives in the court room? I am not watching any videos....just reading here. I would not know what they look like anyway.

"The prosecution began its cross-examination of Shayna Hubers Thursday by pointing out discrepancies between her statements and physical evidence of her fatal shooting of her boyfriend.

“You’re telling the jury all the things that you think are inaccurate now are things that don’t match the physical evidence,” Prosecutor Michelle Snodgrass told Hubers.

Snodgrass noted several changes in Hubers' accounts of what she was wearing, whether a door in Ryan Poston's condominium was locked and whether she grabbed the gun used in the shooting out of Poston's hand the night of Oct. 12, 2012.

Fidelity was another topic Snodgrass asked Hubers about...."
