*Hearing – (@ 9:30am ET) - LA – Justin M. Bloxom (12) (Mar. 30, 2010, Stonewall; abducted & murdered) – *Brian Douglas Horn (42/34 @ time of crime) arrested & charged (3/31/10) & arraigned (1/3/12) with 1st degree murder & kidnapping. Plead not guilty. DA seeks DP.
Suspect texted Justin pretending to be a 15-yr old girl.
Trial started 3/18/14, jurors reached a verdict on 4/2/14. Took them 45 minutes to reach guilty verdict; received the death sentence in May, 2014.
9/7/18 Update: Louisiana Supreme Court overturns 1st degree murder conviction & death sentence; his rights were violated when his lawyer conceded at the 2014 trial that Horn killed Justin. In the ruling, the court cited a recent U.S. Supreme Court case McCoy v. Louisiana, overturning a death penalty conviction in Bossier Parish, because defense lawyers infringed their client’s Sixth Amendment right to effective counsel, by admitting their client committed murder and seeking leniency from the jury, when their client objected to the strategy of admitting guilt. Similar to that case, Horn told his lawyers he did not want to concede guilt and admit killing Bloxom at trial. He even filed motions objecting to the legal strategy when his lawyers nonetheless admitted guilt, asking the jury to spare Horn’s life and not sentence him to death.
12/6/18 Update: DeSoto Parish ADA Lee Hall asked the court to immediately appoint Horn’s new counsel over the objection of the State Public Defender’s Board, which claims no qualified attorneys are currently available, due to a lack of funding and a shortage of certified death penalty counsel in the state. According to newly filed court records, Horn is now third on the state’s list of death penalty defendants to be assigned counsel. 42nd Judicial Circuit Judge Amy Burford-McCartney declined to appoint Horn new representation during Thursday’s proceeding. A new hearing has been set for Friday, January 11 at 9:30 a.m., to take up the matter further.
