Why can’t JMc have been in error on her time estimate? She didn’t have her phone records for texting with her on the stand. Guess I don’t see what the excitement is?
She was very careful about the times in her testimony. This wasn't something that was said offhand, she had clearly prepped.

One reason for the excitement is the timelines get very tight. If Karen was at John's home at 12:36, then she must have left 34 Fairview around 12:30-12:32. Jen testified she was staring out the door watching the SUV maneuver back and forth. Multiple people were outside at that time. Julie Nagel had gone out around that time to talk to her brother who was sitting in a truck with two of his friends. So, Karen hit John in the midst of all this activity and no one noticed? Also Brian Higgins said he left at 12:30 or thereafter.

For the prosecution 12:45 is a much better time since no one has testified to being outside.

There we go. Witness just agreed that no one could have seen KR out front of 34 Fairview at 12.45am because KR connected with JO's wifi at home at 12.36am. You know what I think: Lally relied in advance on JMc's testimony for his opening assertion that KR hit JO at c12.45. At that particular time, witness testimony indicates that no-one was definitively pulling up or leaving the house. Will the jury put two and two together and realise that this looks like Lally nominated time of impact to gell with lack of witnesses rather than concrete digital evidence? I mean it looks as if Lally conspired with JMc on that time to fit the lack of evidence. All moo
I think Proctor relied on Jen's info and the DA's office just went along.

Yeah probably but it's on Lally to know what his expert witnesses are going to testify to? Lally was an idiot imo to rely on JMc for time of impact when he has an expert with info to show that's impossible and therefore all his eliciting of times from JMc just goes to showing she lied. And therefore his opening statement is wrong on a crucial detail. Imo Lally has responsibility for understanding and assessing what goes into his opening and closing statements.

I'm trying to understand what the prosecution thought they were accomplishing playing the voicemails. I guess "She was angry, and angry people kill other people"?
Even if she did hit him, they clearly show that she had absolutely no idea. And I even understand why she's so angry, since they just had a fight about him thinking of her as "a babysitter with benefits" that morning. From her perspective, he ditched her to go party, sticking her with the kids again.

MOO
Me saying to Guarino: "Just say you didn't do any investigation in the death of Officer John O'Keefe, and you just did what Proctor ask to do. And that was to target KR."

I also wanted to tell him to stop laughing. What's so funny???
Grrr......

As for all those calls and voice mails, usually the simple explanation is the correct one in MOO.

All of this, to me, shows she was an annoying girlfriend, but not a murderer.

The previous messages between JO and KR also showed her propensity for multiple calls during a time of disagreement. This was probably a pattern for her.

At the very least....it shows she believed him to be alive.
