But if she rules to dismiss the charges, surely the CW can't appeal because isn't the motion is to dismiss with prejudice and double jeopardy would apply.

Whatever happens I hope to God she's not still the judge for the next trial. She's one of the main reasons for the mistrial IMO.

She'll be the judge unless she retires or dies in the interim. Even if they move the case to western Massachusetts.

It's my understanding that the prosecution can appeal the judge's motion to dismiss in MA. Believe it's called an interlocutory appeal. Not that I think this judge is likely to side with the defense, but you never know.
 
When was the last time we've ( everyone not just people here on this forum) seen a town ripped so completely apart like this? It's coming from ALL sides. It's not just outside the town pressure, it's coming from the inside too. There's vandalism, intimidation, terrorism, drama, violence, corruption, fear, protests, counter-protests, contentious town hall meetings, more drama, FBI involvement, incitements, Internal Affairs investigations, even more drama, DEA involvement, NETFLIX series, 48hrs Episodes, Dateline Episodes, Court TV Episodes etc, etc, etc!

It's only going to get worse...WAY worse if this goes forward again. It's a modern day Hatfields & McCoys. Another trial and maybe the National Guard is going to have to come in for support. And boy once those boys and girls come to down things really tend to get weird! Roadblocks, armed soldiers in groups roaming the streets, permissions and denials, movements become "monitrored", There's guys on the roofs with binoculars and night-vison scopes, It's not fun believe me! We've had the Guard come in for some help with Hurrican relief and it's not an enjoyable slice of American Pie if you catch my meaning! The CW needs to reconsider.
It's like a trashy version of Twin Peaks.
 
In my opinion there is a lot of circumstantial evidence of a cover up.
-Two phones completely destroyed with phone numbers changed the day before a protective order came down.
-The text ‘tell them the guy was not in the house’. That is an order not a statement.
Proctors texted that ‘he thought that it was initially a fight, with no investigation

There's not going to be news articles about that specific topic, unfortunately. However, multiple family members and friends have confirmed that the McC's and A's were NOT present at his funeral. Sorry it isn't a news story.
Who are these multiple family and friends? Where did they confirm it?

The Defense are smart. They will appeal to an appalant court, and take this out of the judges claws.

Brian Higgins thinks he saw a tall dark man. And he hired an Attorney. Don’t understand the reason his attorney was allowed during testimony.

He broke the law using FBI equipment for personal reasons by extracting data from his phone in an attempt to avoid handing over everything that was on the phone to investigators. He was allowed to consult with his attorney to try to avoid further incriminating himself on the stand.

I'd love to know more about his proffer to the Feds. But I guess we'll have to wait for the book.
 
If you have a minute, please look at the difference between the judge overseeing KR's case versus the judge in the Ashley Benefeld case (go to about 29 minutes in on this second link) - these videos are both from approved sources.

The difference in decorum, attitude, professionalism, and respect for others in the court room (defendant included) are astonishing to me. Not to mention, the judge in AB case holding the verdict sheet up and explaining in detail, without so much as a hint of condescension - it was refreshing seeing a judge behave the way they are supposed to in a court room. Ethical, empathetic, patient, and full of integrity.

The verdict sheet is fully explained. There is no back-and-forth taking place, repeated uncomfortable displays of trying to show dominance against the defense team. This judge was an inspiration and he should teach classes on how to be an effective and non-biased judge.

The interesting thing about BH saying he saw a tall, dark haired man showing up briefly, is that he testified at a proceeding on June 1, 2023, that the tall guy with dark hair came into the house. He said it might have been Julie Nagel's brother, and described it as 'somebody else came' and 'he was having a conversation with the two girls', and 'it was quick'.

But everyone else testified that Julie Nagel's brother, Ryan Nagel, stayed in the truck outside while Julie went outside to talk with him. The other girl didn't go outside.

If the man he saw was Ryan Nagel, BH would have been outside when he saw him to judge his height. But the brother never got out of the truck so how would BH know if he was tall. Looking at Ryan in the courtroom, he didn't seem very tall.

So the question remains, who was Brian Higgins talking about?

If BH was outside when Ryan Nagel was there (smoking perhaps), I believe BH had an altercation with JOK right around the same time as Ryan was leaving and Karen was waiting for JOK to return to the SUV. And he left shortly after without saying goodbye, "an Irish goodbye". BH left in a rush, having only been there 20-30 minutes. And he went straight back to the police station even though he'd been drinking all night. Makes no sense.

@OldCop considered the possiblity that he went to the Police station to monitor reports. Was there reports of a body found, other reports related to the events, which makes a lot of sense. My instinct is that BH was trying to avoid committing perjury by stating that he saw a tall man show up briefly. MOO
